United Nations Security Council Resolution 1816 was unanimously adopted on 2 June 2008.
Condemning all acts of piracy and armed robbery against vessels off the coast of Somalia, the Security Council this afternoon authorized a series of decisive measures to combat those crimes.
By the terms of resolution 1816 (2008), which was unanimously adopted today, the Council decided that the States cooperating with the country's transitional Government would be allowed, for a period of six months, to enter the territorial waters of Somalia and use “all necessary means” to repress acts of piracy and armed robbery at sea, in a manner consistent with relevant provisions of international law.
The text was adopted with consent of Somalia, which lacks the capacity to interdict pirates or patrol and secure its territorial waters, following a surge in attacks on ships in the waters off the country's coast, including hijackings of vessels operated by the World Food Programme and numerous commercial vessels – all of which posed a threat “to the prompt, safe and effective delivery of food aid and other humanitarian assistance to the people of Somalia”, and a grave danger to vessels, crews, passengers and cargo.
Affirming that the authorization provided in the resolution applies only to the situation in Somalia and shall not affect the rights and obligations under the Law of the Sea Convention, nor be considered as establishing customary international law, the council also requested cooperating States to ensure that anti-piracy actions they undertake do not deny or impair the right of innocent passage to the ships of any third State.
While urging States, whose naval vessels and military aircraft operate on the high seas and airspace of the coast of Somalia to be vigilant, the Council encouraged States interested in the use of commercial routes off the coast of Somalia to increase and coordinate their efforts to deter attacks upon and hijacking of vessels, in cooperation with the country's Government. All States were urged to cooperate with each other, the International Maritime Organization (IMO) and, as appropriate, regional organizations and render assistance to vessels threatened by or under attack by pirates.
Speaking prior to action on the draft, Indonesia's representative emphasized the need for the draft to be consistent with international law, particularly the 1982 United Nations Convention on the Law of the Sea, and to avoid creating a basis for customary international law for the repression of piracy and armed robbery at sea. Actions envisaged in the resolution should only apply to the territorial waters of Somalia, based upon that country's prior consent. Maritime security is an umbrella term informed to classify issues in the maritime domain that are often related to national security, marine environment, economic development, and human security. This includes the world's oceans but also regional seas, territorial waters, rivers and ports, where seas act as a “stage for geopolitical power projection, interstate warfare or militarized disputes, as a source of specific threats such as piracy, or as a connector between states that enables various phenomena from colonialism to globalization”. The theoretical concept of maritime security has evolved from a narrow perspective of national naval power projection towards a buzzword that incorporates many interconnected sub-fields. The definition of the term maritime security varies and while no internationally agreed definition exists, the term has often been used to describe both existing, and new regional and international challenges to the maritime domain. The buzzword character enables international actors to discuss these new challenges without the need to define every potentially contested aspect of it. Maritime security is of increasing concern to the global shipping industry, where there are a wide range of security threats and challenges. Some of the practical issues clustered under the term of maritime security include crimes such as piracy, armed robbery at sea, trafficking of people and illicit goods, illegal fishing or marine pollution. War, warlike activity, maritime terrorism and interstate rivalry are also maritime security concerns.
Maritime Security Regimes are codes and conventions of behavior agreed upon by coastal states to provide a degree of security within territorial waters and on the high seas.
Piracy in the Gulf of Guinea affects a number of countries in West Africa as well as the wider international community. By 2011, it had become an issue of global concern. Pirates in the Gulf of Guinea are often part of heavily armed criminal enterprises, who employ violent methods to steal oil cargo. In 2012, the International Maritime Bureau, Oceans Beyond Piracy and the Maritime Piracy Humanitarian Response Program reported that the number of vessels attacks by West African pirates had reached a world high, with 966 seafarers attacked during the year. According to the Control Risks Group, pirate attacks in the Gulf of Guinea had by mid-November 2013 maintained a steady level of around 100 attempted hijackings in the year, a close second behind the Strait of Malacca in Southeast Asia. Piracy in the Gulf of Guinea continues to be a concern to the shipping industry, which is affected significantly. At the same time, governments in the region generally highlight that the fight against piracy requires a broad understanding of maritime security throughout the Gulf of Guinea.
Piracy off the coast of Somalia occurs in the Gulf of Aden, Guardafui Channel and Somali Sea, in Somali territorial waters and other surrounding places and has a long and troubled history with different perspectives from different communities. It was initially a threat to international fishing vessels during the early 2000s, only to rapidly escalate and expand to international shipping during the War in Somalia (2006–2009).
United Nations Security Council Resolution 1838 is a United Nations Security Council resolution that calls on nations with vessels in the Somali piracy region to apply military force as a means of repressing acts of piracy. Adopted unanimously on October 7, 2008, it recommends that states commit both naval and air forces to fight this crime. The text was drafted by French authorities.
United Nations Security Council Resolution 1918, adopted unanimously on April 27, 2010, after recalling resolutions 1814 (2008), 1816 (2008), 1838 (2008), 1844 (2008), 1846 (2008), 1851 (2008) and 1897 (2008) on Somalia, the Council called on countries to criminalise piracy within their national laws.
United Nations Security Council Resolution 1950, adopted unanimously on November 23, 2010, after recalling previous resolutions on the situation in Somalia, including resolutions 1814 (2008), 1816 (2008), 1838 (2008), 1844 (2008), 1846 (2008), 1851 (2008), 1897 (2009) and 1918 (2010); the Council re-authorised states to intervene in acts of piracy by Somali pirates at sea for a further period of twelve months.
Piracy in the 21st century has taken place in a number of waters around the world, including the Gulf of Guinea, Strait of Malacca, Sulu and Celebes Seas, Indian Ocean, and Falcon Lake.
United Nations Security Council Resolution 1976, adopted unanimously on April 11, 2011, after recalling previous resolutions on the situation in Somalia, particularly resolutions 1918 (2010) and 1950 (2010), the Council decided to consider the establishment of special Somali courts to try pirates operating off the coast of the country.

Operation Allied Protector was an anti-piracy military operation undertaken by NATO forces from March – August 2009 in the Gulf of Aden, the Indian Ocean, and the Guardafui Channel to protect maritime routes from pirates within the International Recommended Transit Corridor (IRTC). It was the second NATO anti-piracy operation in area following Operation Allied Provider and was succeeded by Operation Ocean Shield.
Piracy in Somalia has been a threat to international shipping since the beginning of the country's civil war in the early 1990s. Since 2005, many international organizations have expressed concern over the rise in acts of piracy. Piracy impeded the delivery of shipments and increased shipping expenses, costing an estimated $6.6 to $6.9 billion a year in global trade in 2011 according to Oceans Beyond Piracy (OBP).
International piracy law is international law that is meant to protect against piracy. Throughout history and legal precedents, pirates have been defined as hostis humani generis, Latin for "the enemy of all mankind". The United Nations has codified much of the law in the United Nations Convention on the Law of the Sea (UNCLOS), which defines different types of piracy and ways to combat it.
Piracy kidnappings occur during piracy, when people are kidnapped by pirates or taken hostage. Article 1 of the United Nations International Convention against the Taking of Hostages defines a hostage-taker as "any person who seizes or detains and threatens to kill, to injure, or to continue to detain another person in order to compel a third party namely, a State, an international intergovernmental organization, a natural or Juridical person, or a group of people, to do or abstain from doing any act as an explicit or implicit condition tor the release of the hostage commits the offense of taking of hostages ("hostage-taking") within the meaning of this Convention." Kidnappers often try to obtain the largest financial reward possible in exchange for hostages, but piracy kidnappings can also be politically motivated.
