The Administration of Muslim Law Act is a Singapore statute that pertains to regulation of Muslim religious affairs, establishing the creation of a religious council to offer advice on matters related to the Muslim religion, and the creation of a Syariah Court in Singapore. The act was passed in 1966 and came into force on 1 July 1968.
When Singapore became a crown colony in 1867, administration of Muslims religious matters received attention by the Colonial Office in London. [1] During this period, Muslims in Singapore have had their own judicial system that involved marriage, divorce and other civil affairs, regulated by the colonial government. [2]
In 1877, 143 influential Muslims brought a petition for a religious functionary, also known as the Qadi, to appoint as the Muslim marriage registrar. [1] These Muslims highlighted the importance of a proper recording system for Muslim Marriages, and there were multiple instances of Muslim families being cheated by ‘Qadis’ who did not turn up on the wedding date. [1] Attorney-General Roland Braddell drafted a bill to raise the issue of the English law’s impact on the Muslim community in Singapore, and introducing this new law would be helpful to the Muslim community. [1] This led to the Mahomedan Marriage Ordinance V 1880, which states the laws and regulations on Muslim marriage and divorce, under the control of the State Governor. [3] The ordinance gave a legal framework for Muslim religious affairs.
In 1915, the Mohamed Advisory Board was formed, expanding their scope to “religious affairs, customs, health and conditions.” [4] The board was renamed as the Muslim Advisory Board in 1945. The board continued to work after the Mohamed Advisory Board, advising the Government on matters regarding the Muslim community in Singapore, and matters that needed the regard of the Muslim community’s point of view. [5]
In 1957, while Singapore was under self-rule, the Singapore Legislative Assembly established the Syariah Court through the Muslim Ordinance. [6] The Court claimed jurisdiction of cases whereby both parties were Muslim who were involved in matrimonial disputes.
The idea of a centralised authority, a Majlis, was developing over the Malay states. [1] Talks about a centralised governing body in Singapore started in 1948, calling for the creation of a new centralised Muslim authority or enabling a currently existing organisation to represent Muslims in Singapore. [7] In 1960, four Muslim organisations – Muslim Advisory Board, All-Malaya Muslim Missionary Society, Singapore Religious Teachers’ Association and the Mohammadiah Movement – voiced out the need to create a centralised authority that “unites all sections of the Muslim community.” [8] Ahmad bin Ibrahim, Singapore’s State Advocate General at that time, headed this movement. [8]
In 1952, the Administration of Muslim Law Enactment was passed in Selangor. This legislation incorporated the Qadi and the Shariah Court, and the legislation of a religious council. [9] Many other Malay states followed suit, including Singapore. Ahmad drafted the Administration of Muslim Law Bill. [9]
In 1960, Minister of Labour and Law K. M. Byrne moved the Bill to the Singapore’s Legislative Assembly. [10] The aim of the bill was to restructure the organisations and matters pertaining to the Muslim religion and law, following the administration of the law in other Malayan states. [10] This bill was introduced to replace the Muslim Ordinance 1957, strengthen the Shariah court and establish the Majlis Ugama Islam Singapura (MUIS). [11] The bill also enabled the Yang di-Pertuan Negara to appoint a head for the Majlis, a Mufti, a maximum of two Muslim people in the Legislative Assembly and a minimum of 10 people to form the Majlis committee. [10]
The Law Minister established a Select Committee in 1961, providing a platform for the public to submit written representations regarding the bill. [12] The Majlis's scope of authority was the only matter up for debate. These representations have indicated that the Majlis should expand their duties, especially about wakaf. [12] Those who did not agree with the bill noted that it was not right for a secular government to pass legislation governing, regulating, and governing Islam. [12]
In September 1963, Singapore became part of the Federation of Malaysia. [12] Muslim religious matters in these states were under Malaysia's Head of State because there was no Malay Sultan. [12] Ahmad had to edit the Bill to adapt to these changes. However, Singapore separated from the federation on 9 August 1965. [12]
On 30 December 1965, the Administration of Muslim Law Bill was introduced for the second time in Parliament by Minister for Culture and Social Affairs, Othman Wok. [13] The bill aimed to “repeal and re-enact law relating to Muslims and to make provision for regulating Muslim religious affairs and to constitute a Council to advise on matters relating to the Muslim religion.” [13]
Othman read the bill for the third time on 17 August 1966. [14] He reiterates that the implementation of AMLA will have no personal, sectional or political influences on the Majlis, assuring that the Majlis will prioritise the interest of the Muslim community in Singapore. [15] The bill was passed later on. [14] However, AMLA was only established officially on 1 July 1968 after finding suitable candidates for the Majlis President, Mufti and Secretary. [14]
The enactment of the AMLA created three major institutions: the Majlis Ugama Islam Singapura (MUIS), the Syariah Court, and the Registry of Muslim Marriages (ROMM). [13]
MUIS has several key responsibilities mentioned in Section 5, which include:
AMLA repealed the Muslim Ordinance 1957 with its enactment. The Syariah Court possesses the authority to adjudicate all cases and proceedings that involve solely Muslim parties or those who were wedded under Muslim law, and pertain to conflicts related to marriage and divorce. [17]
Two improvements were made in 1999 and 2009. In 1999, AMLA was amended to heighten the authority of the Court as well as to provide more support to the Court to handle its backlog. [17] In 2009, AMLA made the processes simpler for Muslims to implement rulings issued by the Syariah Court. [17] If there is a violation of Syariah Court orders, people have the option to file a Magistrate's complaint at the District Court. [17]
Previously, the registration of Muslim marriages and divorces were handled by the Syariah Court. [3] Under the AMLA, marriages conducted according to Muslim law and the annulment of divorces involving both Muslim parties are recognized. [3]
In 1978, the management of Muslim marriages was under the authority of the Registry of Muslim Marriages. [3]
The Government of Brunei is the union government created by the constitution of Brunei where by the Sultan of Brunei is both head of state and head of government. Executive power is exercised by the government. Brunei has a legislative council with 36 appointed members, that only has consultative tasks. Under Brunei's 1959 constitution, His Majesty Hassanal Bolkiah, is the head of state with full executive authority, including emergency powers since 1962. The Sultan's role is enshrined in the national philosophy known as "Melayu Islam Beraja" (MIB), or Malay Islamic Monarchy. The country has been under hypothetical martial law since a rebellion occurred in the early 1960s and was put down by British troops from Singapore. The Seat of the Government is located in Bandar Seri Begawan, Brunei.
While freedom of religion is de jure symbolically enshrined in the Malaysian Constitution, it de facto faces many prohibitions and restrictions. A Malay in Malaysia must strictly be a Muslim, and they cannot convert to another religion. Islamic religious practices are determined by official Sharia law, and Muslims can be fined by the state for not fasting or refusing to pray. The country does not consider itself a secular state and that Islam is the state religion of the country, and individuals with no religious affiliation are viewed with hostility.
The Grand Mufti is the head of regional muftis, Islamic jurisconsults, of a state. The office originated in the early modern era in the Ottoman empire and has been later adopted in a number of modern countries.
Islam constitutes the third largest religion in Singapore, with Muslims accounting for approximately 15.6% of the population, as indicated by the 2020 census. Predominantly, Singaporean Muslims are Sunni Muslims adhering to either the Shafi‘i or Hanafi schools of thought. The majority of the Muslim population, about 80%, are ethnic Malays, while 13% are of Indian descent. The remaining fraction comprises local Chinese, Eurasian, and Arab communities, in addition to foreign migrants. Buddhism and Christianity are the two larger religious affiliations in the country.
Jamae Mosque is one of the earliest mosques in Singapore, and is located on South Bridge Road in the Chinatown district within the Central Area. The mosque was established in 1826. This mosque is also known as Chulia Mosque and Periya Paḷḷi among the Tamil Muslim community in Singapore. Together with its neighbour, Sri Mariamman Temple, the mosque stands out in its predominantly Chinese location. The Mosque Street that runs beside it may have been named after this mosque.
The Majlis Ugama Islam Singapura (MUIS), also known as the Islamic Religious Council of Singapore (IRCS), is a statutory board of the Ministry of Culture, Community and Youth of the Government of Singapore. As a majlis, its role is to look after the administration and interests of Singapore's Muslim community. The Majlis is headed by a Council, in which members are appointed by the President of Singapore. Since 2009, the council is headquartered in the Singapore Islamic Hub, along Braddell Road.
Othman bin Wok, often known as Othman Wok, was a Singaporean politician who served as Minister of Social Affairs between 1963 and 1977. After retiring from politics, he was Singapore's Ambassador to Indonesia and served on the boards of the Singapore Tourism Board and Sentosa Development Corporation. For his political, economic and social contributions to the nation building of Singapore, he was awarded the Order of Nila Utama in 1983 by President Devan Nair.
Zainul Abidin bin Mohamed Rasheed is a Singaporean diplomat, former politician and journalist. A former member of the governing People's Action Party (PAP), he was the Member of Parliament (MP) representing Eunos ward of Aljunied GRC between 2001 and 2011 and Cheng San GRC representing Punggol East ward from 1997 to 2001.
Lina Joy is a Malay convert from Islam to Christianity. Born Azlina Jailani on 28 July 1964 in Malaysia to Muslim parents of Javanese descent, she converted at age 26. The Lina Joy case sparkled a debate about apostasy in Malaysia, and her failed legal attempt to not have her religion listed as "Islam" on her identity card is considered a landmark case in Malaysia.
The Jawi Peranakan is an elite ethnic group found primarily within the Malaysian state of Penang and in Singapore, both regions were part of the historical Straits Settlements where their culture and history is centred around. The term "Jawi Peranakan" refers to locally born, Malay-speaking Muslims of mixed South Asian and Malay ancestry. Over time, this has grown to include people with Arab ancestry as well. They were an elite group within the British Malayan community in mid-19th century Malaya. In addition to their substantial wealth and social standing, they are remembered for setting up the first Malay newspaper in Malaysia, Singapore, Indonesia and China, the Jawi Peranakan and their influences on Malay culture.

Freedom of religion in Singapore is a guaranteed constitutionally protected right under Article 15 of the Constitution of Singapore which states: "Every person has the right to profess and practise his religion and to propagate it." and allows believers the freedom to assemble and worship without limitation or interference.
Madrasah Al-Ma'arif Al-Islamiah is an all-girls' Islamic school, commonly known as madrasah, in Singapore. Al-Ma'arif has students at primary, secondary and pre-university levels. It is one of six full-time Islamic madrasahs in Singapore. Unlike most of the other madrasahs, Al-Ma'arif's curriculum places equal emphasis on Islamic religious studies and secular subjects from the Singapore Ministry of Education curriculum.
Madrasah Irsyad Zuhri Al-Islamiah is a full-time co-educational madrasah offering primary education in Singapore. Madrasah is an Arabic word that means "school" but in the present context a madrasah means an Islamic religious school. "Irsyad" means rightly guided in Arabic.
Syariah refers to Sharia law in Islamic religious law and deals with exclusively Islamic laws, having jurisdiction upon every Muslim in Malaysia. The Syariah Court system is one of the two separate court systems which exist in the general Malaysian legal system. There is a parallel system of state Syariah Courts, which have limited jurisdiction over matters of state Islamic law. Syariah Courts have jurisdiction only over Muslims in matters relating to family law and religious observance, and can generally only pass sentences of not more than three years' imprisonment, a fine of up to RM5,000, and/or up to six strokes of the cane.
Shia Muslims are a minority in Singapore, where Sunni Islam is the majority as is much of Southeast Asia. The Shia community in Singapore is considered part of the wider Muslim religious group alongside the majority Sunni and are afforded the same legal rights and protections covered by the Administration of Muslim Law Act, which does not explicitly name any one particular branch or sect. The most prominent branches in Singapore are the Twelver and Isma'ili.
Madrasahs in Singapore are full-time, religious institutions that offer a pedagogical mix of Islamic religious education and secular education in their curricula. While the Arabic term 'madrasah' literally translates to 'school', whether religious or secular, the term 'madrasah' is legally and colloquially defined in Singapore today as an 'Islamic religious school'. There are currently six madrasahs in Singapore offering primary to tertiary education, namely, Aljunied Al-Islamiah, Irsyad Zuhri Al-Islamiah, Al-Maarif Al-Islamiah, Alsagoff Al-Arabiah, Al-Arabiah Al-Islamiah, and Wak Tanjong Al-Islamiah. Four of them are co-educational, while the other two offer madrasah education exclusively to girls.
The Singapore Islamic Hub is a religious campus that houses Masjid Muhajirin, Madrasah Irsyad Zuhri Al-Islamiah and the headquarters of Majlis Ugama Islam Singapura (Muis). These institutions combined create a cohesive and symbiotic whole, embodies the Islamic principles of Iman, Ilmu and Amal respectively.
The Singapore Malay Chamber of Commerce and Industry (SMCCI) is a non-profit organization, established in 1956 to support the Malay/Muslim business community in Singapore.
