The Thirty-fifth Amendment of the Constitution (Age of Eligibility for Election to the Office of President) Bill 2015 (bill no. 6 of 2015) was a proposed amendment to the constitution of Ireland to reduce the minimum age of candidacy for the office of President of Ireland from 35 to 21. The bill was introduced to the Oireachtas in January 2015 by the Fine Gael–Labour government, after which both houses of the Oireachtas passed the bill. The bill was rejected by the electorate in a referendum on 22 May 2015 by 73.1% against to 26.9% in favour. [1]
The office of President was created when the Constitution was enacted in 1937. Douglas Hyde, the first president, took office in 1938. The age limit of 35 was set in the draft constitution introduced by the then Executive Council, in line with that of other countries, including the President of the United States. [2] [3] The draft subsection originally read: [4]
When the President of the Executive Council, Éamon de Valera, undertook to delete the words "and is not placed under disability or incapacity by law", he stated, "And if I get any support from the other members of the House, I should be inclined to say that I would wipe out the 35 years of age provision, too." [3] The latter was not pursued. [5]
Until the 1990 election of Mary Robinson, presidents were older men at the end of their career. The 1996 Constitution Review Group was divided on whether to reduce the age limit; the majority favoured "no change, or only a minor reduction", while a minority felt the age should be the same as for election to the Oireachtas (currently 21). [2] In 1997, the Oireachtas joint committee on the Constitution disagreed, recommending a reduction to age 18. [6] Private member's bills to reduce the age limit to 18 were introduced in 1999 by Eamon Gilmore and in 2011 by Catherine Murphy; neither was enacted. [7] [8]
After the 2011 general election, Fine Gael and the Labour Party formed a coalition government, the programme of which included the establishment of a Constitutional Convention to examine potential changes on specified issues, including "Reducing the President's term of office from seven to five years, and aligning with the European Parliament elections and local elections". [9] The convention considered the issue at its first working meeting, in January 2013, and voted against either of the specified proposals; however, it voted in favour of two others: reducing the nomination age from 35 to 21, and allowing candidate nomination by electors. [10] The age-reduction proposal was passed by 50 votes to 47, with three "don't know". [10] The choice of relatively minor questions for the convention's first meeting was defended by the Taoiseach, who said, "It is not that there are no exceptionally difficult constitutional issues, but the aim is to see how the constitutional convention will actually operate and whether it can do its work effectively." [11] The convention's report on its first meeting was formally submitted in March 2013, and the government formally responded in July, when Taoiseach Enda Kenny promised a referendum "before the end of 2015" on reducing the age of candidacy; the proposal on popular nomination was referred to an Oireachtas committee. [12] In December 2014, the cabinet agreed to hold the promised referendum in May 2015, [13] and in January 2015, the amendment bill was formally introduced in the Dáil by the Minister for the Environment, Community and Local Government, Alan Kelly. [14]
The government held simultaneous referendums on 22 May 2015, on the presidential age bill and another constitutional amendment, to allow same-sex marriage. [15] [16] A Dáil by-election in Carlow–Kilkenny was held on the same day. [15]
The bill as passed by both Houses of the Oireachtas proposed to change the wording of Article 12.4.1° from [emphasis added]: [2] [17]

Although the proposed change concerned both versions of the text, it is the Irish language version that takes precedence. As well as the substantive change down to 21, the proposed wording modifies two ambiguities in the English-language version of the text. Firstly, it avoids an ambiguity as to the year in question: one's "thirty-fifth year" begins immediately after one's thirty-fourth birthday, so a strict reading of the text does not have the intended meaning. Secondly, the male pronoun "his" is removed in favour of gender-neutral language. [18] These changes were however essentially symbolic: two women, Mary Robinson and Mary McAleese had already been presidents of Ireland, and the original Irish text unambiguously indicates the age of eligibility as 35.
The presidential age referendum was the subject of far less media coverage or active advocacy than the marriage referendum, and described as "forgotten", [19] "invisible", [20] or "the other referendum". [21] Fine Gael, Fianna Fáil, and Sinn Féin were nominally in favour, though some representatives of Fine Gael and Fianna Fáil said they would be voting No. [22] The Labour Party took no position on the referendum, having supported the bill in the Oireachtas. [22] The Union of Students in Ireland supported a Yes vote. [23] [24] Solidarity called for a Yes vote in the referendum and put forward an amendment in the Dáil to reduce the age to 18.
In The Irish Times in February 2015, academics Theresa Reidy and Colum Kenny took opposite stances on the proposal. [25] [26] Reidy argued that it would encourage youth participation in politics and broaden the choice of candidates available to voters, while admitting that the issue was far less important than other amendment proposals not proceeded with. [25] Kenny argued that any young person likely to succeed in being nominated would be "a creature of a political party, chosen and funded as a gimmick", and suggested that a No vote would "send a message to Oireachtas Éireann that politicians ought not to toy with the Constitution or patronise the electorate". [26] Diarmaid Ferriter endorsed an internet comment that "the only under 35-year-olds who would think that they would be suitable for the role would be the sort of self-righteous Yoof upstarts that should be let nowhere near such an important and distinguished position". [27] Fintan O'Toole called it "the single most frivolous proposal ever put to the people". [28] Among Yes-advocates, Michael Noonan named Michael Collins and (jocularly) Jesus as prominent people too young to run; [29] among No-advocates, Niall Horan was similarly instanced. [30] [31]

The National Youth Council of Ireland regretted the defeat, which it said "was due, in part, to a failure on the Government’s side to explain or promote the issue". [34]
The president of Ireland is the head of state of Ireland and the supreme commander of the Irish Defence Forces.
The Constitution of the Irish Free State was adopted by Act of Dáil Éireann sitting as a constituent assembly on 25 October 1922. In accordance with Article 83 of the Constitution, the Irish Free State Constitution Act 1922 of the British Parliament, which came into effect upon receiving the royal assent on 5 December 1922, provided that the Constitution would come into effect upon the issue of a Royal Proclamation, which was done on 6 December 1922. In 1937 the Constitution of the Irish Free State was replaced by the modern Constitution of Ireland following a referendum.
The Government of the 8th Dáil or the 7th Executive Council was the Executive Council of the Irish Free State formed after the general election held on 24 January 1933. It was led by Fianna Fáil leader Éamon de Valera as President of the Executive Council, who had first taken office in the Irish Free State after the 1932 general election. De Valera had previously served as President of Dáil Éireann, or President of the Republic, from April 1919 to January 1922 during the revolutionary period of the Irish Republic.
There were two Governments of the 6th Dáil, which was elected at the September 1927 general election held on 15 September 1927. The 4th Executive Council and the 5th Executive Council were both minority governments of Cumann na nGaedheal led by W. T. Cosgrave as President of the Executive Council.
The Fourth Amendment of the Constitution Act 1972 is an amendment to the Constitution of Ireland which lowered the voting age for all national elections and referendums in the state from twenty-one to eighteen years of age. It was approved by referendum on 7 December 1972 and signed into law on 5 January 1973.
The Ninth Amendment of the Constitution Act 1984 is an amendment to the Constitution of Ireland that allowed for the extension of the right to vote in elections to Dáil Éireann to non-Irish citizens. It was approved by referendum on 14 June 1984, the same day as the European Parliament election, and signed into law on 2 August of the same year.
Amendments to the Constitution of Ireland are only possible by way of referendum. A proposal to amend the Constitution of Ireland must first be passed as a bill by both Houses of the Oireachtas (parliament), then submitted to a referendum, and finally signed into law by the President of Ireland. Since the constitution entered into force on 29 December 1937, there have been 32 amendments to the constitution.
An ordinary referendum in Ireland is a referendum on a bill other than a bill to amend the Constitution. The Constitution prescribes the process in Articles 27 and 47. Whereas a constitutional referendum is mandatory for a constitutional amendment bill, an ordinary referendum occurs only if the bill "contains a proposal of such national importance that the will of the people thereon ought to be ascertained". This is decided at the discretion of the President, after a petition by Oireachtas members including a majority of Senators. No such petition has ever been presented, and thus no ordinary referendum has ever been held.
The Oireachtas of the Irish Free State was the legislature of the Irish Free State from 1922 until 1937. It was established by the 1922 Constitution of Ireland which was based from the Anglo-Irish Treaty. It was the first independent Irish Parliament officially recognised outside Ireland since the historic Parliament of Ireland which was abolished with the Acts of Union 1800.
The current Constitution of Ireland came into effect on 29 December 1937, repealing and replacing the Constitution of the Irish Free State, having been approved in a national plebiscite on 1 July 1937 with the support of 56.5% of voters in the then Irish Free State. The Constitution was closely associated with Éamon de Valera, the President of the Executive Council of the Irish Free State at the time of its approval.
The Third Amendment of the Constitution Bill 1958 was a proposal to amend the Constitution of Ireland to alter the electoral system from proportional representation under the single transferable vote (PR-STV) to first-past-the-post (FPTP). The proposal was rejected in a referendum held on 17 June 1959. This was the same date as the presidential election in which Taoiseach Éamon de Valera was elected as president.
The Fourth Amendment of the Constitution Bill 1968 was a bill to amend the Constitution of Ireland to alter the electoral system for elections to Dáil Éireann, the house of representatives of the Oireachtas, from proportional representation by means of the single transferable vote (PR-STV) to first-past-the-post (FPTP). It was one of two referendums on the elections held on 16 October 1968, the other being a proposal to allow a greater variance in representation. Both bills were rejected.
The Convention on the Constitution was established in Ireland in 2012 to discuss proposed amendments to the Constitution of Ireland. More commonly called simply the Constitutional Convention, it met for the first time 1 December 2012 and sat until 31 March 2014. It had 100 members: a chairman; 29 members of the Oireachtas (parliament); four representatives of Northern Ireland political parties; and 66 randomly selected citizens of Ireland.
The Thirty-first Amendment of the Constitution (Children) Act 2012 amended the Constitution of Ireland by inserting clauses relating to children's rights and the right and duty of the state to take child protection measures. It was passed by both Houses of the Oireachtas (parliament) on 10 October 2012, and approved at a referendum on 10 November 2012, by 58% of voters on a turnout of 33.5%. Its enactment was delayed by a High Court case challenging the conduct of the referendum. The High Court's rejection of the challenge was confirmed by the Supreme Court on 24 April 2015. It was signed into law by the President on 28 April 2015.
The Thirty-second Amendment of the Constitution Bill 2013 was a proposal to amend the Constitution of Ireland to abolish Seanad Éireann, the upper house of the Irish parliament, the Oireachtas. The proposal was rejected by the electorate in a referendum on 4 October 2013 by 51.7% voting against to 48.3% in favour.
The Marriage Act 2015 is an act of the Oireachtas which provides for same-sex marriage in Ireland. The act gives legislative effect in statute law to the Thirty-fourth Amendment of the Constitution of Ireland, which mandates such provision. It was introduced on 15 September 2015 and signed into law on 29 October 2015, and commenced on 16 November 2015.
The Citizens' Assembly is a citizens' assembly established in Ireland in 2016 to consider several political questions including the Constitution of Ireland. Questions considered include: abortion, fixed term parliaments, referendums, population ageing, and climate change. Over 18 months a report is produced on each topic. The government is required to respond officially to the reports in the Oireachtas (parliament); as of 9 April 2019 responses have been given on three of the five topics.
The Thirty-eighth Amendment of the Constitution of Ireland is an amendment to the Constitution of Ireland which altered the provisions regulating divorce. It removed the constitutional requirement for a defined period of separation before a Court may grant a dissolution of marriage, and eased restrictions on the recognition of foreign divorces. The amendment was effected by an act of the Oireachtas, the Thirty-eighth Amendment of the Constitution Act 2019.
Various proposals have been considered since the 1980s to extend the franchise in Irish presidential elections to citizens resident outside the state. In 2019, the then government introduced a bill to amend the constitution to facilitate this extension. The bill lapsed in January 2020 when the 32nd Dáil was dissolved for the 2020 general election, but was restored to the order paper in July 2020.
One acerbic contributor to a popular politics website made the colourful, and I suspect accurate [emphasis added], observation that "the only under 35-year-olds who would think that they would be suitable for the role would be the sort of self-righteous Yoof upstarts that should be let nowhere near such an important and distinguished position".
