2009 Azerbaijani constitutional referendum

A constitutional referendum was held in Azerbaijan on 18 March 2009. [1] The referendum, initiated by the authoritarian Ilham Aliyev regime, consisted of 29 measures. The most controversial were a measure to abolish presidential term limits, enabling Aliyev to run for president beyond two terms, and a measure to greatly restrict press freedom.

The measures passed, with approval of measures between 87.14% and 91.76%, disapproval between 4.59% and 7.24% and invalid votes between 3.64% and 5.70%; turnout was 71.08%. [2] [3] The referendum was marred by fraud. [4]

This provision of the constitutional amendment was condemned by the Venice Commission of the Council of Europe, which stated that "As a rule, it can be said that the abolition of existing limits preventing the unlimited re-election of a President is a step back, in terms of democratic achievements". [5] [6] Professor Wojciech Sadurski, Challis Professor of Jurisprudence at the Faculty of Law of Sydney University, in his legal opinion stated that the conduct of the Azeri government in the adoption of the amendment violated the principle of transparency and that it constituted a breach of European law under the European Convention on Human Rights as well as the international law. [7] [8] The amendment was also criticized by the Azerbaijani opposition. [9]

On the basis of the amendment in 2013 Ilham Aliyev ran for president for the third time.

He was reelected for a second term in 2008 and was allowed to run in elections indefinitely in 2013 and 2018 due to the 2009 constitutional referendum, which removed term limits for presidents. Throughout his electoral campaign, Aliyev was a member of the ruling New Azerbaijan Party, which he has headed since 2005.

Presidential elections were held in Azerbaijan on 9 October 2013. The result was a victory for incumbent President Ilham Aliyev, who received a reported 84.5% of the vote, whilst leading opposition candidate Jamil Hasanli finished second with a reported 5.5% of the vote.

A constitutional referendum was held in Azerbaijan on 26 September 2016. Voters were asked whether they approved of 29 constitutional amendments, with a separate vote on each one. The title was created by the law "Regulations on the title of "Hero of the Patriotic War" of the Republic of Azerbaijan" dated 26 November 2020 and the decree of the President of Azerbaijan, Ilham Aliyev dated 1 December 2020. It was established on the occasion of Azerbaijan being the victor in the Second Nagorno-Karabakh War. Its recipient is also awarded with the Hero of the Patriotic War Medal.

<span class="mw-page-title-main">2024 Azerbaijani presidential election</span>

Early presidential elections are scheduled to be held in Azerbaijan on 7 February 2024. Originally set for October 2025, President Ilham Aliyev called for a snap election in December 2023 following the previously successful Azerbaijani offensive in Nagorno-Karabakh, which brought an end to the Armenian-led breakaway state Republic of Artsakh and the full accession of the disputed Nagorno-Karabakh region by Azerbaijan. Due to the pretext, the election was unofficially referred as "Victory Election" by the officials and press media. This will be a third snap election for president in Azerbaijan's history, as well as the first presidential election to be held in winter season.
