Texas District Courts

The Texas District Courts form part of the Texas judicial system and are the trial courts of general jurisdiction of Texas. As of January 2019, 472 district courts serve the state, each with a single judge, elected by partisan election to a four-year term. [1]

District courts have original jurisdiction in all felony criminal cases, divorce cases, land title disputes, election contests, civil matters in which at least $200 is disputed or claimed in damages, as well as other matters. Most district courts consider both criminal and civil cases but, in counties with many courts, each may specialize in civil, criminal, juvenile, or family law matters. [2]

The Texas tradition of one judge per district court is descended from what was the dominant form of American state trial court organization for much of the 19th century, which Texas wrote into its state constitution. [3] Although the relevant constitutional clause was amended in 1985 to no longer require one judge per court, [4] the tradition had become thoroughly entrenched.

Districts can cover a single county or several counties, with many districts overlapping one another. Harris County, the state's most populous, is home to 60 district courts - each one covering the entire county. While district courts can exercise concurrent jurisdiction over an entire county, and they can and do share courthouses and clerks to save money (as allowed under an 1890 Texas Supreme Court case), each is still legally constituted as a separate court. [3] This is dramatically different from the situation in most U.S. states (or most other jurisdictions), in which a single trial court is staffed by multiple judges, each of whom has authority to act in the name of that court. [5]

In sparsely populated areas, a single district can cover numerous counties: several districts span five counties, for example. Some counties share numerous overlapping districts, such as the 12 districts that serve the same 13 county region of central and eastern Texas, with each district covering the entirety of the 13 counties. [5]

On June 9, 2023, Texas' governor signed an Act into law creating a trial level business court, as well as the first appellate level business court in the United States. The new law became effective in September 2023. [6] [7] [8] On June 28, 2024, the Texas Supreme Court approved rules of procedure for the new Business Court. [9] In June 2024, the Governor began appointing Business Court Division judges. [10] [11] [12] [13] [14] In August 2024, the Texas Supreme Court rejected a constitutional challenge to the appellate business court's creation. [15] The trial and appellate business courts will be open for cases on September 1, 2024. [16] This new court is a separate statutory court, and not a division of the district court. Thus, it will remove some types of cases from the dockets of the district courts where the new business court is operational.

It is vested with unlimited civil and criminal jurisdiction, although in many counties outside New York City it acts primarily as a court of civil jurisdiction, with most criminal matters handled in County Court.

The United States is a federation; consequently, the government of Maryland, like the other 49 state governments, has exclusive authority over matters that lie entirely within the state's borders, except as limited by the Constitution of the United States.

The structure of the judiciary of Texas is laid out in Article 5 of the Constitution of Texas and is further defined by statute, in particular the Texas Government Code and Texas Probate Code. The structure is complex, featuring many layers of courts, numerous instances of overlapping jurisdiction, several differences between counties, as well as an unusual bifurcated appellate system at the top level found in only one other state: Oklahoma. Municipal Courts are the most active courts, with County Courts and District Courts handling most other cases and often sharing the same courthouse.

The Supreme Court of Texas is the court of last resort for civil matters in the U.S. state of Texas. A different court, the Texas Court of Criminal Appeals, is the court of last resort in criminal matters.

The Superior Court is the state court in the U.S. state of New Jersey, with statewide trial and appellate jurisdiction. The New Jersey Constitution of 1947 establishes the power of the New Jersey courts: under Article Six of the State Constitution, "judicial power shall be vested in a Supreme Court, a Superior Court, and other courts of limited jurisdiction." The Superior Court has three divisions: the Law Division which is the main trial court for cases of civil or criminal law, the Chancery Division, which tries equity law cases, and the Appellate Division, which is the intermediate appellate court in New Jersey. "Appeals may be taken to the Appellate Division of the Superior Court from the law and chancery divisions of the Superior Court and in such other causes as may be provided by law." Each division of the Superior Court is divided into various Parts."

The Texas Courts of Appeals are part of the Texas judicial system. In Texas, all cases appealed from district and county courts, criminal and civil, go to one of the fourteen intermediate courts of appeals, with one exception: death penalty cases. The latter are taken directly to the Texas Court of Criminal Appeals, the court of last resort for criminal matters in the State of Texas. The highest court for civil and juvenile matters is the Texas Supreme Court. While the Supreme Court (SCOTX) and the Court of Criminal Appeals (CCA) each have nine members per the Texas Constitution, the sizes of the intermediate courts of appeals are set by statute and vary greatly, depending on historical case filings and so that the justices on each court can timely adjudicate the volume of cases regularly before them. The total number of intermediate appellate court seats currently stands at 80, ranging from three, four, six, seven, nine, and thirteen (Dallas) per court.

The Oklahoma Court System is the judicial system for the U.S. State of Oklahoma. Based in Oklahoma City, the court system is a unified state court system that functions under the Chief Justice of Oklahoma who is its administrator-in-chief.

The First Judicial District is the judicial body governing the county of Philadelphia, Pennsylvania, United States. It consists of the Court of Common Pleas of Philadelphia County and the Philadelphia Municipal Court.

The Maine Superior Court is the trial court of general jurisdiction in the Maine state court system.

The Unified Judicial System of Pennsylvania is the unified state court system of the Commonwealth of Pennsylvania.

The Superior Court is North Carolina's general jurisdiction trial court. It was established in 1777 and is North Carolina's oldest court.

Business courts, sometimes referred to as commercial courts, are specialized courts for legal cases involving commercial law, internal business disputes, and other matters affecting businesses. In the US, they are trial courts that primarily or exclusively adjudicate internal business disputes and/or commercial litigation between businesses, heard before specialist judges assigned to these courts. Commercial courts outside the United States may have broader or narrower jurisdiction than state trial level business and commercial courts within the United States, for example patent or admiralty jurisdiction; and jurisdiction may vary between countries. Business courts may be further specialized, as in those that decide technology disputes and those that weigh appeals. Alternative dispute resolution and arbitration have connections to business courts.

The Judiciary of California or the Judicial Branch of California is defined under the California Constitution as holding the judicial power of the state of California which is vested in the Supreme Court, the Courts of Appeal and the Superior Courts. The judiciary has a hierarchical structure with the California Supreme Court at the top, California Courts of Appeal as the primary appellate courts, and the California Superior Courts as the primary trial courts.

The judiciary of Massachusetts is the branch of the government of Massachusetts that interprets and applies the law of Massachusetts, ensures equal justice under law, and provides a mechanism for dispute resolution. The judicial power in Massachusetts is reposed in the Supreme Judicial Court, which superintends the entire system of courts.

The Florida State Courts System is the unified state court system of Florida.
