The Provisional Constitution of the Republic of China was the constitutional law of the Republic of China during the tutelage period. It was the second constitutional law since the Qing Empire was renamed and restructured as the Republic of China. It was enacted by the National Government in May 1931 and was abolished naturally until December 25, 1946, after the implementation of the Constitution of the Republic of China. [1] However, it was never promulgated by the competent authority.
After victory in the Xinhai Revolution, the Nanjing Provisional Government of the Republic of China, led by Sun Yat-sen, framed the Provisional Constitution of the Republic of China (simplified Chinese :中华民国临时约法; traditional Chinese :中華民國臨時約法; pinyin :Zhōnghuá Mínguó línshí yuēfǎ, 1912), which was an outline of basic regulations with the qualities of a formal constitution.
On 11 March 1912, the Provisional Constitution replaced the previous organizational outline of the government, and came into effect as the supreme law. It was later replaced by a constitutional compact instituted by Yuan Shikai on 1 May 1914. However, it was restored once again on 29 June 1916, by President Li Yuanhong.
The Constitutional Protection Movement launched by the Military Government of the Republic of China in Guangzhou on 10 September 1917, was intended to "protect" this provisional constitution. However, as the Warlord Era divided the country into warring factions, the provisional constitution was gradually superseded by the constitutions issued by each rival government. In the Beiyang Government, the provisional constitution was replaced by Cao Kun's constitution on 10 October 1923. In the Nanjing Government, the provisional constitution was not replaced until 1 June 1931, when the Provisional Constitution of the Political Tutelage Period was announced, although the old constitution was already rarely discussed after the establishment of the Nationalist Government on 1 July 1925. From 1928 onwards, the Nationalists were operating under an Organic Law that had an ambiguous relationship with the 1931 Provisional Constitution as it was not completely superseded.
The Constitution of the Republic of China superseded it in 1946, ending the Period of Tutelage. [2]
In 1928, the Nationalist Government led by Kuomintang achieved a basic victory in the Northern Expedition, and the domestic situation in China had finally been settled. According to the provisions of Sun Yat-sen's National Founding Guidelines, the military administration ended, and the country would enter the tutelage period.
In March 1929, the 3rd National Congress of the Kuomintang decided not to formulate a constitution for the time being. Instead, they formulated the National Government Organization Act and the Tutelage Period Guidelines to supplement the National Founding Guidelines. [3]
On May 8, 1931, the National Assembly was held. The Political Tutelage Period Act was passed on May 12 and was promulgated and implemented by the National Government on June 1.
The Political Tutelage Period Act has a total of eight chapters and 89 articles. The content of the Act includes a general outline, people’s rights, tutelage guidelines, national livelihood, national education, central and local authorities, governmental organization, and supplementary regulations. Its primary characteristics are as follows:
1. For the freedom and rights of citizens, except for religious beliefs, indirect protectionism is implemented, i.e., the protection of human rights depends on laws, and the government can restrict it according to the laws. [4]
2. The Tutelage Period Guidelines have reconfirmed the form of party governance, and the party governing the country is the Party-State.
3. There are two chapters on national livelihood and education. They announce the government’s policy guidelines and goals in these two respects awhile implementing Sun Yat-sen’s policy on the livelihood of the people.
4. The authority of the central and local governments are subject to the principle of equal rights. It is also subject to the content of the powers of both parties, except for industrial and commercial patents and monopoly franchises, which are under the jurisdiction of the central government; the rest are regulated in detail by law. [5]
5. The National Government organization includes five yuans and a committee system, i.e., it is composed of National Government committees. In addition to representing the Republic of China, the party chairman also nominates the president of the five yuans. Therefore, the National Government organization displays obvious characteristics of the presidential system. Provinces and counties would prepare for self-government, and governors would be elected by the people.
6. The supplementary regulations stipulate that this Provisional Constitution is the supreme law of the tutelage period. The Central Executive Committee of the Kuomintang is responsible for interpreting the law. The Provisional Constitution does not specify the amendment procedures. The amendment procedures can only be implemented in accordance with the established procedures, i.e., re-election of the National Assembly. It is, therefore, a rigid Provisional Constitution.
The Provisional Constitution of the Republic of China was the Provisional Constitution of the Tutelage period. It was initially scheduled to be abolished at the end of the Tutelage period in 1936. However, due to the Japanese invasion of China, the constitutional National Assembly was delayed repeatedly, and constitutionalism was not initiated.
In 1946, the Constitutional National Assembly enacted the Constitution of the Republic of China, along with the Preparatory Procedures for its Implementation. All laws that conflict with the Constitution were to be repealed immediately. At the same time, the National Government promulgated the Act on the Termination of the Tutelage Period to end the government operation during this period.
"Mainland China" is a geopolitical term defined as the territory under direct administration of the Chinese Communist government of the People's Republic of China in the aftermath of the Chinese Civil War. The geopolitical sense of the term includes islands such as Hainan, Chongming, and Zhoushan, even though those islands are offshore of the Chinese mainland. The president of the Republic of China, commonly known as the president of Taiwan, is the head of state of the Republic of China (Taiwan) as well as the commander-in-chief of the Republic of China Armed Forces. The position once had authority of ruling over Mainland China, but its remaining jurisdictions has been limited to Taiwan, Penghu, Kinmen, Matsu, and other smaller islands since the conclusion of the Chinese Civil War.
The Three Principles of the People is a political philosophy developed by Sun Yat-sen as part of a philosophy to improve China made during the Republican Era. The three principles are often translated into and summarized as nationalism, democracy, and the livelihood of the people. This philosophy has been claimed as the cornerstone of the nation's policy as carried by the Kuomintang; the principles also appear in the first line of the national anthem of Taiwan.
The Legislative Yuan is the unicameral legislature of the Republic of China (Taiwan) located in Taipei. The Legislative Yuan is composed of 113 members, who are directly elected for four-year terms by people of the Taiwan Area through a parallel voting system.
The National Assembly was the authoritative legislative body of the Republic of China, from 1947 to 2005. Along with the Control Yuan and the Legislative Yuan, the National Assembly formed the tricameral parliament of China.
The Constitution of the Republic of China is the fifth and current constitution of the Republic of China (ROC), ratified by the Kuomintang during the Constituent National Assembly session on 25 December 1946, in Nanjing, and adopted on 25 December 1947. The constitution, along with its Additional Articles, remains effective in ROC-controlled territories.

The Nationalist government, officially the National Government of the Republic of China, also known as the Second Republic of China or simply as the Republic of China, refers to the government of the Republic of China from 1 July 1925 to 20 May 1948, led by the Kuomintang.
The 1st Legislative Yuan election was held in China between 21 and 23 January 1948. This election, and the preceding 1947 National Assembly election are the first elections of under the newly ratified 1947 Constitution of the Republic of China. Under this constitution, the Legislative Yuan is a standing legislature when the National Assembly is not in session. At the time most of Chinese territory was under the control of the government of the Republic of China, using a direct voting system elected 759 Legislative Representatives. Using the Republic's then 461 million population to calculate, on average 600,000 people elected one representative in the Legislative Yuan. The election along with the one held for the National Assembly also made China the largest democracy at the time.
The Government of the Republic of China, commonly known as the Government of Taiwan, is the central government of Taiwan, whose actual-controlled territory consists of main island of Taiwan (Formosa), Penghu, Kinmen, Matsu, and other island groups, collectively known as Taiwan Area or Free Area. Currently governed by the Democratic Progressive Party (DPP) since 2016. The government of Taiwan is run by a Semi-presidential system, consists of the presidency and five branches (Yuan): the Executive Yuan, Legislative Yuan, Judicial Yuan, Examination Yuan, and Control Yuan. The president is the head of state, with the premier as the head of central government. Since 2005, the Legislative Yuan has been the unicameral parliamentary body of the country.
Dang Guo was the one-party system adopted by the Republic of China under the Kuomintang, lasting from 1924 to 1987. It was adopted after Sun Yat-sen acknowledged the efficacy of the nascent Soviet Union's political system, including its system of dictatorship. Chiang Kai-shek later used the Kuomintang to control and operate the National Government of the Republic of China (ROC) and the National Revolutionary Army. All major national policies of the government bureaucracy were formulated by the Kuomintang, giving the party supreme power over the whole nation. Following the beliefs of Sun Yat-sen, political power should have been returned to the people after the National Revolutionary Army militarily ended the Warlord Era. However, martial law in the ROC continued from 1949 until 1987, during which other political parties were banned. Martial law was lifted in 1987 by President Chiang Ching-kuo, a move that legalized other political parties such as the Democratic Progressive Party and ended the Dang Guo.
National Assembly elections were held between 21 and 23 November 1947 in China. This is the first election of under the newly ratified 1947 Constitution of the Republic of China. Under this constitution, the National Assembly is an authoritative legislature body that holds the power as constitutional convention and presidential electoral college. A total of 2,961 delegates were elected from across the country.
The Republic of China (ROC) or simply China was a sovereign state based in mainland China from 1912 to 1949 prior to its move to Taiwan. It was first established on 1 January 1912, after being proclaimed in the Xinhai Revolution against the Manchu-led Qing dynasty, and lasted until 7 December 1949, after its ruling party Kuomintang (KMT) was defeated by the Chinese Communist Party (CCP) at the de facto end of the Chinese Civil War, which resulted in a retreat of its central government to Taiwan, a territory which it took control of from the Empire of Japan in October 1945 after its surrender in World War II. The Communist-led People's Republic of China (PRC) was established on the mainland upon its official proclamation on 1 October 1949, while the ROC is now based on the island of Taiwan with its capital Taipei, where it retains actual rule over the Taiwan Area with the political status of Taiwan remaining in dispute to this day.
The National People's Congress (NPC) is the highest organ of state power of the People's Republic of China. The NPC is the only branch of government in China, and per the principle of unified power, all state organs from the State Council to the Supreme People's Court (SPC) are subservient to it. With 2,977 members in 2023, it is the largest legislative body in the world. The NPC is elected for a term of five years. It holds annual sessions every spring, usually lasting from 10 to 14 days, in the Great Hall of the People on the west side of Tiananmen Square in Beijing.
The constitutional oath of office of China was implemented on January 1, 2016 through a decision by the Standing Committee of the National People's Congress of China. The oath requirement applies to state civil servants elected or appointed by the National People's Congress and its Standing Committee at or above the county level.
The National Supervisory Commission of the People's Republic of China is the highest supervisory and anti-corruption authority of the People's Republic of China. Formed in 2018 by an amendment to the Constitution, the Commission holds the same constitutional status as that of the State Council, of the Supreme People's Court, and of the Supreme People's Procuratorate.
The National Constituent Assembly was a constituent assembly in the Republic of China, assembled for drafting the Constitution of the Republic of China. Meetings were convened in November and December 1946 at National Great Hall, Nanjing.
