Freedom of religion in Mauritania is limited by the Government. The constitution establishes the country as an Islamic republic and decrees that Islam is the religion of its citizens and the State.
Non-Muslim resident expatriates and a few non-Muslim citizens practice their religion openly with certain limitations on proselytization and transmission of religious materials.
Relations between the Muslim community and the small non-Muslim community are generally amicable.
Officially, 100% of Mauritanian citizens are Muslim. [1] In reality, 99.1% are Sunni Muslims, although there are a few non-Muslims (approximately 0.9%). [2] Roman Catholic and non-denominational Christian churches have been established in Nouakchott, Atar, Zouerate, Nouadhibou and Rosso, but are not open to local citizens. A number of expatriates practice Judaism but there are no synagogues.
Islam is generally considered to be the essential cohesive element unifying the country's various ethnic groups and castes. There is a cabinet-level Ministry of Culture and Islamic Orientation and a High Council of Islam, consisting of six imams, which, at the Government's request, advises on the conformance of legislation to Islamic precepts.
Mosques and Qur'anic schools are funded privately by their members and other donors. One exception is a small stipend to the imam of the Central Mosque in the capital city of Nouakchott provided by the government.
The Government does not register religious groups; however, secular NGOs, inclusive of humanitarian and development NGO's affiliated with religious groups, must register with the Ministry of the Interior.
Nonprofit organizations, including both religious groups and secular NGO's, generally are not subject to taxation.
The judiciary consists of a single system of courts with a legal system that conforms with the principles of Shari'a (Islamic law).
The Government observes Muslim holidays as national holidays. A magistrate of Shari'a, who heads a separate government commission, decides the dates for observing religious holidays and addresses the nation on these holidays.
There is no religious oath required of government employees or members of the ruling political party, except for the President and the members of the 5-person Constitutional Council and the 10-person High Council of Magistrates presided over by the President. The Constitutional Council and the High Council of Magistrates advise the President in matters of law and the Constitution. The oath of office includes a promise to God to uphold the law of the land in conformity with Islamic precepts.
All schools except international schools are required to provide four hours of Islam education every week. Students completing the Baccalaureate exam must complete religious education in Arabic.
There are several foreign faith-based nongovernmental organizations (NGOs) active in humanitarian and developmental work in the country. New laws in 2021 make it easier for faith-based NGOs to register and operate, but they are not allowed to proselytise or promote non-Islamic religions. [3]
In April 2018, the National Assembly passed a law making the death penalty mandatory for "blasphemy". [4] This follows laws which give the death penalty for adultery and homosexual activity, although these penalties have not been used since the 1980s. [5]
Although there is no specific legal prohibition against proselytizing by non-Muslims, in practice the Government prohibits proselytizing by non-Muslims through the use of Article 11 of the Press Act, which bans the publication of any material that is against Islam or contradicts or otherwise threatens Islam. The Government views any attempts by practitioners of other religions to convert Muslims as undermining society. Foreign faith-based NGO's limit their activities to humanitarian and development assistance. In June 2009 American aid worker Chris Leggett was murdered for allegedly proselytizing, according to the Barnabas Fund.
Under Article 11 of the Press Law, the Government may restrict the importation, printing, or public distribution of Bibles or other non-Islamic religious literature, and in practice Bibles are neither printed nor publicly sold in the country. However, the possession of Bibles and other non-Islamic religious materials in private homes is legal. [6]
Shari'a provides the legal principles upon which the law and legal procedure are based. Mauritania follows the Maliki madhab, which has certain unique laws not applicable to other madhabs.
In 2022 Freedom House rated Mauritanian religious freedom as 2 out of 4, [7] noting that while apostasy is a crime punishable by death, to date, no one has been executed for the crime. However, in April 2018, parliament passed a new law that strengthens the existing death penalty punishment for certain blasphemy offenses.
Freedom of religion in Pakistan is formally guaranteed by the Constitution of Pakistan for individuals of various religions and religious sects.
The 2019 transitional constitution of Sudan guarantees freedom of religion and omits reference to sharia as a source of law, unlike the 2005 constitution of Sudan's deposed president Omar al-Bashir whose government had criminalized apostasy and blasphemy against Islam. Bashir's government had also targeted Shia Muslims and those engaging in proselytization to faiths other than Islam. Christians had also faced restrictions in matters of religious freedom.
The Kingdom of Saudi Arabia is an Islamic absolute monarchy in which Sunni Islam is the official state religion based on firm Sharia law. Non-Muslims must practice their religion in private and are vulnerable to discrimination and arrest. While no law requires all citizens to be Muslim, non-Muslim foreigners attempting to acquire Saudi Arabian nationality must convert to Islam. Children born to Muslim fathers are by law deemed Muslim.
Freedom of religion in Comoros is addressed in the constitution which proclaims equality of rights and obligations for everyone.
Nepal is a secular state under the Constitution of Nepal 2015, where "secular" means religious, cultural freedoms, including protection of religion and culture handed down from time immemorial.
The constitution of Brunei states that while the official religion is the Shafi'i school of Sunni Islam, all other religions may be practiced "in peace and harmony." Apostasy and blasphemy are legally punishable by corporal and capital punishment, including stoning to death, amputation of hands or feet, or caning. Only caning has been used since 1957.
The Constitution of Bahrain states that Islam is the official religion and that Shari'a is a principal source for legislation. Article 22 of the Constitution provides for freedom of conscience, the inviolability of worship, and the freedom to perform religious rites and hold religious parades and meetings, in accordance with the customs observed in the country; however, the Government has placed some limitations on the exercise of this right.
The Constitution provides for the freedom to practice the rights of one's religion and faith in accordance with the customs that are observed in the kingdom, unless they violate public order or morality. The state religion is Islam. The Government prohibits conversion from Islam and proselytization of Muslims.
The Constitution of Kuwait provides for religious freedom. The constitution of Kuwait provides for absolute freedom of belief and for freedom of religious practice. The constitution stated that Islam is the state religion and that Sharia is a source of legislation. In general, citizens were open and tolerant of other religious groups. Regional events contributed to increased sectarian tensions between Sunnis and Shia.
The Basic Law, in accordance with tradition, declares that Islam is the state religion and that Shari'a is the source of legislation. It also prohibits discrimination based on religion and provides for the freedom to practice religious rites as long as doing so does not disrupt public order. The government generally respected this right, but within defined parameters that placed limitations on the right in practice. While the government continued to protect the free practice of religion in general, it formalized previously unwritten prohibitions on religious gatherings in locations other than government-approved houses of worship, and on non-Islamic institutions issuing publications within their communities, without prior approval from the Ministry of Endowments and Religious Affairs (MERA). There were no reports of societal abuses or discrimination based on religious belief or practice.
In Qatar, the Constitution, as well as certain laws, provide for freedom of association, public assembly, and worship in accordance with the requirements of public order and morality. Notwithstanding this, the law prohibits proselytizing by non-Muslims and places some restrictions on public worship. Islam is the state religion.
The Constitution of Yemen provides for freedom of religion, and the Government generally respected this right in practice; however, there were some restrictions. The Constitution declares that Islam is the state religion, and that Shari'a is the source of all legislation. Government policy continued to contribute to the generally free practice of religion; however, there were some restrictions. Muslims and followers of religious groups other than Islam are free to worship according to their beliefs, but the Government prohibits conversion from Islam and the proselytization of Muslims. Although relations among religious groups continued to contribute to religious freedom, there were some reports of societal abuses and discrimination based on religious belief or practice. There were isolated attacks on Jews and some prominent Zaydi Muslims felt targeted by government entities for their religious affiliation. Government military reengagement in the Saada governorate caused political, tribal, and religious tensions to reemerge in January 2007, following the third military clash with rebels associated with the al-Houthi family, who adhere to the Zaydi school of Shi'a Islam.
Human rights in Mauritania are generally seen as poor according to international observers, including Freedom House, the United States Department of State, and Amnesty International.
The people of Mauritania are overwhelmingly adherents of Sunni Islam, of the Maliki school of jurisprudence.
Mohamed Cheikh Ould Mkhaitir is a Mauritanian blogger who was a political prisoner from 2014 to 2019. He was sentenced to death after he wrote an article critical of Islam and the caste system in Mauritania, after which he became a designated prisoner of conscience by Amnesty International. He now lives in exile in France due to concerns for his safety.
Capital punishment for offenses is allowed by law in some countries. Such offenses include adultery, apostasy, blasphemy, corruption, drug trafficking, espionage, fraud, homosexuality and sodomy, perjury, prostitution, sorcery and witchcraft, theft, and treason.

The situation for apostates from Islam varies markedly between Muslim-minority and Muslim-majority regions. In Muslim-minority countries, "any violence against those who abandon Islam is already illegal". But in some Muslim-majority countries, religious violence is "institutionalised", and "hundreds and thousands of closet apostates" live in fear of violence and are compelled to live lives of "extreme duplicity and mental stress."
