1 On 26 April 1994, North Metropolitan Liberal MLC Bob Pike died. Liberal candidate Iain MacLean was elected in the resultant countback on 31 May 1994.
2 On 28 February 1995, East Metropolitan Labor MLC Tom Butler resigned. Labor candidate Valma Ferguson was elected in the resultant countback on 4 April 1995.
3 In April 1996, North Metropolitan MLC Sam Piantadosi left the Labor Party and sat as an independent. He resigned on 19 November 1996 to contest the seat of Yokine at the 1996 election. Labor candidate Ed Dermer, who had already won the seat effective from May 1997 at the aforementioned election, was elected at the resulted countback on 24 December 1996.
4 On 19 November 1996, North Metropolitan Liberal MLC Iain MacLean resigned to contest the seat of Wanneroo at the 1996 election. Liberal candidate Alan Carstairs was elected to the subsequent vacancy in a countback on 24 December 1996.
5 On 21 November 1996, East Metropolitan Labor MLC Alannah MacTiernan resigned to contest the seat of Armadale at the 1996 election. Labor member Paul Sulc was elected to the subsequent vacancy in a countback on 24 December 1996.

Half of the state senators had been elected at the March 1990 election and had terms due to finish on 30 June 1996; the other half of the state senators were elected at the March 1993 election and had terms due to finish on 30 June 1999. The territory senators were elected at the March 1993 election and their terms ended at the next federal election, which was March 1996.

The Council consisted of 42 members, 6 elected in 1988, 15 elected in 1991 and 21 elected in 1995. As members serve eight-year terms, half of the Council did not face re-election in 1995, and the members elected in 1995 did not face re-election until 2003. The President was Max Willis until 29 June 1998 and then Virginia Chadwick.

The 14 members who had been indirectly elected in 1976 served an eight-year term and did not face re-election until 1984, the 15 members elected in 1978 did not face re-election until 1988, while the 15 members elected in 1981 did not face re-election until 1992. The President was Johno Johnson.

This was the first membership of the Council to be elected under the multi-member electorate system established by the Acts Amendment Act 1987 where members were selected by proportional representation within six regions.

The chamber had 30 seats made up of ten provinces each electing three members, on a system of rotation whereby one-third of the members would retire at each biennial election. Prior to the 1910 election, the Council had thought of itself as entirely independent from party politics, but with the election of Labor members to the Council and Labor's vigorous campaign at the 1911 election for the Legislative Assembly, many of its members joined the newly formed Liberal Party which had emerged from the various National Political Leagues and Liberal Leagues.
