The Speaker of the Sikkim Legislative Assembly is the title given to the presiding officer (chair) of the Mizoram Legislative Assembly. The Speaker's official role is to moderate debate, make rulings on procedure, announce the results of votes, etc. The Speaker decides who may speak and has the powers to discipline members who break the procedures of the Assembly. The Speaker often also represents the body in person, as the voice of the body in ceremonial and some other situations. Many bodies also have a speaker pro tempore or deputy speaker, designated to fill in when the speaker is not available.
The Speaker presides over the sessions of the Legislative Assembly and conducts the business in the Assembly. He decides whether a bill is a money bill or a non-money bill. He maintains discipline and decorum in the Assembly and can punish a member for their unruly behaviour by suspending them. He permits the moving of various kinds of motions and resolutions like the motion of no confidence, motion of adjournment, motion of censure and calling attention notice as per the rules. The Speaker decides on the agenda to be taken up for discussion during the meeting. The date of election of the Speaker is fixed by the Governor. [1]
Although the members of the Legislative Assembly represent their constituencies, the Speaker represents the whole Assembly. [1]
While the office of Speaker is vacant, the duties of the office are performed by the Deputy Speaker or, if the office of Deputy Speaker is also vacant, by such member of the Assembly as the Governor may appoint for the purpose. [1]
During the absence of the Speaker from any sitting of the Assembly the Deputy Speaker or, if he is also absent, such person as may be determined by the Assembly, or, if no such person is present, such other person as may be determined by the Assembly, shall act as Speaker. [1]
In the Legislative Assembly, a simple majority vote in the Assembly in which all present members participate determine both the Speaker and the Deputy Speaker — the presiding officers — who are also its members.
The party in power proposes the name of their candidate after its candidate after titular hearings with Leaders of other Parties who are a part of the Assembly. This ensures that the Speaker is accepted by all political Parties belonging to the Assembly. The name of the candidate determined by the party in power is usually proposed by the Chief Minister or the Minister of Parliamentary Affairs. The pro-tem Speaker chairs the session in which the election for the post of the Speaker takes place.
The Deputy Speaker chairs sessions where the election takes place towards the end of Legislative Assembly. Once the election is over, the person who is presiding declares the chosen candidate to be Speaker of the Assembly, without latter motions being voted upon. Once the final tally of votes is declared, the Chief Minister and Leader of the Opposition escort the Speaker elect to the Chair. His speech, in which he thanks the Assembly, marks the start of the tenure of the new Speaker. [1]
The term of office of the Speaker ranges from the day he is elected to the dissolution of the Legislative Assembly. When the Assembly is dissolved, the Speaker terminates his tenure as a member of the Assembly, but does not quit his position as Speaker. He stands eligible for re-election.
A member holding office as Speaker or Deputy Speaker of an Assembly shall vacate his office if his tenure as member of the Assembly is terminated; or may at any time by writing under his hand addressed, if such members is the Speaker, to the Deputy Speaker, and if such member is the Deputy Speaker, to the Speaker, resign his office; and may be removed from his office by a resolution of the Assembly provided that no resolution shall be moved unless at least fourteen days' notice has been given. Further, whenever the Assembly is dissolved, the speaker shall not vacate his office until immediately prior to the Legislation Assembly's first meeting after the dissolution. [2] [1]
At any sitting of the Legislative Assembly, while any resolution for the removal of the Speaker from his office is under consideration, the Speaker, or while any resolution for the removal of the Deputy Speaker from his office is under consideration, the Deputy Speaker, shall not, though he is present, preside, and during the absence of the Speaker from any sitting of the Assembly the Deputy Speaker in relation to every such sitting as they apply in relation to a sitting from which the Speaker or, as the case may be, the Deputy Speaker, is absent. The Speaker shall have the right to speak and take part in discussions in the Legislative Assembly while any resolution for his removal from office is under consideration in the Assembly and shall be entitled to vote only in the first instance on such resolution or on any other matter during such proceedings but not in the case of an equality of votes. Cloture, closure or, informally, a guillotine, is a motion or process in parliamentary procedure aimed at bringing debate to a quick end.
A motion or vote of no confidence is a motion and corresponding vote thereon in a deliberative assembly as to whether an officer is deemed fit to continue to occupy their office. The no-confidence vote is a defining constitutional element of a parliamentary system, in which the executive's mandate rests upon the continued support of the majority in the legislature. Systems differ in whether such a motion may be directed against the prime minister, against individual cabinet ministers, against the cabinet as a whole, or some combination of the above.
The Lok Sabha, also known as the House of the People, is the lower house of India's bicameral Parliament, with the upper house being the Rajya Sabha. Members of the Lok Sabha are elected by an adult universal suffrage and a first-past-the-post system to represent their respective constituencies, and they hold their seats for five years or until the body is dissolved by the President on the advice of the council of ministers. The speaker of the Lok Sabha is the presiding officer and the highest authority of the Lok Sabha, the lower house of the Parliament of India. The speaker is elected generally in the first meeting of the Lok Sabha following general elections. The speaker does not enjoy a security of tenure and his term is subjected to the pleasure of the house i.e. can be removed anytime by a resolution of the Lok Sabha by a majority of the all the then members of the house. The longest-serving speaker was Balram Jakhar, whose tenure lasted 9 years and 329 days.
Parliament of Sierra Leone is the legislative branch of the government of Sierra Leone. It is principally responsible for making laws. The Sierra Leone parliament consists of 149 members, of which 135 members are directly elected from across Sierra Leone's 16 districts, while 14 are paramount chiefs appointed from the 14 rural districts. The parliament is led by the Speaker of the House; the position is currently held by Abass Bundu of the Sierra Leone People's Party. The current elected 135 ordinary members of parliament are composed of members of the All People's Congress and the Sierra Leone People's Party which are the two largest political parties in Sierra Leone.
The House of Assembly of the British Virgin Islands, until 2007 known as the Legislative Council, has 15 members: 13 directly elected for four-year terms, and two ex officio members.
A committee of the whole is a meeting of a legislative or deliberative assembly using procedural rules that are based on those of a committee, except that in this case the committee includes all members of the assembly. As with other (standing) committees, the activities of a committee of the whole are limited to considering and making recommendations on matters that the assembly has referred to it; it cannot take up other matters or vote directly on the assembly's business. The purpose of a committee of the whole is to relax the usual limits on debate, allowing a more open exchange of views without the urgency of a final vote. Debates in a committee of the whole may be recorded but are often excluded from the assembly's minutes. After debating, the committee submits its conclusions to the assembly and business continues according to the normal rules.
The Provincial Assembly of the Punjab is a unicameral legislature of elected representatives of the Pakistani province of Punjab, which is located in Lahore, the provincial capital. It was established under Article 106 of the Constitution of Pakistan, having a total of 371 seats, with 297 general seats, 66 seats reserved for women and 8 reserved for non-Muslims.
Deliberative assemblies – bodies that use parliamentary procedure to arrive at decisions – use several methods of voting on motions. The regular methods of voting in such bodies are a voice vote, a rising vote, and a show of hands. Additional forms of voting include a recorded vote and balloting.
In certain countries, a motion in parliamentary procedure is a formal proposal by a member of a deliberative assembly that the assembly take certain action. The Sarawak State Legislative Assembly is the legislative chamber of the unicameral legislature of the Malaysian state of Sarawak; the Yang di-Pertua Negeri of Sarawak forms the other part of the legislature. The Assembly is modelled after the traditions of the Westminster parliamentary system, which originates from the practices of the British Parliament. The executive branch of government is drawn from the elected members of the Assembly. The State Legislative Assembly sits at the Sarawak State Legislative Assembly Building located in Petra Jaya in Kuching, the state capital.
