The commissioner for ethical standards in public life in Scotland is an independent commissioner in Scotland with the responsibility for investigating complaints about Members of the Scottish Parliament, councillors of the 32 Councils of Scotland, and board members of Scottish public bodies. The commissioner also monitors the appointment of members of specified public bodies in Scotland by the Scottish Ministers.
The Office of the Commissioner for Public Appointments in Scotland was created by the Public Appointments and Public Bodies etc. (Scotland) Act 2003.
On 1 June 2004 Karen Carlton was appointed as the first Commissioner for Public Appointments in Scotland.
The role of the office is to regulate the process by which people are appointed to the boards of many of the public bodies operating in Scotland such as the Royal Botanic Gardens Edinburgh. Appointments to these bodies are made by Scottish Ministers, who rely on a team of people to identify and recommend to them suitable candidates for appointment. The process is administered by the Scottish Government and closely monitored by representatives of the commissioner. These representatives are called Assessors. An Assessor is actively involved at each stage of every appointment regulated by the office; they act as a member of the team that recommends suitable candidates for appointment. The process followed by the team is open and transparent. It ensures that only people with appropriate skills, knowledge and personal qualities are recommended to Ministers. All vacancies are publicised and people who wish to be considered must submit an application and be assessed against the skills, knowledge and personal qualities required for the role. Every application is handled in the same way, to ensure equality of opportunity and treatment.
In 2006 OCPAS published a Code of Practice for Ministerial Appointments to Public Bodies in Scotland which sets out the principles and practices the commissioner expects the Scottish Government to adopt. [1] In 2012, Stuart Allan became acting Commissioner. [2]
The post was changed to the Commissioner for Ethical Standards in Public Life by the Public Services Reform (Commissioner for Ethical Standards in Public Life in Scotland etc.) Order 2013, legislation which came into force on 1 July 2013. [3] Prior to that there were separate pieces of legislation to deal with complaints and investigations. The commissioner's role in public standards is legislated for in the Ethical Standards in Public Life etc. (Scotland) Act 2000, Scottish Parliamentary Standards Commissioner Act 2002 and the Public Appointments and Public Bodies etc. (Scotland) Act 2003. Stuart Allan became the commissioner for ethical standards in public life in July 2013. [2] Bill Thomson was appointed as Commissioner and Accountable Officer with effect from 1 April 2014. [5]
The commissioner is responsible for reporting breaches of the Code of Practice to the Scottish ministers. The commissioner also has the power to direct the Scottish ministers to delay making appointments where the Code of Practice has been breached, and refer the matter to the Scottish Parliament. The Scottish Parliamentary Corporate Body has a statutory responsibility for appointment of the commissioner, with the agreement of the Scottish Parliament. [6]
The position is currently held by Ian Bruce, who was first appointed as the Acting Commissioner in April 2021 and is now appointed as the Ethical Standards Commissioner from 1 March 2023. Parliament approved the appointment of Ian Bruce to take up the full-time post of Commissioner for a fixed term of 6 years. Ian Bruce has had over 15 years of specialist experience, being appointed the public appointments manager under previous Public Appointments Commissioners for Scotland. In that capacity he recruited, trained and managed the contracts of public appointments advisers, dedicated professionals with expertise in recruitment and selection and equality and diversity, who represent the independent Commissioner on selection panels to identify new board members. In the United Kingdom, non-departmental public body (NDPB) is a classification applied by the Cabinet Office, Treasury, the Scottish Government, and the Northern Ireland Executive to public sector organisations that have a role in the process of national government but are not part of a government department. NDPBs carry out their work largely independently from ministers and are accountable to the public through Parliament; however, ministers are responsible for the independence, effectiveness, and efficiency of non-departmental public bodies in their portfolio.
The High Court of Justiciary is the supreme criminal court in Scotland. The High Court is both a trial court and a court of appeal. As a trial court, the High Court sits on circuit at Parliament House or in the adjacent former Sheriff Court building in the Old Town in Edinburgh, or in dedicated buildings in Glasgow and Aberdeen. The High Court sometimes sits in various smaller towns in Scotland, where it uses the local sheriff court building. As an appeal court, the High Court sits only in Edinburgh. On one occasion the High Court of Justiciary sat outside Scotland, at Zeist in the Netherlands during the Pan Am Flight 103 bombing trial, as the Scottish Court in the Netherlands. At Zeist the High Court sat both as a trial court, and an appeal court for the initial appeal by Abdelbaset al-Megrahi.
The Conflict of Interest and Ethics Commissioner of Canada is an entity of the Parliament of Canada. The commissioner is an independent officer of Parliament, who administers the Conflict of Interest Act and the Conflict of Interest Code for Members of the House of Commons and is supported in this role by the Office of the Conflict of Interest and Ethics Commissioner. The position came into effect on July 9, 2007, with the coming into force of the Conflict of Interest Act. This act, in turn, was enacted as part of the Federal Accountability Act.
Public bodies of the Scottish Government are organisations that are funded by the Scottish Government. They form a tightly meshed network of executive and advisory non-departmental public bodies ("quangoes"); tribunals; and nationalised industries. Such public bodies are distinct from executive agencies of the Scottish Government, as unlike them they are not considered to be part of the Government and staff of public bodies are not civil servants, although executive agencies are listed in the Scottish Government's directory of national public bodies alongside other public bodies.

It was established in 1965 to keep Scots law under review and recommend necessary reforms to improve, simplify and update the country's legal system. It was established by the Law Commissions Act 1965 at the same time as the Law Commission in England and Wales.
The Independent Police Complaints Commission (IPCC) was a non-departmental public body in England and Wales responsible for overseeing the system for handling complaints made against police forces in England and Wales.
The Ethical Standards in Public Life etc. (Scotland) Act 2000 is an Act of the Scottish Parliament which established that the Scottish Ministers had to issue a code of conduct for councillors, and put in place mechanisms for dealing with councillors in contravention of the code. It was introduced by Scottish Executive minister Wendy Alexander.
The Committee on Standards in Public Life(CSPL) is an advisory non-departmental public body of the United Kingdom Government, established by John Major in 1994 to advise the Prime Minister on ethical standards of public life. It promotes a code of conduct called the Seven Principles of Public Life, also known as the Nolan principles after the first chairman of the committee, Lord Nolan.
The Standards in Public Office Commission (SIPO) is an independent body established in December 2001 by the Irish Government under the Standards in Public Office Act 2001. It replaced the Public Offices Commission which had been established in November 1995 by the Ethics in Public Office Act 1995.

The Scottish Land Court is a Scottish court of law based in Edinburgh with subject-matter jurisdiction covering disputes between landlords and tenants relating to agricultural tenancies, and matters related to crofts and crofters. The Scottish Land Court is both a trial court and an appeal court; hearings at first-instance are often heard by a Divisional Court of one of the Agricultural Members advised by the Principal Clerk. Decisions of the Divisional Court can be appealed to the Full Court, which will consist of at least one legally qualified judicial member and the remaining Agricultural Member. Some cases are heard at first-instance by the Full Court, and these cases may be appealed to the Inner House of the Court of Session.
The Scottish Public Services Ombudsman (SPSO) is the organisation that handles complaints about public services in Scotland. The Ombudsman service is independent of government and with a duty to act impartially.
The UK Statistics Authority is a non-ministerial government department of the Government of the United Kingdom responsible for oversight of the Office for National Statistics, maintaining a national code of practice for official statistics, and accrediting statistics that comply with the Code as National Statistics. UKSA was established on 1 April 2008 by the Statistics and Registration Service Act 2007, and is directly accountable to the Parliament of the United Kingdom.
The Standards Commission for Scotland is an independent body that has the purpose of advancing high ethical standards in public life. Its main tool is the promotion and enforcement of Codes of Conduct for councillors and those appointed to devolved public bodies.
The judiciary of Scotland are the judicial office holders who sit in the courts of Scotland and make decisions in both civil and criminal cases. Judges make sure that cases and verdicts are within the parameters set by Scots law, and they must hand down appropriate judgments and sentences. Judicial independence is guaranteed in law, with a legal duty on Scottish Ministers, the Lord Advocate and the Members of the Scottish Parliament to uphold judicial independence, and barring them from influencing the judges through any form of special access.
The Pubs Code etc. Regulations 2016 were introduced by the UK Government as part of the Small Business Enterprise and Employment Act 2015. The code was passed on 14 June 2016 and implemented on 21 July 2016.
The Scottish Land Commission was established by the Scottish Government following the passage of the Land Reform (Scotland) Act 2016 by the Scottish Parliament; the Commission also incorporates the work of the Tenant Farming Commissioner. The Lands Commissioners, who constitute the Commission, have functions relating to land in Scotland, so that they address issues which relate to ownership of land, land rights, management of land, and use of land. The Tenant Farming Commissioner has the aim of improving the relationship between tenant farmers and land owners, and can create codes of practice, provide practical guidance, and must consult on such matters. The Tenant Farming Commissioner cannot be an agricultural landlord or agricultural tenant, and will develop codes of practice which are in addition to the law and the jurisdiction of the Scottish Land Court.
The Scottish Parliamentary Standards Commissioner Act 2002 is legislation that introduced arrangements for complaints against any Member of the Scottish Parliament to be investigated independently. It established the Scottish Parliamentary Standards Commissioner, who was given powers to summon witnesses and compel evidence.
