Exemption from military service in Israel is covered by the Israeli Security Service Law, which regulates the process of Israeli military conscription. Per the law, an Israeli citizen who is drafted into the Israel Defense Forces (IDF) may be exempted if an evaluation finds them to meet specific criteria. The IDF's conscription laws only apply to three communities: the Jews, the Druze, and the Circassians. [3] Both men and women are drafted from the Jewish community, whereas only men are drafted from the Druze and Circassian communities.
Grounds for exemptions are expatriate status, medical or psychological issues, conscientious objection, [4] [5] [6] and criminal record (subject to review). Additionally, female Jewish draftees can be exempt due to marriage, pregnancy, motherhood, or religious commitments, including observing dietary and Sabbath travel laws, in accordance with §39 and §40 of the Security Service Law.
Under a special arrangement ( Torato Umanuto ), male Haredi students who were issued a draft notice could be granted a total exemption from service so long as they remained enrolled at their yeshiva for religious studies. In June 2024, Israel's Supreme Court unanimously ruled that Haredi Jews were eligible for compulsory service, ending nearly eight decades of exemption. [7] The army began drafting Haredi men the following month. [8]
Additionally, Arab citizens of Israel (who constitute about 21% of the Israeli population) are also exempted from military service. This exemption does not originate via Israeli statutory law, but is instead based on the guidelines of the IDF Human Resource Department, issued under the IDF's discretionary powers pursuant to the law. [3] As a result, Arab Muslims, Arab Christians, and Bedouins are not conscripted, [3] though all of them may still serve voluntarily. Among Israel's non-Druze and non-Circassian minorities, the Bedouin community has been notable for their voluntary contributions to service in the IDF. [9] [10]
According to 2007 IDF figures, the largest single group of young (Jewish) Israelis who avoided conscription consisted of women who claim exemptions on religious grounds. This group made up 35% of all women eligible for the draft. Amongst males, the overall percentage of non-participation was 27.7%. This figure included 11.2% for Torato Omanuto, 7.3% for medical and psychological grounds, 4.7% because of criminal records and 4.2% because of residing abroad. [11] In 2014, the law changed such that the majority of the Haredi Jews were no longer exempt from the military service. [1] Another law change to grant exemptions again was contested by the High Court in 2017. [2] This ban on exemptions has now theoretically come into force but a lack of government action means nothing has changed in practice. [12]
By 2020, about 32.9% of men and 44.3% of women received exemptions from IDF service, and an additional 15% of men dropped out before completing their term of service. [13] Of those who received exemptions, some 44.7% were Haredim, 46.6% were secular, and 8.7% were religious Zionist. [13] There was a noted increase in exemptions granted for reasons of mental health. [13]
Accordance with section 36 of the Security Service Law, the security minister may exempt certain people from an army service in the IDF, for reasons related to the volume of the military forces or reserve forces, or for reasons related to educational needs, settlement needs, security needs, economy needs, family needs and various other reasons.
In accordance with section 5 of the Security Service Law, a medical board is authorized to determine if a candidate is unfit for national security service.
In 2005, 32.1% of the Jewish women did not enlist in the military on religious grounds, and the overall rate of non-enlisted Jewish women has risen to 42.3%. [14] These high rates indicate that refraining from the draft is relatively common, at least among Israeli women. In 2008, the proportion of women who did not enlist rose to 44%, from which 34.6% did not enlist on religious grounds. As a result, the Israeli military tightened the way it handles cases in which Jewish women request an exemption on religious grounds, through investigating the truthfulness of their claims, in order to expose young women who lied about being religious. [15]
Section 94 of the Security Service Law describes another method of draft evasion: defecting from the military on the day of recruitment. When a soldier fails to show up to be recruited he is defined by the military as a draft evader. After being defined as a draft evader, an arrest warrant is issued against him and thereafter the military police is responsible for locating and capturing him. After being caught by the military police, it would be decided whether the draft evader would go through disciplinary proceedings (which means that they would get a limited punishment and not a criminal record), or whether he or she would face a military court where the punishment is not limited and the criminal conviction is registered.
Draft evasion is a criminal act and condemned by the majority of Israelis. Among the strongest opponents to the Israeli government policy, a few people support draft evasion, but they are a minority in the Israeli public. After the 2006 Lebanon War media campaigns were organized against draft evasion and to promote enlistment, especially in combat units. Head of Human Resources Elazar Stern and Defense Minister Ehud Barak were particularly vocal on this subject:
The army is increasingly transforming from the people's army to the army of half of the people. A soldier should not feel that he is going into a battle while being perceived by large parts of the Israeli public as a patsy. [17]
Israeli celebrities and public figures who evaded the draft in their youth (mostly before they became famous) have been condemned.
An individual's military service is usually a topic of discussion in many job interviews in Israel, and is information job seekers usually would add to their resume. Nevertheless, in 2003 the Regional Court in Tel Aviv declared that the requirement of military service as a precondition to be hired for a position constitutes discrimination and is forbidden if military service is not relevant for that position. [20] The Israeli Equal Opportunities Act (חוק שוויון ההזדמנויות בעבודה) was revised in the mid 1990s [21] to prohibit employers from asking candidates about their military profile in the IDF. Nevertheless, legally there is as yet no prohibition against questions regarding an individual's military service or the fact that they did not enlist in the military - information which might be used later on as part of the many considerations which would contribute to an interviewer's decision not to hire the individual. In the years since the Equal Opportunities Act was revised, and despite the changes in the Israeli public regarding military service, there is still largely a negative attitude toward those who have not served in the IDF. As an example, a substantial proportion of the employment ads in the newspapers state explicitly that only candidates who have carried out "full military service" will be considered for that position.
In June 2023, blanket military service exemptions for ultra-Orthodox yeshiva students expired. This meant that the IDF could conscript anyone eligible for military service, including ultra-Orthodox citizens. Right before the expiration, a cabinet resolution passed that extended the no-draft policy for another 10 months, while it decided on how best to proceed. After the October 7th attacks, the government failed to pass any subsequent laws regarding conscription exemption. Subsequently, the Movement for Quality Government in Israel petitioned that the lack of exemption should result in enforcement of conscription of ultra-Orthodox Israelis. [22]
In June 2024, the Supreme Court of Israel declared any continued exemption of IDF conscription unlawful. [22] The ruling had caused officials in the ultra-Orthodox Shas party to urge potential conscripts in July 2024 to ignore any call-ups from the IDF and protests. During at least one protest protestors attacked both law enforcement and the vehicle of Minister Yitzhak Goldknopf. [23] [24]
In July 2024, the army began drafting 3,000 Haredi men. [25] In mid November 2024 it was announced that Israeli military officials had issued 1,126 arrest warrants for ultra-Orthodox Jewish conscripts who had not responded to drafting orders, those who continued to not cooperate could declared a draft dodger and banned from foreign travel and risk of arrest. [26]
The Israel Defense Forces, alternatively referred to by the Hebrew-language acronym Tzahal (צה״ל), is the national military of the State of Israel. It consists of three service branches: the Israeli Ground Forces, the Israeli Air Force, and the Israeli Navy. It is the sole military wing of the Israeli security apparatus. The IDF is headed by the Chief of the General Staff, who is subordinate to the Israeli Defense Minister.
Haredi Judaism is a branch of Orthodox Judaism that is characterized by its strict interpretation of religious sources and its accepted halakha and traditions, in opposition to more accommodating values and practices. Its members are usually referred to as ultra-Orthodox in English; a term considered pejorative by many of its adherents, who prefer the terms strictly Orthodox or Haredi. Haredim regard themselves as the most authentic custodians of Jewish religious law and tradition which, in their opinion, is binding and unchangeable. They consider all other expressions of Judaism, including Modern Orthodoxy, as deviations from God's laws, although other movements of Judaism would disagree.
Citizens of Israel have refused to serve in the Israel Defense Forces (IDF) or have disobeyed orders on the grounds of pacifism, antimilitarism, religious philosophy, or political disagreement with Israeli policy such as its occupation of the West Bank. Conscientious objectors in Israel are known as sarvanim which is sometimes translated as "refuseniks", or mishtamtim.
Hesder is an Israeli yeshiva program which combines advanced Talmudic studies with military service in the Israel Defense Forces, usually within a Religious Zionist framework. The program allows Orthodox Jewish men to serve in the Israeli military while still engaging in Torah study.
The Tal Committee was an Israeli public committee appointed on 22 August 1999 which dealt with the special exemption from mandatory military service in the Israel Defense Forces (IDF) given to Israeli ultra-Orthodox Jews which had been the status quo from the time of Ben Gurion, as well as extending mandatory military service to Israeli-Arabs. The committee was appointed by Prime Minister Ehud Barak and was initially headed by former Supreme Court Justice Tzvi Tal. The committee was later headed by Yohanan Plesner before its official dissolution on 2 July 2012, two days before submitting its report, hence the term Plesner Committee.
The 97th Netzah Yehuda Battalion, previously known as Nahal Haredi is a battalion in the Kfir Brigade of the Israel Defense Forces. The purpose of the unit is to allow Haredi Jewish men to serve as combat soldiers in the Israeli military by creating an atmosphere conducive to their religious convictions in the strict observance of Halakha. The battalion has been accused of human rights violations against Palestinians, including killing unarmed civilians, killing suspects in custody, sexual assault and torture.
Since the Israeli Declaration of Independence in 1948, fixed-term military service has been compulsory in Israel. The draft laws of the Israel Defense Forces (IDF) only apply to Jews, Druze, and Circassians. Because the Druze and Circassian communities are less populous, their women are exempted from mandatory military service altogether. Women from the Jewish community are not exempted, but serve for slightly shorter terms than their male counterparts. The IDF does not conscript non-Druze Arab citizens of Israel, though their men and women may enlist voluntarily.
Sherut Leumi is an alternative voluntary form of national service in Israel, as opposed to the mandatory military conscription prevalent in the country. It is designed for individuals who do not meet the eligibility criteria for service in the Israel Defense Forces, or who hold conscientious objections to military enlistment. The program primarily was created for religious Jewish girls aged 17 to 24, although it is open to all applicants who cite diverse grounds for their decision.
Torato Umanuto was a special government arrangement in Israel allowing young Haredi Jewish men enrolled in yeshivas to complete their studies before they were conscripted into the Israeli military. Historically, it has been mandatory in Israeli law for male and female Jews, male Druze, and male Circassians to serve in the military once they become 18 years of age, with male conscripts required to serve for three years and female Jewish conscripts required to serve for two years.
Israel is one of only a few countries where military service is compulsory for all able-bodied female citizens. Under Israeli conscription laws, the Israel Defense Forces (IDF) may draft recruits from three communities: the Jews, the Druze, and the Circassians. As the latter two communities are less populous, their women are not required to serve. Women from the Jewish majority are not exempted from the conscription laws, but serve for slightly shorter terms than male conscripts. All women who are exempted from the conscription laws may still enlist voluntarily. Jewish women who are called up for military service may apply for an exemption on humanitarian, religious, or certain legal grounds. Those who claim such an exemption will typically be redirected to Sherut Leumi, the alternative means of national service.
Women in Israel comprise 50.26 percent of the state's population as of 2019. While Israel lacks an official constitution, the Israeli Declaration of Independence of 1948 states that “The State of Israel (…) will ensure complete equality of social and political rights to all its inhabitants irrespective of religion, race or sex.”
Religious relations in Israel are relations between Haredim, non-Haredi Orthodox, Karaite, Ethiopian, Reform, Conservative, and secular Jews, as well as relations between different religions represented in Israel. The religious status quo, agreed to by David Ben-Gurion with the Orthodox parties at the time of Israel's declaration of independence in 1948, is an agreement on the role that Judaism would play in Israel's government and the judicial system. Tensions exist between religious and secular groups in Israel.
The Plesner Committee, also known as the Commission for Equality in the Burden, was a committee established by the Government of Israel to formulate recommendations on the recruitment of Israelis to the Israeli Defense Forces, in particular the recruitment of Haredim and Arabs. The committee was established prior to the anticipated expiration of Tal Law which exempted yeshiva students from mandatory military service in the IDF.
In 2013, two independent protests occurred in Israel. In May, an attempt to change the Tal Law, which excluded ultra-Orthodox Jewish men for doing military service, led to protests by Haredi against military conscription. Again in November, Bedouins in the Negev called for a 'Day of Rage' against their displacement by the Israeli government to state developed townships as a result of the Prawer-Begin plan.
Conscription of yeshiva students refers to the conscription of Orthodox yeshiva students in Israel. Since 1977, this community had been exempted from military duty or national service. In 2012, service became mandatory with a penalty of imprisonment for up to five years for draft-dodgers, although that law has never been enforced.
The Israeli Security Service Law, also known as the Israeli Defense Service Law, regulates conscription into military service for citizens of Israel. The Security Service Law, enacted in 1986 and replacing the Security Service Act of 1949, made conscription a national routine rather than only requiring military draft during national security emergencies.
The Jerusalem Faction is an Israeli Haredi political organization based in Jerusalem. It was founded in 2012 by Shmuel Auerbach as a reaction to the Bnei Brak-based Degel HaTorah's perceived moderate approach to the question of conscription of Haredim into the Israel Defence Forces by the Israeli government that came up following the expiration of the Tal Law.
Chochmat Nashim is an Israeli organisation that promotes women's rights in the Orthodox Jewish community in Israel and the United States. Their work aims to raise awareness of trends and policies within Orthodoxy that might harm women and girls. The group's activities include the establishment of a photo bank which includes the images of Orthodox women, and the use of satirical publications which mimic Jewish Torah study aimed at educating Orthodox men about the unequal treatment of Jewish women in religious divorce proceedings.
The conscription of yeshiva students to the Israeli Defense Forces has been a highly contentious issue in Israel and outside it for decades now, at least since 1977.
The Hasmonean Brigade is planned to be an infantry unit in the Israeli Defense Forces intended to accommodate Haredi soldiers, who were previously exempt from conscription in Israel. The brigade is currently being arranged and commanded by Colonel Avinoam Emunah and will potentially have up to 4,000 soldiers.
