The DPS MMS Scandal of 2004 was an infamous scandal caused by the unconsented sharing of an explicit video filmed by a student at Delhi Public School, R. K. Puram. The scandal caused a widespread sensation across India. [1]

The MMS clip

In 2004, a male student Hemant Chugh attending Delhi Public School, R.K. Puram, shot a video on his phone of a fellow underage female student, Aparna Bedi, topless and performing fellatio on him, seemingly without her knowledge. The grainy video clip was then shared through MMS and went viral on porn sites. [2]

Auction bid

On 9 October 2004, an article appeared in Delhi-based tabloid Today with the headline, "DPS sex video at baazee.com". The article, written by Anupam Thapa, had the tag "Outrage", was an exclusive story, and claimed "online website goes ahead with the sale of the infamous clip". The article stated, "India's biggest online trading portal baazee.com had listed the said MMS clip under the title 'DPS girls having fun' with the member ID of 27877408. The police upon investigation learnt that one Alice Electronics of Kharagpur, West Bengal had sold 8 copies of said clip since the 27th August 2004." After this story appeared Delhi Police Commissioner took cognizance of the news item and ordered crime branch to register a case and investigate. Crime branch of Delhi Police registered a case at Hauz Khas Police Station naming Anupam Thapa as complainant in the case and treating the entire story as a First Information Report. [3] Avnish Bajaj, the then CEO of the website Baazee.com was summoned by the Delhi High Court for having allowed this clip to be listed for auction under sections 67 and 85 of the I-T Act, 2000. While Section 67 prohibits publishing obscene information in electronic form, Section 85 allows the prosecution of a person responsible for the business of a company over violations. Bajaj who had subsequently sold his company to eBay Pvt. Ltd. contended that mere listing could not be construed as crime under the Information Technology Act 2000. [4]

This incident caused panic across the country, with many media outlets covering the story. Discussions surrounding the event brought to light the inefficiency of and the need to amend the IT Act, 2000. [5] Following this scandal, and partly due to debates around culpability, liability and prosecution of material on the internet, several key judgements were passed including banning the use of mobile phones in college and school campuses across India. The female student was expelled from the school and she continued her studies from Canada.

Four Hindi films Dev.D (2009), [6] Love Sex Aur Dhokha (2010), [7] Ragini MMS (2011)[ citation needed ] and I Don't Luv U (2013) [8] were inspired by or based on the 2004 MMS scandal. The crime series Gumrah: End of Innocence also featured an episode on the issue, with Aanchal Munjal playing the lead.

<i>United States v. Alkhabaz</i>

United States v. Alkhabaz, 104 F.3d 1492 was a case brought against University of Michigan undergraduate Abraham Jacob Alkhabaz, a.k.a. Jake Baker, related to several incidents regarding snuff stories that he wrote while he was a student at the University of Michigan. Alkhabaz was charged with violation of 18 U.S.C. s 875(c), communicating via interstate or foreign commerce threats to kidnap or injure another person. The case raised immediate First Amendment concerns and is considered an important one in the history of cyber law.

Delhi Public School, Vasant Kunj is a school located in Vasant Kunj, New Delhi, India. DPS Vasant Kunj offers academic services from Kindergarten through Grade XII. The school has a combined strength of 205 teachers at the senior and junior level, and an enrollment of four thousand students.

The Suryanelli rape case refers to a case of kidnapping and subsequent rape of a 16-year-old school girl from Suryanelli, Kerala, India, in 1996. The girl was allegedly lured with the promise of marriage on 16 January 1996 and kidnapped. She was allegedly raped by 37 of the 42 accused persons, over a period of 40 days. The remaining had abetted the crime. After P.J. Kurien, the then Union Minister and later Rajya Sabha Deputy Chairman belonging to UDF led by Congress party, was named, the issue was politicised, due to a then upcoming general election. Several women's rights activists like K. Ajitha and Suja Susan George, and women's organisations, like NFIW and Anweshi, have taken an interest in the case.

<i>Dev.D</i> 2009 film by Anurag Kashyap

Dev.D is a 2009 Indian Hindi-language romantic drama film released on 6 February 2009. Written and directed by Anurag Kashyap, it is a modern-day take on Sarat Chandra Chattopadhyay's classic Bengali novel Devdas, previously adapted for the screen by P.C. Barua and Bimal Roy and more recently by Sanjay Leela Bhansali. Dev.D received positive critical reviews. The film is set in contemporary Punjab and Delhi, where familial ties are negotiated by the traditional system and marriages are a game of power and a matter of honour.

Delhi Public School, R. K. Puram is a co-educational day and private boarding school educating pupils from 6th to 12th grade, located in the South Delhi district of New Delhi, India. It was founded in 1972 and was the second Delhi Public School to be established after Delhi Public School, Mathura Road.

The Sexual Offences Act, 1957 is an act of the Parliament of South Africa which, in its current form, prohibits prostitution, brothel-keeping and procuring, and other activities related to prostitution. The Mysore Mallige scandal refers to a sex scandal in 2001 that involved the leaking of a home video made by a couple. This scandal broke out when the home video made by the couple themselves was leaked out by a friend of the boy involved. Both the boy and the girl were students of an Malnad college of engineering. The words Mysore Mallige meaning the Jasmine of Mysore is actually a double entendre because it originally refers to the flower variety by the same name.

Rape is the fourth most common crime against women in India. According to the 2021 annual report of the National Crime Records Bureau (NCRB), 31,677 rape cases were registered across the country, or an average of 86 cases daily, a rise from 2020 with 28,046 cases, while in 2019, 32,033 cases were registered. Of the total 31,677 rape cases, 28,147 of the rapes were committed by persons known to the victim. The share of victims who were minors or below 18 – the legal age of consent – stood at 10%.
