Employees' State Insurance Corporation (abbreviated as ESIC) is one of the two main statutory social security bodies under the ownership of Ministry of Labour and Employment, Government of India, the other being the Employees' Provident Fund Organisation. The fund is managed by the Employees' State Insurance Corporation (ESIC) according to rules and regulations stipulated in the ESI Act 1948.

Administratively, the organisation is divided into zones that are headed by Zonal Insurance Commissioner. At present, there are Five Zones across India. The states have one Regional Offices (RO) which is generally headed by an additional commissioner or Director Rank officer; the Regional Offices are sub-divided into Sub-Regional offices (SRO) consisting several districts, SROs are headed by Director or Joint Director Rank officers. To assist Regional Directors, there are Deputy Directors, heading various units/ branches and looking after the enforcement of the Act and Schemes. Many district offices have an Assistant Director or a Social Security Officer,SSO to implement the scheme and to attend grievances.

The total sanctioned manpower of the ESIC is at present more than 21,000 including all levels. The Deputy Directors are recruited directly, competitively, through the Union Public Service Commission of India as well as through promotion from lower ranks. Subordinate Officers are also recruited directly by ESIC in addition to promotion from the staff cadres.

History

In March 1943, B.P. Adarkar was appointed by the Government of India to create a report on the health insurance scheme for industrial workers. [2] The report became the basis for the Employment State Insurance (ESI) Act of 1948. [2] The promulgation of Employees’ State Insurance Act, 1948 envisaged an integrated need-based social insurance scheme that would protect the interest of workers in contingencies such as sickness, maternity, temporary or permanent physical disablement, death due to employment injury resulting in loss of wages or earning capacity. The Act also guarantees reasonably good medical care to workers and their immediate dependents. Following the promulgation of the ESI Act the Central Govt. set up the ESI Corporation to administer the Scheme. The Scheme thereafter was first implemented at Kanpur and Delhi on 24 February 1952. The Act further absolved the employers of their obligations under the Maternity Benefit Act, 1961 and Workmen's Compensation Act 1923. The benefits provided to the employees under the Act are also in conformity with ILO conventions. [3] :1

The act was initially intended for factory workers but later became applicable to all establishments having 10 or more workers. As of 31 March 2016, the total beneficiaries are 82.8 million. [4] :13 [5] ..

ESI Act

Employees' State Insurance Corporation (ESIC), established by ESI Act, is an autonomous corporation under Ministry of Labour and Employment, Government of India. As it is a legal entity, the corporation can raise loans and take measures for discharging such loans with the prior sanction of the central government and it can acquire both movable and immovable property and all incomes from the property shall vest with the corporation. [6] The corporation can set up hospitals either independently or in collaboration with state government or other private entities, but most of the dispensaries and hospitals are run by concerned state governments.The ESIC has its offices throughout the country with Jurisdiction further dividing into Regional Offices(ROs) & Sub- Regional Offices(SROs).

Benefits

As per the section 46 of the ESI Act, 1948, six benefits [7] are envisaged to its subscribers.

5- Dependants benefit

6- funeral expenses

For all employees earning 21,000 (US$260) or less per month as wages, the employer contributes 3.25% and the employee contributes 0.75%, total share 4%. This fund is managed by the ESI Corporation (ESIC) according to rules and regulations stipulated there in the ESI Act 1948, which oversees the provision of medical and cash benefits to the employees and their family. ESI scheme is a type of social security scheme for employees in the organised sector.

The employees registered under the scheme are entitled to medical treatment for themselves and their dependents, unemployment cash benefit in certain contingencies and maternity benefit in case of women employees. In case of employment-related disablement or death, there is provision for a disablement benefit and a family pension respectively. [3] :67 Outpatient medical facilities are available in 1418 ESI dispensaries and through 1,678 registered medical practitioners. Inpatient care is available in 145 ESI hospitals and 42 hospital annexes with a total of 19,387 beds. In addition, several state government hospitals also have beds for the exclusive use of ESI Beneficiaries. Cash benefits can be availed in any of 830 ESI centres throughout India. [4] :13,16

Recent years have seen an increasing role of information technology in ESI, with the introduction of Pehchan smart cards as a part of Project Panchdeep. [4] :8 [8] In addition to insured workers, poor families eligible under the Rashtriya Swasthya Bima Yojana can also avail facilities in ESI hospitals and dispensaries. ESI Corporation also runs medical, nursing and paramedical schools in some ESI hospitals across India.

Medical and dental colleges

Employees' State Insurance Corporation runs medical, dental, nursing and paramedical schools in many locations across India. [9] Presently, there are 11 medical colleges and 2 dental colleges established by the ESI Corporation. These colleges admit students on the basis of marks obtained in the competitive examinations conducted at the central level, the National Eligibility cum Entrance Test (NEET-UG).

There are 8 Medical Colleges managed by the Ministry of Labour and Employment, Government of India under the ESI Corporation. They are :

  3. ESIC Medical College and PGIMSR, Joka, Kolkata, West Bengal
  4. ESIC Medical College and PGIMSR, Faridabad, Haryana
  5. ESIC Medical College and PGIMSR, Sanath Nagar, Hyderabad , Telangana
  6. ESIC Medical College and PGIMSR, Kalaburagi, Karnataka
  7. ESIC Medical College and Hospital, Alwar, Rajasthan
  8. ESIC Medical College and Hospital, Bihta, Patna, Bihar

The administration of the remaining 3 medical colleges have been handed over to the respective State Governments under various MoU. They were established by the ESI Corporation but are managed by the state government since inception. They are:

  2. ESIC Dental College, Kalaburagi, Karnataka.

The Government of India plans to construct 12 more ESI Medical Colleges in various cities across India in the upcoming years. [11]

New Amendment

The Employees’ State Insurance Corporation (ESIC) raised the monthly wage limit to Rs. 21,000 from the existing Rs. 15,000, for coverage with effect from 1 January 2017. The rate of contribution was reduced from 6.5% to 4% ( employer's share 3.25% and employee's share 0.75%) [12] effective from 1 July 2019.

<span class="mw-page-title-main">Employees' Provident Fund Organisation</span> Organization of Government of India

The Employees' Provident Fund Organisation (EPFO) is one of the two main social security organization under the Government of India's Ministry of Labour and Employment and is responsible for regulation and management of provident funds in India, the other being Employees' State Insurance. The EPFO administers the mandatory provident fund, a basic pension scheme and a disability/death insurance scheme. It also manages social security agreements with other countries. International workers are covered under EPFO plans in countries where bilateral agreements have been signed. As of May 2021, 19 such agreements are in place. The EPFO's top decision-making body is the Central Board of Trustees (CBT), a statutory body established by the Employees' Provident Fund and Miscellaneous Provisions (EPF&MP) Act, 1952. As of 2021, more than 15.6 lakh crore are under EPFO management.

In China, the practice of medicine is a mixture of government, charitable, and private institutions, while many people rely on traditional medicine. Until reforms in the late twentieth and early twenty-first century, physicians were quasi-government employees and with little freedom in the choice of the hospital to work with. Insurance in India covers both the public and private sector organisations. It is listed in the Constitution of India in the Seventh Schedule as a Union List subject, meaning it can only be legislated by the Central Government only.

Social security in India includes a variety of statutory insurances and social grant schemes bundled into a formerly complex and fragmented system run by the Indian government at the federal and the state level. The Directive Principles of State Policy, enshrined in Part IV of the Indian Constitution reflects that India is a welfare state. Food security to all Indians are guaranteed under the National Food Security Act, 2013 where the government provides highly subsidised food grains or a food security allowance to economically vulnerable people. The system has since been universalised with the passing of The Code on Social Security, 2020. These cover most of the Indian population with social protection in various situations in their lives.

Indian labour law refers to law regulating labour in India. Traditionally, the Indian government at the federal and state levels has sought to ensure a high degree of protection for workers, but in practice, this differs due to the form of government and because labour is a subject in the concurrent list of the Indian Constitution. The Minimum Wages Act 1948 requires companies to pay the minimum wage set by the government alongside limiting working weeks to 40 hours. Overtime is strongly discouraged with the premium on overtime being 100% of the total wage. The Payment of Wages Act 1936 mandates the payment of wages on time on the last working day of every month via bank transfer or postal service. The Factories Act 1948 and the Shops and Establishment Act 1960 mandate 15 working days of fully paid vacation leave and 7 casual leaves each year to each employee, with an additional 7 fully paid sick days. The Maternity Benefit (Amendment) Act, 2017 gives female employees of every company the right to take 6 months' worth of fully paid maternity leave. It also provides for 6 weeks worth of paid leaves in case of miscarriage or medical termination of pregnancy. The Employees' Provident Fund Organisation and the Employees' State Insurance, governed by statutory acts provide workers with necessary social security for retirement benefits and medical and unemployment benefits respectively. Workers entitled to be covered under the Employees' State Insurance are also entitled to 90 days worth of paid medical leaves. A contract of employment can always provide for more rights than the statutory minimum set rights. The Indian parliament passed four labour codes in the 2019 and 2020 sessions. These four codes will consolidate 44 existing labour laws. The Maternity (Amendment) Bill 2017, an amendment to the Maternity Benefit Act, 1961, was passed in Rajya Sabha on 11 August 2016, in Lok Sabha on 9 March 2017, and received an assent from President of India on 27 March 2017. The Maternity Benefit Act, 1961 protects the employment of women during the time of her maternity and entitles her of a 'maternity benefit' – i.e. full paid absence from work – to take care for her child. The Act is applicable to all establishments employing 10 or more than 10 persons in Factories, Mines, Plantation, Shops & Establishments and other entities. Establishments employing 50 or more employees are also required to provide crèche facilities, either separately or along with common facilities within a prescribed distance.

It was established in 2015 under the aegis of the ESI Corporation, a central autonomous body under Ministry of Labour and Employment, Government of India. Faridabad is a part of the National Capital Region, India (NCR) adjoining Delhi, the Capital City of India. It is affiliated to Pandit Bhagwat Dayal Sharma University of Health Sciences, Rohtak. The college is attached to a 1150-bedded multi-speciality hospital which was built in 2013 but became operational in 2014. The campus is spread in over 30 acres and provide primary and tertiary healthcare facilities to the workers insured under the ESI corporation and is one of the tertiary care referral center for smaller ESI clinic and dispensaries.

Government Medical College & ESI Hospital, Coimbatore, is a Government co-educational Medical College located at Varadharajapuram, Singanallur, Coimbatore. It was established in 2016 under the aegis of the ESI Corporation, a central autonomous body under Ministry of Labour and Employment, Government of India. The college is attached to a 510-bedded Multi-Speciality Hospital which was built in 2016. During the Covid pandemic, the hospital was the first referral centre for Coimbatore and neighboring districts and was the chief covid treatment centre that treated patients following which the number of beds were increased to 1000. It is also the only govt college in Tamil Nadu where all the wings of AYUSH are functional.

TheAtal Beemit Vyakti Kalyan Yojana (ABVKY) is a government welfare scheme initiated by the Central Government of India. Originally introduced as a pilot project for a duration of two years, the primary objective of the scheme is to provide financial support to individuals facing unemployment during the COVID-19 pandemic. The scheme's duration was later extended until June 30, 2022.

ESIC Medical College, Patna, also known by its full name Employees State Insurance Corporation Medical College, Bihar, is a NMC recognised medical college, established in 2021 under the aegis of the ESI Corporation, a centrally controlled autonomous body. This college is located at Bihta.

Employees State Insurance Scheme Hospital is an E S I Hospital for employees of companies, located at Ayanavaram neighbourhood in Chennai of Tamil Nadu in the peninsular India. Employees with a monthly salary less than ₹15,000 are eligible for treatments in ESIS Hospitals. This is one of the two hospitals in Chennai, the other being in K. K. Nagar.
