Giovanni Bonello (born 11 June 1936 in Floriana) is a Maltese judge,judge of the European Court of Human Rights [1] from 1998 until 2004, [2] then extended till 2010.
His father,Vincenzo Bonello,was the curator of the national art collection in the interwar period,and among the Maltese patriots,like Enrico Mizzi,who were deported and interned in Uganda by the British colonial administration during World War II. [3]
Giovanni Bonello studied law and practiced for the first decades of his professional career,specializing in constitutional and human rights litigation in newly-independent Malta. He defended over 170 human rights lawsuits before Maltese and international courts. At a point,was also the legal adviser of Malta's Chamber of Commerce. [4] Bonello was,among others,the legal counsel of the Little Company of Mary in the saga that opposed the Irish nuns to Dom Mintoff's government,which finally closed down their Blue Sisters Hospital. [5]
Bonello was also the author of "Page 13",the most widely read (and anonymous) political news column of The Sunday Times of Malta in the 1970s and 1980s,dedicated to human rights issues during the Labour government of Dom Mintoff - "But I have never actually confirmed or denied the rumour myself",as he stated in 2008. [6]
In 1990,the new Nationalist government led by Eddie Fenech Adami nominated Bonello as Chief Justice of Malta and (ex officio) President of the Constitutional Court,as well as Judge from Malta at the European Court of Human Rights. Yet,Bonello declined the appointment,as Fenech Adami insisted Bonello should take both the positions in Malta,and in Strasbourg. Fenech Adami then appointed Giuseppe Mifsud Bonnici to both posts. [3]
It was then the new Labour government led by Alfred Sant,in 1998,to appoint Bonello as Maltese judge at the European Court of Human Rights,from 1 November 1998 until 31 October 2004. [3] [7] As the Parliamentary Assembly of the Council of Europe rejected the all-male list of candidates proposed by the Maltese Government to succeed him,Bonello's term was extended twice until 19 September 2010. [8] Bonello was finally replaced by Vincent A. De Gaetano in 2010. [9]
Bonello has been considered a liberal judge.[ citation needed ] He has been the first judge whose separate opinions were published during his tenure,later also the separate opinions of the Portuguese judge Paulo Pinto de Albuquerque were also published in Italy. Judge (later Court President) Nicolas Bratza and leading authority on Human Rights Law Michael O'Boyle published them with Wolf Legal Publishers of the Netherlands. [10] His separate opinions were also collected in the book When Judges Dissent,published in 2008. [11]
Upon his retirement from the European Court of Human Rights,Court president Jean-Paul Costa said "Vanni" brought "robust independence of spirit and unflagging commitment to the protection of human rights". He displayed such qualities time and again in numerous separate opinions given in his unique and memorable style,which was "elegant as it is forceful",using "vocabulary as rich as it is rare". In fact,his opinions led Judge Bonello to attain "near-legendary" status among all those who followed Strasbourg case law,he said. President Costa said Judge Bonello was a true gentlemen who gained the respect and affection of all those who worked with him,whether they agreed with him or not. He was a marvellous ambassador for his profession and his country. "Along with his professional achievements,Vanni is a man of broad and deep culture,a connoisseur of great art and a distinguished historian. Now that he can finally take his leave of the Court,he can and will dedicate himself more fully to these intellectual and aesthetic pursuits." The president recounted an anecdote about the man he befriended during his long term at the Court. He said he had tried making a modest personal contribution to Judge Bonello's historical studies about the French occupation of Malta during the Napoleonic era,however,he soon realised his assistance was almost useless because Judge Bonello knew virtually everything there was to know on the subject. Bonello has published several history books,some of which led Bonello to be awarded the National Book Prize by the National Book Council. [13] [14] [15] He also served as president for the Malta Historical Society from 2011 to 2015. [15] [16]
Bonello also wrote a series of articles for the Times of Malta,celebrating the life of Caterina Scappi,founder of the first hospital exclusively for women in Malta:"For her absolutely pioneer social commitment,for this revolutionary philanthropy,Scappi deserves the monument she never got. Only an obscure and overlooked tombstone in the Carmelite church in Valletta today bears witness to her existence,her feminist vision and her generous,farsighted altruism." [17] [18] [19]
In 2018 Bonello published Misunderstanding the Constitution,a collection of essays first published on the Times of Malta and dedicated to "How the Maltese judiciary undermines human rights". Robert Thake described it as an "indictment of the Maltese judicial system and the often-frightening condition of Malta’s human rights record". Bonello discusses the abysmal record of Maltese cases at the European Court of Human Rights (85% of Malta's Constitutional Court decisions are overturned in Strasbourg) and how Maltese judges have misunderstood key human rights notions,including by pretending that the Constitutional Court is a "Court of last instance" (rejecting as ill-founded all application that would not have "exhausted domestic remedies") and by refusing to accept the erga omnes validity of its own rulings. Edoardo "Eddie" Fenech Adami,is a Maltese politician and Nationalist politician who served as the prime minister of Malta from 1987 until 1996,and again from 1998 until 2004. Subsequently,he was the seventh president of Malta from 2004 to 2009. He led his party to win four general elections,in 1987,1992,1998 and 2003,as well as the majority of votes in 1981. Staunchly pro-European,Fenech Adami was fundamental for Malta's accession to the European Union.
Agatha Barbara,was a Maltese politician,having served as a Labour Member of Parliament and Minister. She was the first woman to serve as president of Malta,and remains the longest-serving woman Member of Parliament in Maltese political history.
Giorgio Borg Olivier,was a Maltese statesman and leading politician. He twice served as Prime Minister of Malta as the Leader of the Nationalist Party. He was also Leader of the Opposition between 1955–1958,and again between 1971–1977.
Black Monday in Malta refers to 15 October 1979 when the Progress Press and the home of Eddie Fenech Adami,then Leader of the Opposition,were ransacked following a rally by the Labour Party.
Peter Serracino Inglott was a Priest,Philosopher,Scholar and Rector of the University of Malta from 1987 to 1988,then consecutively from 1991 to 1996. He was awarded the title of Emeritus Professor of philosophy at the University of Malta. He was a key figure at reconstructing the Maltese education system and held academia to his personal life prominently. He was also politically affiliated with the country's Nationalist Party,serving as advisor to former Prime Minister of Malta,Eddie Fenech Adami.
Foreign relations exist between Australia and Malta. Both countries have full embassy level diplomatic relations since 1967. As both countries are members of the Commonwealth,both are represented by High Commissions,with Australia maintaining a High Commission in Valletta,and Malta a High Commission in Canberra. In addition,Malta has two Consulates-General,and four honorary consulates.
The judiciary of Malta interprets and applies the laws of Malta,to ensure equal justice under law,and to provide a mechanism for dispute resolution. The legal system of Malta is based partially on English law and partly on Continental law,whilst also being subject to European Union law.
Malta–Portugal relations are foreign relations between Malta and Portugal. Malta has an embassy in Lisbon and 4 honorary consulates. Portugal is accredited to Malta from its embassy in Rome,Italy. Both countries are full members of the European Union,Council of Europe,Organization for Security and Co-operation in Europe and Union for the Mediterranean.
Giuseppe Mifsud Bonnici was a Maltese judge and philosopher,Chief Justice of Malta between 1990 and 1995. He mostly specialised in the philosophy of law.
Michael C. Bonello is a Maltese economist,former governor of the Central Bank of Malta from 1999 to 2011.
Sejdićand Finci v. The Malta Independence Fiftieth Anniversary Medal is a national commemorative medal of the Republic of Malta. The medal is awarded by the president of Malta to recognize contributions to the development and well-being of Malta as a nation and a member of the international community of nations since the State of Malta gained independence in 1964. The medal,which may be awarded posthumously,has been awarded to former presidents,prime ministers,and other notable Maltese politicians.
Vincent A. De Gaetano is a Maltese judge,serving since 2010 as judge of the European Court of Human Rights in respect of Malta. Since 3 November 2010 he is Vice-President of Section IV.
Andrea Belli was a Maltese architect and businessman. He designed several Baroque buildings,including Auberge de Castille in Valletta,which is now the Office of the Prime Minister of Malta.
Caterina Vitale (1566–1619) was the first female pharmacist and chemist in Malta,and the first female pharmacist of the Knights Hospitaller.
John Joseph Cremona KOM KM was a Maltese jurist and poet. He was the Attorney General of Malta during independence talks in 1964 and helped draft the Constitution of Malta. He served as the chief justice of Malta from 1971 to 1981. He assumed the functions of Head of State in an acting capacity several times,both as governor-general and president. He simultaneously served as Malta's first representative judge on the European Court of Human Rights from 1965 to 1992. Cremona was also a noted poet,writing in Italian,English,and Maltese.
Lorry Sant was a Maltese activist,trade unionist and Malta Labour Party politician who held a number of ministerial offices between 1971 and 1987. Sant was a controversial figure who had an aggressive leadership approach. In the 1980s he was involved in incidents of political violence,and he has been held responsible for violating the human rights of his employees.
Caterina Scappi was a rich and well-respected benefactor of the Carmelite church in Malta. Little is known about her origins or early life,but she is known for the substantial charitable donations for women's causes. In particular,she founded the first hospital in Malta dedicated exclusively to women.
George Bonello du Puis was a Maltese politician who served as Malta’s High Commissioner in London from 1999 to 2007. He was also a member of Parliament of Malta and served as Finance Minister after the 1987 elections and served as Economic Services Minister between 1992 and 1995.
