Independent Labor (or Independent Labour) is a description used in Australian politics, often to designate a politician who is an Australian Labor Party (ALP) member but not endorsed by the party at elections or if siting in a parliament, not a member of the Labor party room caucus. The label has also been used to describe candidate who identify with the labour movement, but not the ALP. [1]
The label is often used at local government elections, especially in states where the ALP does not endorse any candidates. However, registering a party or affiliation as an "Independent Labor" is not permitted in New South Wales under section 64 of the Electoral Act 2017, and the use of the term in electoral material is also considered an offence under section 180 of the act. [2] [3]
Currently, the there are two Independent Labor MPs in state parliament: David O’Byrne, who resigned from the Tasmanian Labor Party caucus in 2021, and Will Fowles, who resigned from the parliamentary Victorian Labor Party following allegations of a serious assault in 2023. [4] [5]
The first Independent Labour MP in federal politics was James Wilkinson, who was elected at the 1901 election. He had been a member of the ALP previously, and rejoined the party in 1903. [6]
Charlie Mutton was expelled from the Victorian Labor Party after contesting the 1940 Victorian state election as an Independent Labor candidate. [7] He was readmitted to the party in 1956. [7]
Doris Blackburn, a prominent socialist, was elected as the first female federal independent MP in 1946, standing as an Independent Labor candidate in the seat of Bourke. [8]
The Independent Labor Group was a grouping in the New South Wales Legislative Council from 1959 to 1977, after a number of Labor MLCs were expelled from the party for voting against the abolition of the Legislative Council, which was then party policy. [9]
In more recent years, the label has been rarely used outside of local elections. Former MP Brenton Best nominated as an Independent Labor candidate in 2017, and Territory Labor MP Jeff Collins used the label after resigning from the party in 2019, before later joining Territory Alliance. [10] [11]
On 23 August 2021, former Tasmanian Labor leader David O’Byrne resigned from the party caucus to sit as an Independent Labor MP, which he continued to do so until resigning his ALP membership on 4 February 2024. [12] [13]
On 5 August 2023, Ringwood MP Will Fowles was asked to resign from the parliamentary Victorian Labor Party by then-Premier Daniel Andrews following allegations of a serious assault. [5]
Australian politicians have also been elected under other independent labels, including Independent Liberal, Independent National, Independent Free Trade, Independent UAP and Independent Socialist. [14]
The Australian Labor Party (ALP), also commonly known as the Labor Party or simply Labor, is the major centre-left political party in Australia and one of two major parties in Australian politics, along with the centre-right Liberal Party of Australia. The party has been in government since being elected at the 2022 federal election, and with political branches in each state and territory, they currently form government in New South Wales, Queensland, South Australia, Victoria, Western Australia, the Australian Capital Territory, and the Northern Territory. As of 2023, Tasmania is the only state or territory where Labor forms the opposition. It is the oldest continuous political party in Australian history, being established on 8 May 1901 at Parliament House, Melbourne, the meeting place of the first federal Parliament.
The Democratic Labour Party (DLP), formerly the Democratic Labor Party, is an Australian political party. It broke off from the Australian Labor Party (ALP) as a result of the 1955 ALP split, originally under the name Australian Labor Party (Anti-Communist), and was renamed the Democratic Labor Party in 1957. In 1962, the Queensland Labor Party, a breakaway party of the Queensland branch of the Australian Labor Party, became the Queensland branch of the DLP.

Henry Alfred "Harry" Jenkins, is a former Australian politician. He was a member of the House of Representatives from 1986 to 2013, representing the Australian Labor Party (ALP).
Maurice McCrae Blackburn was an Australian politician and socialist lawyer, noted for his protection of the interests of workers and the establishment of the legal firm known as Maurice Blackburn Lawyers.
Doris Amelia Blackburn was an Australian social reformer and politician. She served in the House of Representatives from 1946 to 1949, the second woman after Enid Lyons to do so. Blackburn was a prominent socialist and originally a member of the Labor Party. She was married to Maurice Blackburn, a Labor MP, but he was expelled from the party in 1937 and she resigned from the party in solidarity. Her husband died in 1944, and she was elected to his former seat at the 1946 federal election – the first woman elected to parliament as an independent. However, Blackburn served only a single term before being defeated. She later served as president of the Women's International League for Peace and Freedom.
Adem Kubilay Somyurek is an Australian politician. He has served as a member of the Victorian Legislative Council currently representing the Northern Metropolitan Region.
Will Fowles is an Australian politician. He has been a member of the Victorian Legislative Assembly since November 2018, initially representing the seat of Burwood in Melbourne's Eastern suburbs. Ahead of the 2022 Victorian state election, the seat of Burwood was abolished by Victoria's Electoral Boundaries Commission, leading Fowles to stand for the seat of Ringwood, where he resides with his family.
David O'Byrne is an Australian trade unionist and politician. A prominent union leader prior to entering politics and the brother of fellow politician Michelle O'Byrne, he has been a Labor Party member of the Tasmanian House of Assembly since 2018 and previously served from 2010 to 2014, representing the electorate of Franklin.
Christopher Spence, an Australian politician, was a member of the New South Wales Legislative Assembly representing The Entrance for the Liberal Party from the 2011 New South Wales state election until 19 February 2014 when he moved to the parliamentary crossbench and sat as an independent after the Independent Commission Against Corruption heard evidence that Spence may have breached electoral funding laws. He retired in 2015.
The New South Wales Labor Party, officially known as the Australian Labor Party (New South Wales Branch) and commonly referred to simply as NSW Labor, is the New South Wales branch of the Australian Labor Party (ALP). The branch is the current ruling party in the state of New South Wales and is led by Chris Minns, who has served concurrently as premier of New South Wales since 2023.

He was a member of the New South Wales Legislative Assembly representing the electoral district of Newcastle for the Liberal Party from the 2011 New South Wales state election until 6 August 2014, when he moved to the parliamentary crossbench and sat as an independent, following evidence given to the Independent Commission Against Corruption (ICAC) that he may have breached electoral funding laws.
The history of the Australian Labor Party has its origins in the Labour parties founded in the 1890s in the Australian colonies prior to federation. Labor tradition ascribes the founding of Queensland Labour to a meeting of striking pastoral workers under a ghost gum tree in Barcaldine, Queensland in 1891. The Balmain, New South Wales branch of the party claims to be the oldest in Australia. Labour as a parliamentary party dates from 1891 in New South Wales and South Australia, 1893 in Queensland, and later in the other colonies.
Rosalind Louise Spence is an Australian politician. She has been a Labor Party member of the Victorian Legislative Assembly since November 2014, representing Yuroke from 2014 to 2022, then Kalkallo from 2022 onwards.
