Traditional leadership of Namibia is a governing structure in Namibia based on the ethnicity of the indigenous people of the territory. Acceptance of a traditional authority is vested in the Government of Namibia, executed by the minister of Urban and Rural Development. There are 51 recognised traditional authorities and a further 40 pending applications. [1]
Traditional authorities cover the entire Namibian territory. For a traditional authority to be recognised by government it must have a sole area of jurisdiction; although virtually all places in Namibia are inhabited by members of different clans and tribes, the area of the settlements are deemed to belong to only one traditional authority. For a traditional leader to be accepted by government, they must be appointed according to the customary law of their clan, without major disputes about their current reign. [2]
Leaders and their administrative staff are not paid by the state. Instead the traditional group's members are expected to sustain their leadership. Government did, however, give one car each to the recognised authorities, and awards allowances for fuel and administrative work. The parallel existence of traditional authorities and the Namibian government in Namibia is controversial. [1] The traditional rulers and leaders are represented through the Council of Traditional Leaders, established by Act 13 of 1997 (GG 1706) and amended by Act 31 of 2000 (GG 2462). [3]
Traditional leaders are entrusted with the allocation of communal land and the formulation of the traditional group's customary laws. [1]
They also take over judicial work through traditional courts, offering a way to access compensation through civil law that does not require fees or lawyers. Crime in Namibia is treated by the classical courts solely as a criminal procedure, and ends in punishment of the offender; To seek material compensation a civil case has to be opened after the criminal verdict. Traditional fines are thus, in the words of justice minister Yvonne Dausab, meant "to wipe off tears", and not to replace criminal proceedings. [4]
Typical punishments are in money or in livestock. For instance, the traditional courts of the Ovambo people in Namibia's north fine ten cows or 15,000N$ for murder, two cows or 3,000N$ for impregnating a child, and up to six cows for theft, depending on severity. The traditional court of the Oorlam people at Vaalgras in Namibia's south, where there are few communal cattle farmers, fines three goats for theft. [4]
In the traditional Lozi system, the king and judges appointed by him heard cases of murder. A person found guilty of killing another without just cause was sentenced to death by the king and subsequently executed. However, if the convict sought refuge in the house of Katamoyo (Mother of Life), a challenging feat, the sentence was not carried out. [5]

Politics of Namibia takes place in a framework of a semi-presidential representative democratic republic, whereby the President of Namibia is both head of state and head of government, and of a pluriform multi-party system. Executive power is exercised by both the president and the government. Legislative power is vested in the two chambers of Parliament. The judiciary is independent of the executive and the legislature.
South West Africa, renamed to Namibia from 12 June 1968, was an occupied part of the Union of South Africa and later the Republic of South Africa from 1915 to 1990, after which it became modern-day Namibia. It bordered Angola, Botswana, South Africa, and Zambia. During its administration, South Africa applied its own apartheid system in the territory of South West Africa.
Khoekhoe are the traditionally nomadic pastoralist indigenous population of South Africa. They are often grouped with the hunter-gatherer San peoples. The designation "Khoekhoe" is actually a kare or praise address, not an ethnic endonym, but it has been used in the literature as an ethnic term for Khoe-speaking peoples of Southern Africa, particularly pastoralist groups, such as the Griqua, Gona, Nama, Khoemana and Damara nations. The Khoekhoe were once known as Hottentots, a term now considered offensive.
The Damara, plural Damaran are an ethnic group who make up 8.5% of Namibia's population. They speak the Khoekhoe language and the majority live in the northwestern regions of Namibia, however they are also found widely across the rest of the country.
Nama are an African ethnic group of South Africa, Namibia and Botswana. They traditionally speak the Nama language of the Khoe-Kwadi language family, although many Nama also speak Afrikaans. The Nama People are the largest group of the Khoikhoi people, most of whom have disappeared as a group, except for the Namas. Many of the Nama clans live in Central Namibia and the other smaller groups live in Namaqualand, which today straddles the Namibian border with South Africa.
Rehoboth is a town in central Namibia just north of the Tropic of Capricorn. Located 90 kilometres south of the Namibian capital Windhoek, Rehoboth lies on a high elevation plateau with several natural hot-water springs. It receives sparse mean annual rainfall of 240 millimetres (9.4 in), although in the 2010/2011 rainy season a record 731 millimetres (28.8 in) were measured. In 2005, it had a population of 21,378 later increased to 28,843 in 2011, according to the 2011 Namibian Population and Housing Census. In 2023, it had increased further to 40,788 people.
Berseba is a village in the ǁKaras Region of southern Namibia and the district capital of the Berseba electoral constituency. It is situated 100 km (62 mi) north-west of Keetmanshoop near the Brukkaros Mountain, a famous tourist destination.
Reverend Dr Kaptein Hendrik Witbooi was a Namibian politician and the seventh Captain of the ǀKhowesin clan. A member of SWAPO from 1976 until his death, Witbooi brought with him several clans of Namaqua into the liberation organisation.
Reverend Markus Kooper was a Namibian activist, educator and religious figure. From Hoachanas in the Hardap Region, Kooper was one of the first Namibians who travelled to the United Nations to petition for his country's independence from apartheid South Africa. He is buried at the National Heroes Acre memorial cemetery outside of Windhoek.
Hoachanas is a settlement of 3,000 inhabitants in the Hardap Region of southern central Namibia, located 55 kilometres (34 mi) northeast of Kalkrand. It is situated at the junction of the main road C21 from Kalkrand, and C15 from Dordabis to Stampriet and belongs to the Mariental Rural electoral constituency.
Gochas is a village in the Hardap Region of Namibia. It is located 110 kilometres (68 mi) southeast of Mariental and 64 kilometres (40 mi) southwest of Stampriet on the way to the Mata Mata border post to the Kgalagadi Transfrontier Park. The town lies on the banks of the Auob River 1,150 metres (3,770 ft) above sea level. The area is at the center of a set of Kalahari Desert dune farms on which cattle and sheep graze.
Andreas Lambert, also known as Andries Lambert, was the second Kaptein of the Kaiǀkhauan, a subtribe of the Orlam, in the eastern area of South-West Africa, today's Namibia.
Martha Mwadinomho yaKristian Nelumbu is the Ohamba (Queen) of the Oukwanyama, a dynasty of the Ovambo people in northern Namibia. Queen Mwadinomho was born into the Oukwanyama royal family at Oifidi village in Angola on 7 August 1931. She is of the totem of the cattle. She was crowned in November 2005, succeeding her cousin Kornelius Mwetupunga Shelungu. She is the first woman leader to head this traditional authority.
The Red Nation is the main subtribe of the Nama people in Namibia and the oldest Nama group speaking Khoekhoegowab, the language often called Damara/Nama.
Riemvasmaak is a settlement in ZF Mgcawu District Municipality in the Northern Cape province of South Africa. The name means ‘tighten the strap’ or ‘tied with straps’.
Cornelius Fredericks was a leader of the ǃAman, a subtribe of the Orlam people, in the southern area of German South-West Africa, today's Namibia. He was a rival Kaptein of the Bethanie Orlam, contesting the chieftaincy of Paul Fredericks. Among the Orlam people living in Bethanie, Cornelius had more followers, but Paul was the official leader who also had the support of the German colonial powers.
The Council of Traditional Leaders is a national institution of the government of Namibia where the traditional leadership of Namibia is represented.
