The gay panic defense or homosexual advance defence is a strategy of legal defense,which refers to a situation in which a heterosexual individual charged with a violent crime against a homosexual individual claims they lost control and reacted violently because of an unwanted sexual advance that was made upon them. A defendant will use available legal defenses against assault and murder,with the aim of seeking an acquittal,a mitigated sentence,or a conviction of a lesser offense. A defendant may allege to have found the same-sex sexual advances so offensive or frightening that they were provoked into reacting,were acting in self-defense,were of diminished capacity,or were temporarily insane,and that this circumstance is exculpatory or mitigating.
The Fells Acres day care sexual abuse trial took place in the Commonwealth of Massachusetts following charges initially lodged in the mid-1980s against family members who operated a day care center,Fells Acres Day School,in Malden,Massachusetts. The facility had been opened in 1966 by Violet Amirault (1923–1997). She and her two children—son Gerald Amirault and daughter Cheryl Amirault LeFave —were tried for sexually abusing children at their facility. Gerald was tried in 1986 while his sister and mother were tried in 1987. All three were convicted and sentenced to prison. The Amiraults deny the charges,which supporters regard as a conspicuous example of day-care sex-abuse hysteria.
Day-care sex-abuse hysteria was a moral panic that occurred primarily during the 1980s and early 1990s,and featured charges against day-care providers accused of committing several forms of child abuse,including Satanic ritual abuse. The Baylor University sexual assault scandal was the result of numerous allegations of and convictions for sexual and non-sexual assaults committed by Baylor University students,mostly players on the Baylor Bears football team. During a period from about 2012 to 2016,school officials suppressed reports of rapes and sexual misconduct. In 2016,Baylor's football team came under fire when it was revealed university officials had failed to take action regarding the alleged rapes and assaults. The scandal led to the ousting of head football coach Art Briles,the demotion and eventual resignation of Baylor president Ken Starr,the resignation of athletic director Ian McCaw,and the firing of two others connected with the football program. It also led to the resignation of Baylor's Title IX Coordinator,Patty Crawford. A plaintiff's attorney,Jim Dunnam,accused Baylor of implementing a ″concerted strategy to get the public to believe this is entirely and only a football-related problem."
Robin Camp is a former Federal Court of Canada judge. Camp was the subject of a high-profile removal hearing before the Canadian Judicial Council for his role in a 2014 sexual assault trial that he presided over. McNally v R [Crim 1051 (2013)],is a 2013 court decision in which the English and Wales Court of Appeals (EWCA) ruled that Scottish student Justine McNally's prior conviction of six counts of sexual assault by penetration would be upheld. McNally's sentence,however,was reduced. The convictions were made under the Sexual Offences Act 2003. Various other cases were explored to maintain the conviction,expanding the previously slim "rape by deception" laws. McNally v R was one of the first cases to display gender fraud or gender deception arguments.
