Luke Malaba (born 15 May 1951) is a Zimbabwean judge and the current Chief Justice of Zimbabwe since March 2017. He was appointed Chief Justice by then-President Robert Mugabe on 27 March 2017. However,he had already been serving as acting Chief Justice since 1 March 2017,following Justice Godfrey Chidyausiku‘s retirement. Previously,he had served as Deputy Chief Justice. [1]
Luke Malaba was born in Plumtree,Southern Rhodesia on 15 May 1951. [2] [3] He attended St. Ignatius College in Chishawasha. He received his law degree from the University of Warwick in 1974,and another law degree from the University of Zimbabwe in 1982. From 1981 to 1984,he served as a prosecutor in Bulawayo. He started his career as a magistrate in 1984 at Masvingo. He attained the rank of regional magistrate in 1990. He was appointed as a judge of the High Court in 1994,serving until 2001. He was elevated to the Supreme Court in August 2001,and became the country’s first Deputy Chief Justice in 2008. [1]
Following the retirement of Godfrey Chidyausiku,Malaba was appointed Acting Chief Justice on 1 March 2017. During interviews to become the Chief Justice,he scored 92 percent,achieving the highest score of those interviewed. He assumed the office on 27 March 2017. [1] In July 2018,Malaba ruled that former President Robert Mugabe had freely resigned,and was not coerced. [4] The Chief Justice,in a unanimous Supreme Court decision in August 2018,concurred with the other eight justices of the court,in a ruling that president Emmerson Mnangagwa's July 2018 election was lawfully conducted,and had "complied with prescribed procedures",dismissing the political opposition's claims to the contrary. Under the Zimbabwean constitution,Chief Justice Malaba was required to retire when he reached 70 years of age on 15 May 2021. [6]
However Amendment 2 to the Constitution increased the age limit to 75 in early May 2021 allowing him to remain in office. There are questions around the constitutionality of this amendment. [7] On 15 May 2021 the High Court of Zimbabwe retired Malaba as the chief justice and ruled his extension of office was unconstitutional. [8] This judgement was appealed in the constitutional court which overruled the high court decision. [9]
The effort to keep him in office was likely sponsored by Zimbabwean President Emmerson Mnangagwa,as Malaba had made two significant rulings in his favour. Firstly,he had legitimised the coup that had ousted Robert Mugabe, [10] and secondly,he had quashed a legal challenge to the outcome of the 2018 Zimbabwean general election. In the event that there are electoral challenges in the 2023 election,Mnangagwa would prefer to have a favourable judge presiding. [11]
The politics of Zimbabwe takes place in a framework of a full presidential republic,whereby the President is the head of state and government as organized by the 2013 Constitution. Executive power is exercised by the government. Legislative power is vested in both the government and parliament. The status of Zimbabwean politics has been thrown into question by a 2017 coup.
The Zimbabwe African National Union –Patriotic Front (ZANU–PF) is a political organisation which has been the ruling party of Zimbabwe since independence in 1980. The party was led for many years under Robert Mugabe,first as prime minister with the Zimbabwe African National Union (ZANU) and then as president from 1987 after the merger with the Zimbabwe African People's Union (ZAPU) and retaining the name ZANU–PF,until 2017,when he was removed as leader.
Emmerson Dambudzo Mnangagwa is a Zimbabwean politician who has served as President of Zimbabwe since 24 November 2017. A member of ZANU–PF and a longtime ally of former President Robert Mugabe,he held a series of cabinet portfolios and was Mugabe's Vice President until November 2017,when he was dismissed before coming to power in a coup d'état. He secured his first full term as president in the disputed 2018 general election.

Kembo Dugish Campbell Mohadi,is a Zimbabwean politician and former Vice-President of Zimbabwe who served from 28 December 2017 to 1 March 2021. He briefly served as the Minister of Defence,Security and War Veterans in 2017. Previously he was Minister of State for National Security in the President's Office from 2015 to 2017 and Minister of Home Affairs from 2002 to 2015.
Phelekezela Mphoko is a Zimbabwean politician,diplomat,businessman and former military commander who served as Second Vice-President of Zimbabwe from 2014 until 2017,as well as Zimbabwe's ambassador to Russia,Botswana and South Africa. Legally,Mphoko was the acting President of Zimbabwe from 21–24 November 2017,however,as he was not in the country at the time,official standing on this is unclear. Mphoko's term as vice-president was ended by President Emmerson Mnangagwa following the dissolution of the cabinet on 27 November 2017.
The Cabinet of Zimbabwe is the executive body that forms the government of Zimbabwe together with the President of Zimbabwe. The Cabinet is composed of the President,the Vice-Presidents,and ministers appointed by the President. Until 1987,the Cabinet was chaired by the Prime Minister;it is now headed by the President.
Constantino Chiwenga,is a Zimbabwean politician and former army general currently serving,since 2017,as the First Vice-President of Zimbabwe under President Emmerson Mnangagwa. In August 2020,he added the Health Ministry to his portfolio.

General elections were held in Zimbabwe on 30 July 2018 to elect the President and members of both houses of Parliament. Held eight months after the 2017 coup d'état,the election was the first since independence in which former President Robert Mugabe was not a candidate.
The Liberal Democrats of Zimbabwe was formed in 2015 from South Africa. It is a political party registered in terms of ZEC requirements in Zimbabwe. The party did not participate in the 2018 general election. In 2016 it petitioned the Zimbabwean Embassy in Pretoria over the spending of US$800,000 on Robert Mugabe's birthday when many Zimbabweans were starving.
In November 2017,Zimbabwean President Robert Mugabe was removed as president and party leader of ZANU-PF,replaced by Emmerson Mnangagwa.

On 23 June 2018,a grenade exploded at White City Stadium in Bulawayo,Zimbabwe. The blast occurred at a ZANU–PF campaign rally,just after President Emmerson Mnangagwa had finished giving a speech. It was described as an assassination attempt against Mnangagwa,who was unharmed. The bombing resulted in at least 49 injured,including Vice-Presidents Constantino Chiwenga and Kembo Mohadi,and other high-ranking government officials. Two security agents later died of their injuries.

The 2018 Zimbabwe Presidential election petition aimed to overturn the Zimbabwe's presidential elections results which declared Emmerson Dambudzo Mnangagwa as victor. The election was held on Monday July 30.
