Audit Wales (Welsh : Archwilio Cymru), formerly the Wales Audit Office (WAO, Welsh : Swyddfa Archwilio Cymru), [1] is an independent public body which was established by the Senedd (Welsh Parliament; Welsh : Senedd Cymru, formerly the National Assembly for Wales) on 1 April 2005. It has overall responsibility for auditing on behalf of the Auditor General for Wales, across all sectors of government in Wales, except those reserved to the UK government.
Their aim is to ensure that the people of Wales know whether public money is being managed wisely and that public bodies in Wales understand how to improve outcomes. [2]
This overall aim is supported by four key objectives:
Audit Wales currently audits around 800 public bodies including the Welsh Government, NHS Wales, and local government.
Audit Wales takes the form of a statutory board, which employs staff, secures resources and monitors and advises the Auditor General. The Senedd appoints the Chair and 3 other non-executive members to the board. The other members are the Auditor General and 3 employees. [4] Audit Wales currently employ around 240 people across 3 offices in Cardiff, Swansea and Ewloe.
On 1 July 1999, The National Assembly for Wales (Transfer of Functions) Order 1999 came into effect, this transferred all powers from the Secretary of State for Wales to the Senedd. Wales did not have its own auditing body, as all public auditing was carried out by the National Audit Office and the Audit Commission. It was not until 1 April 2005 that Audit Wales was created after the Public Audit (Wales) Act 2004 came into effect.
The Public Audit (Wales) Act 2004, the Government of Wales Act 1998 and Government of Wales Act 2006 and other legislation currently provide the statutory basis for the Auditor General and the auditors he appoints in local government to fulfill their purpose across the Welsh public sector. In 2012 the Welsh Government introduced before the National Assembly the Public Audit (Wales) Bill. One feature of the Bill as currently drafted is to make provision for the Auditor General to be the statutory auditor of local government bodies. [3]
The legislatures of the United Kingdom are derived from a number of different sources. The Parliament of the United Kingdom is the supreme legislative body for the United Kingdom and the British overseas territories with Scotland, Wales and Northern Ireland each having their own devolved legislatures. Each of the three major jurisdictions of the United Kingdom has its own laws and legal system.
Local government in Wales is primarily undertaken by the twenty-two principal councils. The councils are unitary authorities, meaning they are responsible for providing local government services within their principal area, including education, social work, environmental protection, and most highway maintenance. The principal areas are divided into communities, most of which have an elected community council. The services provided by community councils vary, but they will typically maintain public spaces and facilities. Local councils in Wales are elected; the most recent local elections in Wales took place in 2022, and the next are due to take place in 2027.
The Senedd, officially known as the Welsh Parliament in English and Senedd Cymru in Welsh, is the devolved, unicameral legislature of Wales. A democratically elected body, it makes laws for Wales, agrees to certain taxes, and scrutinises the Welsh Government. It is a bilingual institution, with both Welsh and English being the official languages of its business. From its creation in May 1999 until May 2020, the Senedd was officially known as the National Assembly for Wales and was often simply called the Welsh Assembly.
England and Wales is one of the three legal jurisdictions of the United Kingdom. It covers the constituent countries England and Wales and was formed by the Laws in Wales Acts 1535 and 1542. The substantive law of the jurisdiction is English law.
The Welsh Government is the executive arm of the devolved government of Wales. The government consists of cabinet secretaries and ministers. It is led by the first minister, usually the leader of the largest party in the Senedd, who selects ministers with the approval of the Senedd. The government is responsible for tabling policy in devolved areas for consideration by the Senedd and implementing policy that has been approved by it.
The National Audit Office (NAO) is an independent Parliamentary body in the United Kingdom which is responsible for auditing central government departments, government agencies and non-departmental public bodies. The NAO also carries out value for money (VFM) audits into the administration of public policy.
Politics in Wales forms a distinctive polity in the wider politics of the United Kingdom, with Wales as one of the four constituent countries of the United Kingdom (UK).
The Senedd constituencies and electoral regions are the electoral districts used to elect members of the Senedd to the Senedd, and have been used in some form since the first election of the then National Assembly for Wales in 1999. New boundaries were introduced for the 2007 elections and currently consist of forty constituencies and five regions. The five electoral regions are: Mid and West Wales, North Wales, South Wales Central, South Wales East, and South Wales West, with the forty constituencies listed below. Voting last took place in all districts in the 2021 Senedd election, and is not used for local government.
There are four types of elections in Wales: elections to the House of Commons of the United Kingdom, elections to the devolved Senedd, local elections to community councils and the 22 principal areas, and the police and crime commissioner elections. In addition there are by-elections for each aforementioned election. Elections are held on Election Day, which is conventionally a Thursday. Three of these four types of elections are held after fixed periods; the exception is UK general elections, the timing of which is at the discretion of the prime minister of the United Kingdom. Senedd elections may be postponed to avoid elections to the UK parliament and Senedd coinciding with each other.
Welsh law is an autonomous part of the English law system composed of legislation made by the Senedd. Wales is part of the legal jurisdiction of England and Wales, one of the three legal jurisdictions of the United Kingdom. However, due to devolution, the law in Wales is increasingly distinct from the law in England, since the Senedd, the devolved parliament of Wales, can legislate on non-reserved matters.
The Counsel General for Wales is the Welsh Government's Law Officer, which means the government's chief legal adviser and representative in the courts. In addition to these "lawyer" roles the Counsel General also works to uphold the rule of law and integrity of the legal community in Wales, and has a number of important specific statutory functions, some of which are to be exercised independently of government and in the public interest.
The Senedd Commission is the corporate body for the Senedd of Wales. The commission is responsible for ensuring the property, staff and services are provided for the Senedd. The commission consists of the Llywydd of the Senedd and four members from different political parties, who each have different portfolios of work. The commission is supported by staff in the Commission and Support Service. Prior to 2020, the body was known as the National Assembly for Wales Commission.
The Welsh Archaeological Trusts were the four archaeological organisations covering Wales, from their establishment in the mid-1970s until their merger into a single archaelogical organisation, Heneb, in 2024.
The Auditor General for Wales is the public official in charge of the Audit Wales, formerly known as the Welsh Audit Office, the body responsible for auditing the Welsh Government, its public bodies, National Health Service bodies and local government in Wales. The Auditor General for Wales is responsible for auditing £20 billion of taxpayers' money each year.
The National Assembly for Wales Order 2007, also known as the "Conduct Order" is a Legislative Competence Order and amendment of the National Assembly for Wales Order which made provision for the conduct of elections and the return of members to the National Assembly for Wales. It was put in place by the Secretary of State for Wales in 2007. In 2017, the enabling powers for the Order were devolved to the Welsh Government. The Welsh Government has further amended the order since.
An Act of Senedd Cymru, or informally an Act of the Senedd, is primary legislation that can be made by the Senedd under part 4 of the Government of Wales Act 2006. Prior to 6 May 2020 any legislation was formally known as an Act of the National Assembly for Wales or informally, an Act of the Assembly.
The auditor-general of New South Wales helps the Parliament of New South Wales hold government accountable for its use of public resources.
Welsh devolution is the transfer of legislative powers for self-governance to Wales by the Parliament of the United Kingdom. The current system of devolution began following the enactment of the Government of Wales Act 1998, with the responsibility of various devolved powers granted to the Welsh Government rather than being the responsibility of the Government of the United Kingdom.
The Northern Ireland Audit Office is an independent public body which was established by the Parliament of the United Kingdom on 18 March 1987. It has overall responsibility for auditing on behalf of the Comptroller and Auditor General for Northern Ireland, across all sectors of government in Northern Ireland, except those reserved to the UK government.
A Welsh statutory instrument is subordinate legislation made by the Welsh Ministers, as well as subordinate legislation made by public bodies using powers provided to be exercisable by Welsh statutory instrument. WSIs are the main form of subordinate legislation in Wales, being used by default to exercise powers delegated to the Welsh Ministers, the Counsel General, and the King-in-Council.
