A special election for two judges of the International Criminal Court was held during the 8th session of the Assembly of States Parties to the Rome Statute of the International Criminal Court in The Hague on 18 November 2009. [1]
The election had become necessary after two judges elected in the January election were unavailable: Mohamed Shahabuddeen of Guyana had resigned before taking office [2] while Fumika Saiga of Japan had died on 24 April 2009. [3]
The judges elected at this election were chosen to complete the terms, until 10 March 2018, of the judges they replaced.
The election was governed by the Rome Statute of the International Criminal Court. Its article 36(8)(a) states that "[t]he States Parties shall, in the selection of judges, take into account the need, within the membership of the Court, for:

Each candidate must belong to exactly one list.
Further rules of election were adopted by a resolution of the Assembly of States Parties in 2004. [4]
Following these rules, the nomination period of judges for the November 2009 special election lasted from 5 August to 16 September 2009 and was extended thrice until 28 October 2009 due to the lack of candidates from some groups for which minimum voting requirements were in place. Minimum voting requirements governed part of the election. This was to ensure that article 36(8)(a) cited above is fulfilled. For this election, the following minimum voting requirements existed; they were to be adjusted once the election was underway.
Regarding the List A or B requirement, there was no minimum voting requirement. [6]
Regarding the regional criteria, there was a voting requirement for one judge from the Asian States and one judge from the Latin American and Caribbean States.
Regarding the gender criteria, there was no minimum voting requirement.
The regional and gender criteria were to be adjusted even before the election depending on the number of candidates. Paragraph 20(b) of the ASP resolution that governed the elections states that if there are less than double the number of candidates required for each region, the minimum voting requirement shall be a (rounded-up) half of the number of candidates; except when there is only one candidate which results in no voting requirement. Furthermore, if the number of candidates of one gender is less than ten, then the minimum voting requirement shall not exceed a certain number depending on the number of candidates.
The regional and gender criteria could have been dropped either if they were not (jointly) possible any more, or if after four ballots not all seats were filled.

The International Criminal Court is an intergovernmental organization and international tribunal seated in The Hague, Netherlands. It is the first and only permanent international court with jurisdiction to prosecute individuals for the international crimes of genocide, crimes against humanity, war crimes and the crime of aggression. The ICC is distinct from the International Court of Justice, an organ of the United Nations that hears disputes between states.
The Rome Statute of the International Criminal Court is the treaty that established the International Criminal Court (ICC). It was adopted at a diplomatic conference in Rome, Italy on 17 July 1998 and it entered into force on 1 July 2002. As of February 2024, 124 states are party to the statute. Among other things, it establishes court function, jurisdiction and structure.
United Nations Security Council resolution 1422, adopted unanimously on 12 July 2002, after noting the recent entry into force of the Rome Statute of the International Criminal Court, the Council granted immunity from prosecution by the International Criminal Court (ICC) to United Nations peacekeeping personnel from countries that were not party to the ICC.

The International Criminal Court has opened investigations in Afghanistan, the Central African Republic, Côte d'Ivoire, Darfur in Sudan, the Democratic Republic of the Congo, Kenya, Libya, Uganda, Bangladesh/Myanmar, Palestine, the Philippines, and Venezuela. Additionally, the Office of the Prosecutor conducted preliminary examinations in situations in Bolivia, Colombia, Guinea, Iraq / the United Kingdom, Nigeria, Georgia, Honduras, South Korea, Ukraine and Venezuela. Preliminary investigations were closed in Gabon; Honduras; registered vessels of Comoros, Greece, and Cambodia; South Korea; and Colombia on events since 1 July 2002.
The states parties to the Rome Statute of the International Criminal Court are those sovereign states that have ratified, or have otherwise become party to, the Rome Statute. The Rome Statute is the treaty that established the International Criminal Court, an international court that has jurisdiction over certain international crimes, including genocide, crimes against humanity, and war crimes that are committed by nationals of states parties or within the territory of states parties. States parties are legally obligated to co-operate with the Court when it requires, such as in arresting and transferring indicted persons or providing access to evidence and witnesses. States parties are entitled to participate and vote in proceedings of the Assembly of States Parties, which is the Court's governing body. Such proceedings include the election of such officials as judges and the Prosecutor, the approval of the Court's budget, and the adoption of amendments to the Rome Statute.
The eighteen judges of the International Criminal Court (ICC) are elected for nine-year terms by the member-countries of the court. Candidates must be nationals of those countries and they must "possess the qualifications required in their respective States for appointment to the highest judicial offices".
The International Criminal Court investigation in Kenya or the situation in the Republic of Kenya was an investigation by the International Criminal Court (ICC) into the responsibility for the 2007–2008 post-election violence in Kenya. The 2007–2008 crisis followed the presidential election that was held on 27 December 2007. The Electoral Commission of Kenya officially declared that the incumbent President Mwai Kibaki was re-elected however supporters of the opposition candidate Raila Odinga accused the government of electoral fraud and rejected the results. A series of protests and demonstrations followed, and fighting—mainly along tribal lines—led to an estimated 1,200 deaths and more than 500,000 people becoming internally displaced.
Six judges of the International Criminal Court were elected during the 10th session of the Assembly of States Parties to the Rome Statute of the International Criminal Court in New York between 12 and 21 December 2011. The judges elected, Anthony Carmona of Trinidad and Tobago, Miriam Defensor Santiago of the Philippines, Chile Eboe-Osuji of Nigeria, Robert Fremr of the Czech Republic, Olga Venecia Herrera Carbuccia of the Dominican Republic and Howard Morrison of the United Kingdom, took office on 11 March 2012.

Fumiko Saiga was a Japanese diplomat and was the first Japanese person and Asian woman to serve as a judge on the International Criminal Court. Her work focused on human rights and gender equality. As a politician, she was the Lieutenant Governor of Saitama Prefecture from 1998-2000.

The judges were elected for terms of nine years and took office on 11 March 2018.
