Annali Christelle Basson (born 10 October 1960) is a South African judge of the High Court of South Africa. She was appointed to the Gauteng Division in January 2016 after serving in the Labour Court from 2007 to 2016. Before her appointment to the bench,she was a legal academic at the University of South Africa,where she specialised in labour law and mercantile law. She was an acting judge in the Constitutional Court in 2018 and was shortlisted for permanent appointment to that court in 2019.
Basson was born on 10 October 1960 in Pretoria. [1] She matriculated in 1978 at the Afrikaanse Hoër Meisieskool Pretoria and went on to the University of Pretoria,where she completed a BLC in 1982 and an LLB in 1984. [1]
Later,in 1990,she completed an LLD at the University of South Africa,focusing on second-generation human rights with a labour law perspective. [1] Basson later said that her doctoral research emerged from her own personal commitment to human rights. [2]
While studying towards her LLB,Basson was a junior lecturer at the University of South Africa,where she taught mercantile law. In 2003, [2] she was promoted to become a full professor of labour law,still in the mercantile law department. [1] She remained in that position until July 2007,during which time she published in labour law,public law,and human rights law. [1] [2]
At the same time,Basson was admitted as an advocate in 1985 and was a member of the Pretoria Bar between 2003 and 2007. She was also a member of the Industrial Court from 1988 to 1994 and an ad hoc commissioner at the Commission for Conciliation,Mediation and Arbitration from 1996 to 2007. [1]
Basson left academia in order to become a judge of the Labour Court,joining the bench on 1 July 2007. [1] She was appointed by President Thabo Mbeki on the recommendation of the Judicial Service Commission, [3] and she presided in the court for over eight years. [1] Her notable judgements in the Labour Court include David Crouch Marketing v Du Plessis and Sindane v Prestige Cleaning Services .
In October 2015,Basson was shortlisted and interviewed for possible appointment to fill vacancies arising in the Gauteng Division of the High Court of South Africa. During the interviews,Deputy Chief Justice Dikgang Moseneke lauded her "simply remarkable" academic performance. [4] She was one of six candidates whom the Judicial Service Commission recommended for appointment to the vacancies, [5] [6] and President Jacob Zuma confirmed her appointment in December 2015,with effect from 1 January 2016. [7]
In November 2018,sitting in the Pretoria High Court,Basson handed down judgement in Baleni v Minister of Mineral Resources,sometimes known as the Xolobeni judgement. The case concerned community opposition to the Xolobeni mine,a proposed titanium mine in the Wild Coast region of the Eastern Cape. Basson affirmed that customary communities had customary rights to their land and agreed with the applicants' counsel,Tembeka Ngcukaitobi,that the Interim Protection of Informal Land Rights Act obliged the Minister of Mineral Resources to obtain the full consent of affected customary communities before granting commercial mining rights under the Mineral and Petroleum Resources Development Act. In January 2022,in an application brought by the Organisation Undoing Tax Abuse,Basson ruled that the national Administrative Adjudication of Road Traffic Offences Act was unconstitutional insofar as it intruded upon local and provincial competences. [11] [12] However,in July 2023,the Constitutional Court unanimously overruled her in Organisation Undoing Tax Abuse v Minister of Transport,with Chief Justice Ray Zondo writing that the Constitution provided for the national Parliament to take on the relevant competences. [13]
Basson was an acting judge in the Constitutional Court from July 2018 to December 2018, [1] during which time she wrote for the court's majority in Competition Commission v Hosken Consolidated Investments and Steenkamp v Edcon. She later served as an acting judge in the Supreme Court of Appeal from June 2022 to November 2022. [1]
In February 2019,the Judicial Service Commission announced that Basson was among six candidates who had been nominated for possible appointment to two permanent vacancies at the Constitutional Court. [14] Interviews were held in April,and Basson was asked about her recent Baleni judgement,about land reform,and,by Supreme Court Justice Azhar Cachalia,about her apparent lack of experience in private law. [2] [15] [16] She told the panel that she did not hesitate to engage in judicial activism and that her academic experience would assist her on the Constitutional Court. [2] [17] Following the interviews,the Judicial Service Commission recommended Basson and four others –Jody Kollapen,Steven Majiedt,Zukisa Tshiqi,and Patricia Goliath –as suitable for appointment. [18] However,in September 2019,President Cyril Ramaphosa announced that he had elected to appoint Tshiqi and Majiedt,who widely been viewed as the frontrunners. [19]
Basson has three children. [1] She is a fifth-degree black belt in taekwondo,a former member of the executive board of the International Taekwondo Federation,and the former president of the federation's African branch. [1] [20] Before joining the bench,she was a member of the Pan Africanist Congress. [15] [16]
Baaitse Elizabeth "Bess" Nkabinde-Mmono is a South African retired judge who served in the Constitutional Court of South Africa from January 2006 to December 2017. During that time,she was acting Deputy Chief Justice of South Africa from 23 May 2016 to 7 June 2017. She joined the bench in November 1999 as a judge of the Bophuthatswana Provincial Division.
Narandran "Jody" Kollapen is a South African judge who joined the Constitutional Court of South Africa on 1 January 2022. He was appointed to the apex court by President Cyril Ramaphosa after a decade of service in the High Court of South Africa. He is also a former chairperson of the South African Human Rights Commission.
Johan Coenraad Froneman is a South African retired judge who was a justice of the Constitutional Court of South Africa from October 2009 to May 2020. He joined the judiciary as a judge of the Eastern Cape Division in 1994 and was elevated to the apex court by President Jacob Zuma. He was also the inaugural Deputy Judge President of the Labour Court of South Africa between 1996 and 1999.
Sisi Virginia Khampepe is a retired South African judge who served in the Constitutional Court of South Africa between October 2009 and October 2021. Formerly a prominent labour lawyer,she joined the bench in December 2000 as a judge of the Transvaal Provincial Division. She was also a member of the Truth and Reconciliation Commission.
Lex Mpati is a South African retired judge who was the President of the Supreme Court of Appeal of South Africa from August 2008 to May 2016. He was appointed to the bench in February 1997 as a judge of the Eastern Cape Division and he joined the Supreme Court as a puisne judge in December 2000. Before his elevation to the presidency,he was the Supreme Court's first Deputy President from 2003 to 2008. He was also an acting judge in the Constitutional Court in 2007.
Zukisa Laura Lumka Tshiqi is a South African judge of the Constitutional Court of South Africa. She formerly served in the Supreme Court of Appeal from December 2009 until October 2019,when President Cyril Ramaphosa elevated her to the Constitutional Court. She was a practising attorney until she was first appointed to the bench in the Gauteng High Court in 2005.
Steven Arnold Majiedt is a South African judge of the Constitutional Court of South Africa. He joined the Constitutional Court in October 2019 as an appointee of President Cyril Ramaphosa. Formerly a practicing advocate,he served in the Supreme Court of Appeal from 2010 to 2019 and in the Northern Cape High Court from 2000 to 2010.
Mandisa Muriel Lindelwa Maya is the Chief Justice of South Africa. She was formerly the President of the Supreme Court of Appeal from 2017 to 2022 before she was elevated to the position of Deputy Chief Justice of South Africa in September 2022. She joined the bench in May 2000 as a judge of the Transkei Division of the High Court of South Africa and was elevated to the Supreme Court of Appeal in 2006.
Patricia Lynette Goliath is a South African judge of the High Court of South Africa. She has been the acting Judge President of the Western Cape Division since December 2022,when John Hlophe was suspended and then impeached.
Xola Mlungisi Petse is a retired South African judge who was the Deputy President of the Supreme Court of Appeal between 2019 and 2024. A former attorney,he joined the Supreme Court as a puisne judge in June 2012. Before that,he was a judge of the Eastern Cape High Court from July 2005 to May 2012.
Owen Lloyd Rogers is a South African judge of the Constitutional Court of South Africa. Before his appointment to that court in August 2022,he served in the Western Cape Division of the High Court for nine years,having joined the bench in February 2013. Formerly an advocate and senior counsel at the Cape Bar,he was also a judge of the Competition Appeal Court between 2016 and 2022.
Mahube Betty Molemela is a South African judge who has been the President of the Supreme Court of Appeal since 1 June 2023. Before her appointment to the Supreme Court in June 2018,she was the first woman Judge President of the Free State High Court from 2015 to 2018. A former attorney,she was appointed to the bench in the Free State in July 2008.
Daisy Sekao Molefe is a South African judge of the Supreme Court of Appeal. Formerly a commercial lawyer,she was a judge of the Gauteng High Court from July 2013 until December 2022,when she was appointed to the Supreme Court of Appeal.
Fayeeza Kathree-Setiloane is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 13 years in the Gauteng High Court. Before her appointment to the bench in October 2010,she practiced as an advocate of the High Court in Johannesburg;she was involved in constitutional litigation,including through the Legal Resources Centre,and also served a stint in corporate advisory at Werksmans.
Dumisani Hamilton Zondi is a South African judge who is the Deputy President of the Supreme Court of Appeal. He was appointed as the chairperson of the Electoral Court in December 2022. Before his elevation to the Supreme Court in June 2014,he served in the Western Cape High Court between 2007 and 2014,as well as in the Competition Appeal Court between 2011 and 2014. He entered legal practice as an attorney in 1986.
Aubrey Phago Ledwaba is a South African judge who is currently serving as the Deputy Judge President of the Gauteng Division of the High Court of South Africa. Formerly a practising attorney in Gauteng,he joined the bench as a puisne judge in November 2005 and was elevated to his leadership position in July 2013. He was an acting judge in the Constitutional Court in 2019 and an acting judge in the Supreme Court of Appeal between 2020 and 2021.
Alan Christopher Dodson SC is a South African lawyer who was a judge of the Land Claims Court from 1995 to 2000. He was also the chairperson of the United Nations's Housing and Property Claims Commission in Kosovo from 2000 to 2007. A member of the Johannesburg Bar since 2001 and Senior Counsel since 2011,he formerly practised as an attorney between 1987 and 1995.
Anna Maleshane Kgoele,also spelled Annah Malefsane Kgoele,is a South African judge of the Supreme Court of Appeal. She joined the appellate court in December 2023 after 14 years in the High Court of South Africa. From 2014 to 2018,she was the president of the South African chapter of the International Association of Women Judges.
Segopotje Sheila Mphahlele is a South African judge who is currently serving as the Judge President of the Mpumalanga High Court. Formerly an attorney and insolvency practitioner,she has been a judge of the High Court of South Africa since December 2013.
Mmathebe Violet Phatshoane is a South African judge who is currently serving as Deputy Judge President of the Northern Cape High Court. She joined the court as a puisne judge in May 2011 and was appointed to the deputy judge presidency in July 2021. Before entering the judiciary,she practised as an attorney in Bloemfontein,specialising in commercial law and labour law.
