The Academies Act 2010 is an Act of the Parliament of the United Kingdom. It aims to make it possible for all publicly funded schools in England to become academies, still publicly funded but with a vastly increased degree of autonomy in issues such as setting teachers' wages and diverging from the National Curriculum. [2] The Act is inspired by the Swedish free school system. [2] Journalist Mike Baker described it as a "recreation of grant-maintained schools". [3]
It was among the first government bills introduced in the 55th United Kingdom Parliament by the Conservative – Liberal Democrat coalition government. The bill was presented by Jonathan Hill, Baron Hill of Oareford in the House of Lords, where it had its third reading on 13 July. It was read a third time in the House of Commons on 26 July. The Act received Royal Assent on the following day and was brought into force in the most part on 29 July.
Angela Harrison, education correspondent for the BBC, has said that the Act "could be the most radical overhaul of schools in England for a generation". [4]
An Academy may be set up under section 1 of the Act by virtue of an agreement between the Secretary of State for Education and any other person. Alternatively, maintained schools may be converted into academies by an Academy Order made under section 4 of the Act, provided that the governing body of the school has applied under section 3 or the school is eligible for intervention under sections 60-62 of the Education and Inspections Act 2006. Academies established under section 1 will be charities in addition to receiving funding from the central government. [2] Academies will also be free to set their own curriculum, as long as it is "broad and balanced" [2] meeting the standards set in section 78 of the Education Act 2002. The Act will only affect schools in England. [5]
Prior to the 2010 General Election there were 203 academies in England. [2] After the election the new Education Secretary Michael Gove sent a letter to all publicly funded schools inviting them to become academies. Within three weeks, 70% of all outstanding secondary schools expressed interest. [6] Of the 1,567 schools initially expressing interest, 828 were rated "outstanding" and could be fast-tracked into academies by September 2010. [7] An analysis of the list applicants for academy status by the Times Educational Supplement reported that the list was "dominated" by schools from middle class areas, particularly the Home Counties. For example, 12% of schools in Kent applied compared to less than 2% in Middlesbrough. [8] A later list published by the Department for Education said a total of 1,907 schools had expressed an interest.
By 23 July 2010, 153 schools in England had applied for academy status. [9] The list included 12 faith schools and more than 20 grammar schools. Ultimately, 32 new academies (including seven primary schools) opened under the provisions of the Act in the autumn term of 2010. A further 110 schools (including 40 primaries) are planned to convert at a later date. [10] By January 2011 a total of 407 primary and secondary schools with academy status existed (twice as many as before the 2010 election), with the 371 secondary academies representing 11% of the total number of secondary schools. [11]
Opposition MPs and the Conservative chair of the Education Select Committee Graham Stuart accused the government of "rushing" the bill through Parliament, [12] to which the government replied that there was "ample time" to debate the bill. [13] Julian Glover said the "rush hides not the enormity but the thinness of the measure; opposition outrage enhancing the impression that something big must be under way" and the Act "concedes no new powers of any importance". [14]
The Act aims to enshrine greater freedoms for schools given academy status. [15] Janet Daley says this will liberate schools from "monolithic local authority control" [16] while journalist Toby Young said the Act will revitalise the goal of the existing academies system to provide an increased level of choice for parents. [17] Professor Alan Smithers of the University of Buckingham said that the plan to increase autonomy for a select number of schools will be divisive and disadvantaged children would lose out. [18] Supporters say that the "pupil premium" (which is not included within the Academies Act but will be brought forward in forthcoming legislation) will countermand this by allocating extra funds for schools with a greater intake of disadvantaged children. [4]
Criticism of provisions in the Act have also come from the British Humanist Association, [19] the Local Government Information Unit, [20] the Liberal Democrat Education Association, [21] teachers' unions, [22] [23] the Campaign for Science and Engineering, [24] the Institute of Education [25] and Sir Peter Newsam, former Chief Schools Adjudicator. [26] The element of the Act which eliminates the requirement for there to be local consultation was criticised as undemocratic by education lawyers and the National Governors' Association. [27] [28] The National Grammar Schools Association warned grammar schools against becoming academies, saying that "there are fears that academies may not be legally defined as 'maintained' schools, in which case they may lose the statutory protection of requiring a parental ballot before they are turned into comprehensive schools." [29]
The Bill extends to England and Wales but only has application to England. While sections of the Bill do technically extend to Wales, the effect of the provisions will only permit an Academy to be established in England, so it will have no practical impact on, or application to, the organisation of schools in Wales.
The Office for Standards in Education, Children's Services and Skills (Ofsted) is a non-ministerial department of the UK government, reporting to Parliament. Ofsted is responsible for inspecting a range of educational institutions, including state schools and some independent schools, in England. It also inspects childcare, adoption and fostering agencies and initial teacher training, and regulates a range of early years and children's social care services.

Grant-maintained schools or GM schools were state schools in England and Wales between 1988 and 1998 that had opted out of local government control, being funded directly by a grant from central government. Some of these schools had selective admissions procedures.

The National Curriculum assessment usually refers to the statutory assessments carried out in primary schools in England, colloquially known as standard attainment tests (SATs). The assessments are made up of a combination of testing and teacher assessment judgements and are used in all government-funded primary schools in England to assess the attainment of pupils against the programmes of study of the National Curriculum at the end of Key Stages 1 and 2 when most pupils are aged 7 and 11 respectively. Until 2008, assessments were also required at the end of Key Stage 3 (14-year-olds) in secondary schools after which they were scrapped.
The specialist schools programme (SSP), first launched as the Technology Colleges programme and also known as the specialist schools initiative, specialist schools policy and specialist schools scheme, was a government programme in the United Kingdom which encouraged state schools in England and Northern Ireland to raise private sponsorship in order to become specialist schools – schools that specialise in certain areas of the curriculum – to boost achievement, cooperation and diversity in the school system. First introduced in 1993 to England as a policy of John Major's Conservative government, it was relaunched in 1997 as a flagship policy of the New Labour governments, expanding significantly under Prime Minister Tony Blair and his successor Gordon Brown. The programme was introduced to Northern Ireland in 2006, lasting until April 2011 in England and August 2011 in Northern Ireland. By this time, it had established a near-universal specialist system of secondary education in England, with almost every state-funded secondary school in England having specialised. This system replaced the comprehensive system which had been in place since the 1970s.
An academy school in England is a state-funded school which is directly funded by the Department for Education and independent of local authority control. The terms of the arrangements are set out in individual Academy Funding Agreements. Most academies are secondary schools, though slightly more than 25% of primary schools, as well as some of the remaining first and middle schools, are also academies.
Haberdashers' Hatcham College is a state secondary school with academy status and a music specialism located in New Cross. The school was formerly a grammar school, then a comprehensive City Technology College and now an Academy operating between two sites near New Cross Gate in South-East London.
Prince Henry's Grammar School, also known as Prince Henry's or PHGS, is a secondary school and sixth form established in 1607 in the market town of Otley, West Yorkshire, England. The school teaches boys and girls between the ages of 11 and 18 and has around 1,400 pupils and 84 teachers. It retains a high position within regional league tables. In 2016 Prince Henry's had the third highest results for GCSEs in Leeds. Also in 2016 PHGS was the best state school in Leeds for A Level results. The school has repeatedly received a 'good' rating from Ofsted with outstanding features, however has in the past received criticism for the state of the old school building. Despite the name, Prince Henry's is now a state-funded academy school.
Section 28 or Clause 28 was a legislative designation for a series of laws across Britain that prohibited the "promotion of homosexuality" by local authorities. Introduced by Margaret Thatcher's Conservative government, it was in effect from 1988 to 2000 in Scotland and from 1988 to 2003 in England and Wales. It caused many organisations such as lesbian, gay, bisexual and transgender student support groups to close or limit their activities or self-censor.

A free school in England is a type of academy established since 2010 under the Government's free school policy initiative. From May 2015, usage of the term was formally extended to include new academies set up via a local authority competition. Like other academies, free schools are non-profit-making, state-funded schools which are free to attend but which are mostly independent of the local authority.

A university technical college (UTC) is a type of specialist secondary school in England that is led by a sponsor university and has close ties to local business and industry. These university and industry partners support the curriculum development of the UTC, can provide professional development opportunities for teachers, and guide suitably qualified students on to industrial apprenticeships or tertiary education. The sponsor university appoints the majority of the UTC's governors and key members of staff. Pupils transfer to a UTC at the age of 14, part-way through their secondary education. The first UTCs were established in 2010.
In the United Kingdom a specialist school, also called a specialist college, is a type of school or sixth form, usually a secondary school, that specialises in a certain field of curriculum. Specialist schools may receive additional funding from sponsors and/or the government to a varying degree. These funds are then used to expand the provision and facilities of selected specialist subject areas, known as "specialisms". Three of the four constituent countries of the United Kingdom have – or have had – specialist schools, with the one exception being Wales.

Since 2008 about 75% have attained "academy status", which essentially gives them a higher budget per pupil from the Department for Education.
In March 2020, nurseries, schools, and colleges in the United Kingdom were shut down in response to the COVID-19 pandemic. By 20 March, all schools in the UK had closed for all in-person teaching, except for children of key workers and children considered vulnerable. With children at home, teaching took place online. The emergence of a new variant of COVID-19 in December 2020 led to cancellation of face-to-face teaching across England, Northern Ireland, Scotland, and Wales the following month.

In some countries, for example New Zealand, the term is used exclusively for schools specialising in special needs education, which are typically known as special schools.
