Mary Elizabeth Heffernan is an American attorney,judge,and former Massachusetts Secretary of Public Safety. She previously served as the Undersecretary of Criminal Justice from 2007 to 2010. [1] She is also a former Assistant District Attorney for Middlesex County. [2] [1]
Heffernan is an alumnus of Framingham State College,Suffolk University Law School,and Suffolk University School of Management. [1] She is a member of the Framingham State University Board of Trustees. [3] She resides in West Roxbury with her two children. [1]
In the private sector,Heffernan served as the Associate General Counsel and Director of Intergovernmental and Regulatory Affairs at Beth Israel Deaconess Medical Center and as the Corporate Director of Government Relations for CareGroup Health Care System. [2] [1]
In 2017,she was appointed as Newton District Court judge. [4]
Soon after her appointment as a Newton District Court judge,she released a suspected rapist –who was in the country illegally and had previously deported –on $2,500 bail despite a request by the district attorney for a much higher bail of $100,000 and despite knowing that U.S. Immigration and Customs Enforcement (ICE) was preparing a detainer for the suspect. In addition prosecutors during the hearing informed Judge Heffernan that the suspect was well known to them as a gang member in the city and was a very high flight risk. Furthermore,not wanting to further inconvenience the suspect allowed him to remain at the courthouse while bail was posted instead of sending him back to the jail awaiting bond to be posted. Bail is the conditional release of a defendant with the promise to appear in court when required. In some countries,especially the United States,bail usually implies a bail bond,a deposit of money or some form of property to the court by the suspect in return for the release from pre-trial detention. If the suspect does not return to court,the bail is forfeited and the suspect may be charged with the crime of failure to appear. If the suspect returns to make all their required appearances,bail is returned after the trial is concluded.

His tenure was also marked by major gang and healthcare enforcement actions. Lelling,however,was also criticized by some as being "overzealous,grandstanding,and politically motivated" for his prosecution of a local trial judge who helped an undocumented immigrant charged with drug crimes avoid arrest by immigration authorities.

United States v. Shelley M. Richmond Joseph and Wesley MacGregor (2019) was the federal criminal prosecution of a Massachusetts state court judge (Joseph) and court officer (MacGregor) for helping a state court defendant evade federal immigration authorities by allowing him to leave a court hearing through a rear door of the courthouse. Both were charged with conspiracy to obstruct justice,aiding and abetting obstruction of justice,and aiding and abetting obstruction of a federal proceeding;MacGregor was also charged with perjury during grand jury proceedings. Joseph faced 20 years in prison;MacGregor,30 years. Both could have been fined $250,000. On September 22,2022,the case concluded with an announcement by federal prosecutors that the obstruction charges against both Joseph and MacGregor would be dismissed and that prosecution of the perjury charge against MacGregor would be deferred. As part of the resolution,Joseph agreed to submit to disciplinary proceedings before the Massachusetts Commission on Judicial Conduct.
