Kalpathy Venkataraman Viswanathan (born 26 May 1966) [1] is a judge of the Supreme Court of India. [2] [3]
Viswanathan graduated from Coimbatore Law College and enrolled with the Bar Council of Tamil Nadu in 1988. [4]
Viswanathan worked as a junior under Senior Advocates C.S. Vaidyanathan and K. K. Venugopal from 1988 to 1995 during his early years of practice. [5]
He was designated as the senior advocate by the Supreme Court on 28 April 2009. He was appointed as the Additional Solicitor General of India on 26 August 2013 and held the position till May 2014. [6] [7]
As senior advocate,he argued important constitution bench cases. He represented the petitioners in the case of right to privacy,validity of Aadhaar Act and marriage equality. [4] [6] He represented the intervenor,Internet Freedom Foundation in the WhatsApp-Facebook Privacy case. [6] [8] He contributed to the court as amicus curiae in various cases,including the case concerning the validity of tenure extension for Central Bureau of Investigation and Enforcement Directorate directors and judicial appointments in lower courts. [9] In the case challenging the validity of tenure extension for ED director,he told the court that the amendment must be scrapped "in the interest of democracy." [4]
When Law Minister Kiren Rijiju labeled retired judges who criticized state policies as an "anti-Indian gang," it sparked significant concern. As a senior advocate,he emphasized the gravity of the situation,highlighting that the use of such strong language by India's law minister to describe retired judges is troubling. [10]
He was appointed as a judge of the Supreme Court of India on 19 May 2023. [2] At the time of his appointment,he became the second justice directly appointed to the Supreme Court from the bar. When considering all previous appointments,he was the tenth member of the bar to have been directly appointed to the Supreme Court. [2] [9] He is in line to be the Chief Justice of India from 12 August 2030,to 25 May 2031. [2] He is on track to become the fourth member directly elevated from the bar to assume the position of Chief Justice of India. [6]

Pendency of court cases in India is the delay in the disposal of cases (lawsuits) to provide justice to the aggrieved person or organisation by judicial courts at all levels. The judiciary in India works in hierarchy at three levels - federal or supreme court,state or high courts,and district courts. The court cases is categorised into two types - civil and criminal. In 2023,the total number of pending cases of all types and at all levels rose above 50 million or 5 crores,including over 169,000 court cases pending for more than 30 years in district and high courts. 4.3 crore out of 5 crore cases,i.e more than 85% cases,are pending in district courts as of December 2022. Government itself is the biggest litigant,having 50% of the pending cases being sponsored by the state. Land and property disputes account for the largest set of pending cases. About 66% of all civil cases in India are related to land and property disputes;and 25% of all cases decided by the Supreme Court involve land disputes.
