Speculation abounded over potential nominations to the Supreme Court of the United States by President George W. Bush since before his presidency.
The Office of Legal Counsel (OLC) is an office in the United States Department of Justice that assists the Attorney General's position as legal adviser to the President and all executive branch agencies. It drafts legal opinions of the Attorney General and provides its own written opinions and other advice in response to requests from the Counsel to the President,the various agencies of the Executive Branch,and other components of the Department of Justice. The Office reviews and comments on the constitutionality of pending legislation. The office reviews any executive orders and substantive proclamations for legality if the President proposes them. All proposed orders of the Attorney General and regulations that require the Attorney General's approval are reviewed. It also performs a variety of special assignments referred by the Attorney General or the Deputy Attorney General.
Diane Joyce Humetewa is a United States district judge of the United States District Court for the District of Arizona. Humetewa is the first Native American woman and the first enrolled tribal member to serve as a U.S. federal judge. She previously served as the United States Attorney for the District of Arizona from 2007 to 2009. Humetewa is also a Professor of Practice at Arizona State University's Sandra Day O'Connor College of Law.
Steven Gill Bradbury is an American attorney and government official who served as the General Counsel of the United States Department of Transportation. He previously served as Acting Assistant Attorney General (AAG) from 2005 to 2007 and Principal Deputy AAG from 2004 to 2009,heading the Office of Legal Counsel (OLC) in the U.S. Department of Justice during President George W. Bush's second term.
During President Ronald Reagan's presidency,he nominated two people for the Supreme Court and at least twelve people for various federal appellate judgeships who were not confirmed. In some cases,the nominations were not processed by the Democratic-controlled Senate Judiciary Committee before Reagan's presidency ended,while in other cases,nominees were rejected by the Senate Judiciary Committee or even blocked by unfriendly members of the Republican Party. Three of the nominees were renominated by Reagan's successor,President George H. W. Bush. Two of the nominees,Ferdinand Francis Fernandez and Guy G. Hurlbutt,were nominated after July 1,1988,the traditional start date of the unofficial Thurmond Rule during a presidential election year. Eight of the thirteen seats eventually were filled by appointees of President George H. W. Bush.

She served as the United States Assistant Attorney General for the Office of Legal Counsel in the United States Department of Justice from 2011 until stepping down in December 2013. Seitz was confirmed to the post by the Senate in a voice vote on June 28,2011.
Mary L. Smith is an American lawyer and former principal deputy director and acting director of the Indian Health Services from October 2015 to February 2017. Previously she was general counsel for the Illinois Department of Insurance. From 2009 until August 2010,she had been a presidential nominee to be the Assistant Attorney General for the Tax Division of the United States Department of Justice. However,she was never confirmed by the Senate,and the White House in 2010 decided not to renominate her to the post. In 2023,she was sworn in as president of the American Bar Association.
Christopher Henry Schroeder is an American lawyer who served as Assistant Attorney General for the Office of Legal Counsel in the Biden Administration from 2021 to 2023. He served as the Assistant Attorney General for the Office of Legal Policy in the United States Department of Justice during the presidency of Barack Obama,serving from April 2010 until December 2012. Before and after his time as Assistant Attorney General,he was the Charles S. Murphy Professor of Law and Professor of Public Policy Studies at Duke University School of Law. He is now Professor Emeritus of the same institution.
Lucy Haeran Koh is an American lawyer serving as a United States circuit judge of the United States Court of Appeals for the Ninth Circuit. Koh previously served as a United States district judge of the United States District Court for the Northern District of California from 2010 to 2021. She also served as a California state court judge of the Santa Clara County Superior Court from 2008 to 2010. She is the first Korean American woman to serve on a federal appellate court in the United States.

Anne Rachel Traum is an American lawyer and academic who is a United States district judge of the United States District Court for the District of Nevada. She was a professor of law at the William S. Boyd School of Law in 2002 and again from 2008 to 2022.
Donald Trump,President of the United States from 2017 to 2021,entered office with a significant number of judicial vacancies,including a Supreme Court vacancy due to the death of Antonin Scalia in February 2016. During the first eight months of his presidency,he nominated approximately 50 judges,a significantly higher number than any other recent president had made by that point in his presidency. According to multiple media outlets,Trump significantly impacted the composition of the Supreme Court and lower courts during his tenure.

He previously served as the general counsel to the Office of the Director of National Intelligence.

President Joe Biden began his presidency with fewer vacancies to fill than his predecessor. He pledged to nominate people with diverse backgrounds and professional experience;further he pledged to nominate the first black woman to the Supreme Court of the United States.
