California Senate Bill 35 (SB 35) is a statute streamlining housing construction in California counties and cities that fail to build enough housing to meet state mandated housing construction requirements, and exempts construction under the law from California Environmental Quality Act review. [1] The bill was introduced to the California State Assembly by State Senator Scott Wiener (D-SF) on December 15, 2016. [2] SB 35 aims to address the California housing shortage by increasing housing supply. The bill was signed into law on September 29, 2017 by Governor Jerry Brown as part of California’s 2017 Housing Package – a set of 15 bills that provide “an injection of new regulatory and financial resources” for cities. Contents

Scott Wiener introduced SB 35 to increase housing supply in cities that are not producing enough housing, [3] by encouraging cities to either increase housing development on their own or be forced to accept housing development. After the bill’s passage, Wiener claimed: “SB 35 will retain local control for those cities that are producing their share of housing, but create a more streamlined path for housing creation in those cities that are blocking housing or ignoring their responsibility to build.” [4]

Provisions

Under existing law, every locality (cities and unincorporated parts of counties) has a housing production goal for low by income level in the Regional Housing Needs Assessments (RHNA). SB 35 requires localities to report their housing production by income level in their annual housing element progress reports (APRs). The units produced is compared to the RHNA targets at the halfway point and end of each cycle. [5] [6] [7] If the locality does not meet its pro-rated RHNA goals, then certain projects can use a streamlined approval process over the next half-cycle.

In order to use the streamlined approval process, the development must:

If the development meets all criteria, localities must approve the project in either (1) 60 days if the development contains less than 150 housing units; or (2) 90 days if the development contains more than 150 units of housing. [9]

Background

California housing costs are among the most unaffordable in the United States. In 2018, the median San Jose home cost 10 times the median household income; Los Angeles homes cost 9.5 times; San Francisco homes cost 8.9 times; San Diego homes cost 8.1 times. [10] California is the most expensive state to rent in, in the United States. [11]

California has had a housing shortage since 1970 and ranks 49th among 50 states for housing units per capita. [12] The problem has worsened following the Great Recession as housing development fell to 40,000 units in 2009 and has not reached pre-recession levels. [13] California needs approximately 180,000 units per year to match current growth. [12] Slow housing development combined with high housing demand has increased housing costs in every city in California.

The state’s high rent prices have translated into increased homelessness, more households spending half their income on housing, and an exodus of low and middle income households leaving to states with lower cost of living. [14] The housing shortage negatively impacts the Economy of California.

Wiener introduced SB 35 to increase housing supply and stabilize or decrease home prices. [13] The bill is part of California's 2017 Housing Package, which are 15 small bills devoted to increasing housing affordability. [13] Supporters hope SB 35 will shorten the permitting process for certain developments. [15]

Housing Element Act of 1969

The Housing Element Act of 1969 mandates all cities construct a specified number of low, middle, and market rate housing. [15] Cities are required to construct their RHNA, which the HCD determines every 8 years. [17] The RHNA determines the amount of low-income, moderate income, and market housing each municipality is expected to construct to meet regional housing needs. However, 97.6% of cities in California do not construct the required number of low-income housing units allocated. [15]

"Local control is about how a community achieves its housing goals, not whether it achieves those goals," Wiener said in a statement. "SB 35 sets clear and reasonable standards to ensure that all communities are part of the solution by creating housing for our growing population." [18]

Local officials, however, often disagree with state officials over what these housing production goals should be. [19]

Opposition

The League of California Cities and many municipal governments opposed SB 35 for imposing state control over local planning rules. [8] City governments opposing SB 35 include: Berkeley, Beverly Hills, Encinitas, Palm Desert, Vallejo, San Luis Obispo, Huntington Beach, and Walnut Creek. [8]

Several cities have pursued court cases to stop SB 35 following its passage. In 2019, Huntington Beach sued the State of California to stop the enforcement of SB 35. The City Attorney for Huntington Beach, Michael Gates, claims SB 35 “unconstitutionally interferes with the city’s authority to enforce local zoning laws.” [20] In 2021, Huntington Beach lost the lawsuit and decided not to appeal. [21]

Impact

Some housing experts believed the impact of SB 35 on overall housing production will be minimal due to the standards required to meet streamlining approval. [6] The bill was expected to increase below-market housing for the lowest income households. [22] As of November 2019, officials had approved more than 6,000 homes under SB 35, including 4,700 in the Bay Area and 1,600 in Southern California. [23] A report in 2023 found that between 2018 and 2021, 156 pending and approved housing projects had resulted from the law with the projects total 18,215 proposed new units, two-thirds of which was affordable housing. [24]

Cities Affected by SB 35

As of 2024, 47 cities and counties had met their lower and above moderate income RHNA. 254 jurisdictions had not created enough housing to meet their above moderate income RHNA. [25] Projects in these jurisdictions can qualify for SB 35 housing if developments with 10% of housing units devoted to below market housing.

SB 35 Projects

Vallco Mall Project

The Vallco Shopping Mall redevelopment project in Cupertino is the largest project to have utilized SB 35. [22] The project will include retail and 2 million square feet of office space, and 2,402 total units of housing. Half of those units, or 1,201, will be designated as below-market rate housing for low and very low-income residents. [9] The project was approved on September 21, 2018 for streamlining under SB 35. In October 2018 the City Council approved, and residents then filed a referendum on, another Vallco project by the same developer—the 2018 Vallco Specific Plan. In May 2019 the City Council repealed the Vallco Specific Plan. [26]

681 Florida Street

The Mission Economic Development Agency (MEDA), an affordable housing development agency, used SB 35 to expedite construction of a 100% affordable housing development in San Francisco’s Mission District. [22] The development will include 130 housing units devoted to low-income families; 30% of those apartments are reserved for formerly homeless families. [27] Without SB 35, the development would have followed the normal approval process and been delayed for 6 months to a year. [22]

Amendments

In 2021 AB1174 was signed into law, which gives projects (like Vallco) using the special approval of SB35 more time to start construction to compensate for delays caused by lawsuits. [28] [29] [28] [29]

SB 423

In 2023, SB 423 was signed into law, which extended the Sunset provision for SB 35 for ten years until January 1, 2036, expands the scope and geographic reach of SB 35’s ministerial review process and modifies SB 35’s labor and affordability requirements. In particular, SB 423 included a legislative finding that affordable housing is a statewide concern instead of a municipal concern, and expanded SB 35's amendments of Government Code Section 65913.4 to apply to all cities, including charter cities. [30] [31]

Finally, SB 423 narrowed SB 35's broad exemptions within the coastal zone (and, by extension, the broad powers of the Coastal Act and the California Coastal Commission to prohibit streamlined multifamily housing within the zone), allowing for some areas in the coastal zone to be eligible for streamlined multifamily housing development under SB 35. [32]

The law entered into force in San Francisco on June 28, 2024, and will enter into force in the rest of California on January 1, 2026.

Vallco Shopping Mall is a mostly-demolished dead mall located in Cupertino, California, United States. Originally built as a single-story shopping mall in 1976 with a lower level added in 1988 and a third-level movie theater added in 2007, it was anchored for most of its existence by Macy's, Sears, and J.C. Penney. As of August 2022, the mall is owned by Sand Hill Property Co. and is almost entirely vacant, with Cupertino Ice Center, Bowlmor Lanes, and Benihana as the only remaining tenants, all in the section to the east of Wolfe Road. The larger western portion of the main mall structure was demolished in August 2019 and the pedestrian overpass was demolished in March 2020; plans for the site include a mixed-use development consisting of office space, housing, and retail.

The Sustainable Communities and Climate Protection Act of 2008, also known as Senate Bill 375 or SB 375, is a State of California law targeting greenhouse gas emissions from passenger vehicles. The Global Warming Solutions Act of 2006 sets goals for the reduction of statewide greenhouse gas emissions. Passenger vehicles are the single largest source of greenhouse gas emissions statewide, accounting for 30% of total emissions. SB 375 therefore provides key support to achieve the goals of AB 32.

Since about 1970, California has been experiencing an extended and increasing housing shortage, such that by 2018, California ranked 49th among the states of the U.S. in terms of housing units per resident. This shortage has been estimated to be 3-4 million housing units as of 2017. As of 2018, experts said that California needs to double its current rate of housing production to keep up with expected population growth and prevent prices from further increasing, and needs to quadruple the current rate of housing production over the next seven years in order for prices and rents to decline.

California Senate Bill 50 was a proposed California bill that would have preempted local government control of land zoning near public transit stations and jobs centers. The bill would have also required, at minimum, four-plex residential zoning statewide. The bill was the successor to a similar bill introduced by state senator Scott Wiener in January 2018 as Senate Bill 827 ; both would have applied to areas within one-half-mile (0.8 km) of frequent transit corridors, including rail stations and bus routes. The bills were sponsored by California YIMBY, a pro-housing lobbying group while they were opposed by local governments, anti-gentrification activists, and suburban homeowners. The bills were written in response to an ongoing housing affordability crisis in California's largest urban areas.

<span class="mw-page-title-main">Affordable housing in Silicon Valley</span>

Silicon Valley, a region located in the southern part of the San Francisco Bay Area, is one of the most expensive regions to live in the United States, and many residents lack access to affordable housing. In 2018, the median home price across the area was $1.18 million, the highest of the 100 largest metro areas in the U.S. The growth of the technology industry in the area, including major companies like Google, Facebook, and Apple, is frequently cited as a major cause of the issue. There have been local efforts to address affordable housing, as well as state measures in response to housing issues across California.

The Regional Housing Needs Assessment (RHNA) is the California state-mandated process within the housing element of its General Plan, to determine how much housing must be planned for each jurisdiction according to Housing Element Law to meet 'projected and existing' housing needs at a variety of affordability levels. Based on demographic data, the state calculates housing need in coordination with each region's planning body, known as a Council of Governments (COG). Once the state and the COG agree, the COG is responsible for the allocation among all jurisdictions within that region through a RNHA Plan. Housing elements are then reviewed by the California Department of Housing and Community Development (HCD) and must be adopted by the jurisdiction which is then responsible for ensuring there are enough sites and proper zoning to accommodate its RHNA allocation. The cycle repeats every eight years. Jurisdictions which fail to adequately accommodate projected growth as determined by HCD are subject to fines from $10,000 per month to $600,000 per month.

The builder's remedy is a legal mechanism in the United States that can be used in certain states to expedite the construction of low or middle income housing when a municipality fails to comply with laws related to housing development. Typically, where a municipality fails to comply with state laws regarding the development of new housing, the builder's remedy either allows a developer to bypass or ignore nearly all of the municipality's zoning laws and begin construction on a development in an expedited manner or provides the developer with a legal remedy that can be enforced in court or through an administrative process. Builder's remedy projects are increasingly common in California, where new state laws have been passed to force local municipalities to approve additional housing to address the ongoing California housing shortage. Massachusetts and New Jersey also employ a form of the builder's remedy as well.

California Assembly Bill 2097 is a 2022 California statute which prohibits California cities and other public agencies from mandating parking for most development projects within 0.5 miles (0.8 km) of a major transit stop. The law also establishes a "substantial hardship exception" which allows a public agency to impose a parking mandate within 0.5 miles of a major transit stop if the agency submits an application with evidence of a negative impact upon either the agency's ability to meet its RHNA obligations for low and very low income residents, disabled and elderly residents, or existing residential or commercial parking within 0.5 miles of a housing development project.

The California Density Bonus Law is a 1979 California statute which grants developers of housing a density bonus, or the ability to exceed city-mandated density limits for their projects, if certain affordable housing prerequisites are met. The law has been repeatedly amended since its enactment, largely in order to ameliorate the state's housing shortage. The original bill, AB 1151, was co-drafted by Mike Roos and Tom Bates in the California State Assembly, and was signed into law by then-Governor Jerry Brown on October 1, 1979.

The Affordable Housing and High Road Jobs Act of 2022 is a California statute which allows for a CEQA-exempt, ministerial, by-right approval for affordable housing on commercially zoned lands, and also allows such approvals for mixed-income housing along commercial corridors, provided that such housing projects satisfy specific criteria of affordability, labor, and environment and pay prevailing wage. The bill was introduced by Assemblymember Buffy Wicks, was signed into law by Governor Gavin Newsom on September 28, 2022, and came into force on July 1, 2023.

California Senate Bill 684 is a 2023 California statute which requires cities to ministerially allow property owners to subdivide multifamily lots to create subdivisions with up to 10 houses, townhouses or condos in multi-family-zoned areas. The law amended the 1974 Subdivision Map Act to streamline approvals for more housing on a single parcel of land. The law also amended the Planning and Zoning Law as well as the Starter Home Revitalization Act. The law requires that eligible housing projects must protect existing housing that:

The Affordable Housing on Faith and Higher Education Lands Act is a 2023 California statute which makes it legal for faith-based institutions and non-profit colleges to build affordable, multi-family homes on lands they own by streamlining the permitting process and overriding local zoning restrictions.

Finally, Newsom green-lighted AB 1174 — a bill that specifically targets the Vallco housing, office and retail project underway in Cupertino. The city was forced to grant Vallco special approval under a new law that fast-tracks certain residential developments. That approval is good for three years, and Cupertino officials recently said Vallco's is set to expire this month. AB 1174 clarifies that projects delayed by litigation — as Vallco was — get more time. "Closing this loophole will protect thousands of new housing units statewide against the whims of local opposition," Jim Wunderman, president and CEO of the Bay Area Council, wrote in a news release. "Too often, the legal system is abused to block housing that we so desperately need. AB 1174 fulfills the intent of past housing reform legislation to speed more housing construction in California."
