The Chancery Regulation Act 1862 (25 & 26 Vict. c. 42), also known as Rolt's Act was an act of the United Kingdom Parliament that was an important step in the fusion of law and equity.
From the 13th century in England and Wales, equity developed as a system of justice in parallel with and complementary to the common law. By the 19th century, with the rise of capitalism in Victorian Britain, equity had become very important. The remedies available to the common law were limited to damages and those disputes demanding an injunction or specific performance of a contract needed to be heard in equity which was administered in Courts of Chancery, separate from the common law courts. Moreover, procedure in equity was better able to handle complex disputes involving the relationship between several parties such as partnerships and trusts. [1]
However, the dual jurisdiction of law and equity caused problems for litigants. In equity, all parties had to be represented at all hearings and if one died or married complex procedures were needed to maintain the action. The rate of progress of the action was in the hands of the parties and would tend to be determined by the slowest. Many uncontroversial administrative actions, such as appointing a new trustee, were dealt with as though they were contentious, adding further delay. There were many inefficiencies in procedure with high costs and a certain amount of corruption. [1] Further, cases that involved questions of both law and equity would be hampered, shuttling between the courts of Chancery and common law courts for years, as in Wood v. Scarth . [2]
The Chancery commission (1824–26) made recommendations on streamlining procedure but the commissioners concluded that the Chancery courts themselves had the powers to improve matters. [1] Over the following decades there was much debate leading to legislation including the Improvement of the Jurisdiction of Equity Act 1852 which allowed Chancery judges to decide questions of fact rather than remitting them to the common law courts. However, by 1862, Chancery judges were still reluctant to make use of these powers so the MP Sir John Rolt introduced a bill to make determination of facts by Chancery judges mandatory. [3]
The purpose of the act was to require the Court of Chancery to determine every issue of fact or law necessary for the final resolution of the case, and thus to end the practice of sending particular issues in cases pending in Chancery, to be determined in the common law courts. In the end, the Act was weakened from its initial intentions, allowing matters of fact to referred by a Chancery Judge to be decided by the assizes. [3] [4]
The act applied to the High Court of Chancery of England and Wales and also to the Court of Chancery of the County Palatine of Lancaster which had an independent jurisdiction in equity. [5] A further act, the Chancery Regulation (Ireland) Act 1862 (25 & 26 Vict. c. 46), brought a similar reform to Ireland.
The fusion of the administration of law and equity was finally effected in the 1870s by the Judicature Acts. [3]
In the field of jurisprudence, equity is the particular body of law, developed in the English Court of Chancery, with the general purpose of providing legal remedies for cases wherein the common law is inflexible and cannot fairly resolve the disputed legal matter. Conceptually, equity was part of the historical origins of the system of common law of England, yet is a field of law separate from common law, because equity has its own unique rules and principles, and was administered by courts of equity.

The Exchequer of Pleas, or Court of Exchequer, was a court that dealt with matters of equity, a set of legal principles based on natural law and common law in England and Wales. Originally part of the curia regis, or King's Council, the Exchequer of Pleas split from the curia in the 1190s to sit as an independent central court. The Court of Chancery's reputation for tardiness and expense resulted in much of its business transferring to the Exchequer. The Exchequer and Chancery, with similar jurisdictions, drew closer together over the years until an argument was made during the 19th century that having two seemingly identical courts was unnecessary. As a result, the Exchequer lost its equity jurisdiction. With the Judicature Acts, the Exchequer was formally dissolved as a judicial body by an Order in Council on 16 December 1880.
The forms of action were the different procedures by which a legal claim could be made during much of the history of the English common law. Depending on the court, a plaintiff would purchase a writ in Chancery which would set in motion a series of events eventually leading to a trial in one of the medieval common law courts. Each writ entailed a different set of procedures and remedies which together amounted to the "form of action".
A court of equity, also known as an equity court or chancery court, is a court authorized to apply principles of equity rather than principles of law to cases brought before it. These courts originated from petitions to the Lord Chancellor of England and primarily heard claims for relief other than damages, such as specific performance and extraordinary writs. Over time, most equity courts merged with courts of law, and the adoption of various Acts granted courts combined jurisdiction to administer common law and equity concurrently. Courts of equity are now recognized for complementing the common law by addressing its shortcomings and promoting justice.

The Chancery Amendment Act 1858 also known as Lord Cairns' Act after Sir Hugh Cairns, was an Act of the Parliament of the United Kingdom that allowed the English Court of Chancery, the Irish Chancery and the Chancery Court of the County Palatine of Lancaster to award damages, in addition to their previous function of awarding injunctions and specific performance. The Act also made several procedural changes to the Chancery courts, most notably allowing them to call a jury, and allowed the Lord Chancellor to amend the practice regulations of the courts. By allowing the Chancery courts to award damages it narrowed the gap between the common law and equity courts and accelerated the passing of the Judicature Act 1873, and for that reason has been described by Ernest Pollock as "prophetic".

The law of trusts was constructed as a part of "Equity", a body of principles that arose in the Courts of Chancery, which sought to correct the strictness of the common law. The trust was an addition to the law of property, in the situation where one person held legal title to property but the courts decided it was fair just or "equitable" that this person be compelled to use it for the benefit of another. This recognised as a split between legal and beneficial ownership: the legal owner was referred to as a "trustee" and the beneficial owner was the "beneficiary".
The Court of Pleas of the County Palatine of Durham and Sadberge, sometimes called the Court of Pleas or Common Pleas of or at Durham was a court of common pleas that exercised jurisdiction within the County Palatine of Durham until its jurisdiction was transferred to the High Court by the Supreme Court of Judicature Act 1873. Before the transfer of its jurisdiction, this tribunal was next in importance to the Chancery of Durham. The Court of Pleas probably developed from the free court of the Bishop of Durham. The Court of Pleas was clearly visible as a distinct court, separate from the Chancery, in the thirteenth century.
