It is a military reserve force composed of National Guard military members or units of each state and the territories of Guam, the Virgin Islands, Puerto Rico, and the District of Columbia, for a total of 54 separate organizations. It is officially created under Congress's Article 1 Section 8 ability to "raise and support armies". All members of the National Guard are also members of the organized militia of the United States as defined by 10 U.S.C. § 246. The Green Mountain Boys were a militia organization established in 1770 in the territory between the British provinces of New York and New Hampshire, known as the New Hampshire Grants and later in 1777 as the Vermont Republic. Headed by Ethan Allen and members of his extended family, it was instrumental in resisting New York's attempts to control the territory, over which it had won de jure control in a territorial dispute with New Hampshire.

However, unlike the National Guard, the State Guard is a purely state-level military force which cannot be federalized or deployed outside the state of New Hampshire. The NHSG is a component of the organized militia of New Hampshire.
