The Valuation Act is a 1913 United States federal law that required the Interstate Commerce Commission (ICC) to assess the value of railroad property. [1] This information would be used to set rates for the transport of freight.
The act was the brainchild of ICC commissioners Charles A. Prouty and Franklin K. Lane. [2] Its objective was the setting of fair rates for freight shipments. It was a classic piece of Progressive Era legislation designed to find a scientific basis for setting tariffs (shipping charges) by determining the correct value of each railroad's real property and assets. Members of Congress assumed that with this information, the ICC would be able to set rates according to the principle of a reasonable rate of return on the real value of each railroad and the industry as a whole. The law amended the Interstate Commerce Act of 1887 and required the ICC to organize a Bureau of Valuation in order to undertake the assessments. The ICC formulated a set of procedural and reporting standards for the valuation process, and then permitted the individual railroads to complete the valuation under the nominal supervision of an ICC administration. [3]
Although the original intent of the Valuation Act was to prepare a one-time assessment of railroad assets, subsequent legislation had the effect of prolonging the process. The Esch-Cummins Act of 1920 expanded the ICC's rate-setting responsibilities, and the agency in turn required updated valuation data from the railroads. [4] The enlarged process led to a major increase in ICC staff, and the valuations continued for almost 20 years. [5] The valuation process turned out to be of limited use in helping the ICC set rates fairly. [3] [6]
Congress passed a minor amendment to the law in 1922. [7]
Prouty resigned from his Commissioner post at the ICC to serve as the first Valuation Bureau Chairman. [2] Lane resigned to become Secretary of the Interior in the Woodrow Wilson administration. [8]
The Interstate Commerce Commission (ICC) was a regulatory agency in the United States created by the Interstate Commerce Act of 1887. The Act authorized the Interstate Commerce Commission (ICC) to impose heavy fines on railroads that offered rebates, and upon the shippers that accepted these rebates. The railroad companies were not permitted to offer rebates. Railroad corporations, their officers, and their employees, were all made liable for discriminatory practices.
The Hepburn Act is a 1906 United States federal law that expanded the jurisdiction of the Interstate Commerce Commission (ICC) and gave it the power to set maximum railroad rates. This led to the discontinuation of free passes to loyal shippers. In addition, the ICC could view the railroads' financial records, a task simplified by standardized bookkeeping systems. For any railroad that resisted, the ICC's conditions would remain in effect until the outcome of legislation said otherwise. By the Hepburn Act, the ICC's authority was extended to cover bridges, terminals, ferries, railroad sleeping cars, express companies and oil pipelines.
The Mann–Elkins Act, also called the Railway Rate Act of 1910, was a United States federal law that strengthened the authority of the Interstate Commerce Commission (ICC) over railroad rates. The law also expanded the ICC's jurisdiction to include regulation of telephone, telegraph and wireless companies, and created a commerce court.

Railroads played a large role in the development of the United States from the industrial revolution in the Northeast (1820s–1850s) to the settlement of the West (1850s–1890s). The American railroad mania began with the founding of the first passenger and freight line in the country, the Baltimore and Ohio Railroad, in 1827, and the "Laying of the First Stone" ceremonies and the beginning of its long construction heading westward over the obstacles of the Appalachian Mountains eastern chain in the next year. The United States Railroad Administration (USRA) was the name of the nationalized railroad system of the United States between December 28, 1917, and March 1, 1920. It was the largest American experiment with nationalization, and was undertaken against a background of war emergency following American entry into World War I. During its brief existence, the USRA made major investments in the United States railroad system, and introduced standardized locomotive and railroad car classes, known as USRA standard. After the end of World War I, while some in the United States advocated for continuing nationalization, ultimately the railroads were returned to their previous owners in early 1920.
The Interstate Commerce Act of 1887 is a United States federal law that was designed to regulate the railroad industry, particularly its monopolistic practices. The Act required that railroad rates be "reasonable and just," but did not empower the government to fix specific rates. It also required that railroads publicize shipping rates and prohibited short haul or long haul fare discrimination, a form of price discrimination against smaller markets, particularly farmers in Western or Southern Territory compared to the official Eastern states. The Act created a federal regulatory agency, the Interstate Commerce Commission (ICC), which it charged with monitoring railroads to ensure that they complied with the new regulations.
John Jacob Esch was an American attorney and member of the United States House of Representatives from 1899 to 1921 serving as a Republican. Born near Norwalk, Wisconsin, he graduated from the University of Wisconsin in 1882 and in 1887 was admitted to the bar. He was a member of the Interstate Commerce Commission from 1921 to 1927. In 1928, President Calvin Coolidge granted him a recess appointment pending his confirmation to a second term; however, the Senate blocked the nomination and the recess appointment expired when Congress adjourned in May. Esch returned to the practice of law and died in La Crosse, Wisconsin.

Students Challenging Regulatory Agency Procedures (SCRAP), 412 U.S. 669 (1973), was a landmark decision of the United States Supreme Court in which the Court held that the members of SCRAP—five law students from the George Washington University Law School—had standing to sue under Article III of the Constitution to challenge a nationwide railroad freight rate increase approved by the Interstate Commerce Commission (ICC). SCRAP was the first full-court consideration of the National Environmental Policy Act (NEPA). The Court also reversed the lower court decision that an injunction should be issued at the suspension stage of the ICC rate proceeding. The standing decision has retained its place as the high mark in the Court's standing jurisprudence.

He served as a commissioner of the Interstate Commerce Commission (ICC) from 1896 to 1914. He was an unsuccessful candidate for the United States Senate from Vermont in 1914, losing to incumbent Republican senator William P. Dillingham.
Henry Clay Hall Jr. was an American attorney and commissioner of the Interstate Commerce Commission, appointed by president Woodrow Wilson in 1914 and who served on the Commission from March 21, 1914, to January 13, 1928. He served as Chairman of the Commission from 1917 to 1918 and again in 1924.
The Railroad Labor Board (RLB) was an institution established in the United States of America by the Transportation Act of 1920. This nine-member panel was designed as means of settling wage disputes between railway companies and their employees. The Board's approval of wage reductions for railroad shopmen was instrumental in triggering the Great Railroad Strike of 1922. The Board was terminated on May 20, 1926 when President Calvin Coolidge signed a new Railway Labor Act into law.
In United States federal law, the Mayfield–Newton Act, or the Mayfield Act, was an act passed by the United States Congress on March 4, 1927, amending the Interstate Commerce Act, the Esch–Cummins Act, and the Uniform Bill of Lading to "authorize reduced freight rates in cases of emergency", including earthquake, fire, flood, famine drought, epidemic, and pestilence. Sponsored by Sen. Earle B. Mayfield (D) of Texas and Rep. Walter H. Newton (R) of Minnesota, the act changed the original maximum suspension, which had been fixed by the Mann-Elkins Act of 1910, to 120 days, extendable by the Interstate Commerce Commission to 6 months – the Esch-Cummins Act reduced the extension period to 30 days while the Mayfield-Newton Act of 1927 replaced the provision with a single period of 7 months.
