Edward John Davila (born June 21, 1952) is a United States District Judge of the United States District Court for the Northern District of California and a former judge on the Superior Court of California for Santa Clara County.

Early life and education

Davila was born in Palo Alto, California. He received a Bachelor of Arts degree from San Diego State University in 1976. [1] He then attended the University of California, Hastings College of the Law and earned his Juris Doctor in 1979. [1] [2]

On August 8, 2001, California Governor Gray Davis appointed Davila to serve as a judge on the Superior Court of California for Santa Clara County. [3] [4] Davila replaced Judge Donald Clark. [3] [2]

Gray Davis former governor of California

Joseph Graham "Gray" Davis Jr. is a retired American politician and attorney who served as the 37th Governor of California from 1999 to 2003. A member of the Democratic Party, only a few months into his second term, in 2003 Davis was recalled and removed from office, the second state governor successfully recalled in U.S. history. Prior to serving as governor, Davis was chief of staff to Governor Jerry Brown (1975–81), a California State Assemblyman (1983–87), California State Controller (1987–95) and the 44th Lieutenant Governor of California (1995–99). Davis holds a B.A. in history from Stanford University and a J.D. from Columbia Law School. He was awarded a Bronze Star for his service as a Captain in the Vietnam War.

While a Superior Court judge, Davila presided over the high-profile case of a Las Vegas couple, [5] Anna Ayala and Jaime Placencia, who planted a severed human finger in a bowl of Wendy's chili. [6] On January 18, 2006, Davila sentenced Ayala to 9 years in prison and Placencia to 12 years and 4 months in prison. [6]

Wendy's is an American international fast food restaurant chain founded by Dave Thomas on November 15, 1969, in Columbus, Ohio. The company moved its headquarters to Dublin, Ohio, on January 29, 2006. As of December 31, 2018, Wendy's was the world's third largest hamburger fast food chain with 6,711 locations, following Burger King and McDonald's. On April 24, 2008, the company announced a merger with Triarc Companies Inc., a publicly traded company and the parent company of Arby's. Despite the new ownership, Wendy's headquarters remained in Dublin. Previously, Wendy's had rejected more than two buyout offers from Triarc. Following the merger, Triarc became known as Wendy's/Arby's Group, and later as The Wendy's Company.

Chili con carne soup-like stew with chili peppers or chili powder

Chili con carne or chilli con carne, meaning "chili with meat" and sometimes known as simply "chili" or "chilli", is a spicy stew containing chili peppers, meat, and often tomatoes and beans. Other seasonings may include garlic, onions, and cumin. Geographic and personal tastes involve different types of meat and ingredients. Recipes provoke disputes among aficionados, some of whom insist that the word "chili" applies only to the basic dish, without beans and tomatoes. Chili con carne is a frequent dish for cook-offs and is used as an ingredient in other dishes.

During the 111th Congress, Senator Barbara Boxer recommended Davila to fill the United States District Court for the Northern District of California vacancy created when Marilyn Hall Patel assumed senior status. [7] [8] On May 20, 2010, President Barack Obama formally nominated Davila to the Northern District of California. [1] The Senate Judiciary Committee recommended his confirmation on December 1, 2010, but the Senate decided to recess without confirming him. [8] [9] [10] Obama renominated Davila on January 5, 2011. [10] [11] That nomination was approved by the Judiciary Committee on February 3, and he was confirmed by the Senate on February 14 by a vote of 93 ayes to 0 nays. He received his commission on March 3, 2011. [2]

Marilyn Hall Patel American judge

Marilyn Hall Patel is a former United States District Judge of the United States District Court for the Northern District of California.

Senior status is a form of semi-retirement for United States federal judges and judges in some state court systems. A judge must be at least 65 years of age and have served in federal courts for at least 15 years to qualify, with one less year of service required for each additional year of age. When that happens, they receive the full salary of a judge but have the option to take a reduced caseload, although many senior judges choose to continue to work full-time. Additionally, senior judges do not occupy seats; instead, their seats become vacant, and the president may appoint new full-time judges to fill their spots.

Davila is married to Mary Greenwood, who formerly served as Santa Clara County Public Defender and is Presiding Justice of the California Court of Appeal for the Sixth District. They reside in Menlo Park, California. [9]
