In the United States, distribution of "obscene, lewd, lascivious, or filthy" materials is a federal crime. [1] The determination of what is "obscene, lewd, lascivious, or filthy" is up to a jury in a trial, which must apply the Miller test; however, due to the prominence of pornography in most communities most pornographic materials are not considered "patently offensive" in the Miller test.

In 1967, Denmark decriminalized pornography, and the following year, the United States Supreme Court held that people could view whatever they wished in the privacy of their own homes. These two developments contributed in part to Congress creating the President's Commission on Obscenity and Pornography in 1968 to investigate the effects of obscenity and pornography on the people of the United States. Each member of the Commission was appointed by President Lyndon B. Johnson. In what became the most detailed and comprehensive investigation into pornography to date, the Commission in its final report found that pornography could not be shown to do harm to individuals or to society, and recommended the repeal of obscenity and pornography legislation as it related to adults. Released during the presidency of Richard Nixon, the report generated a brief bout of controversy but was ultimately ignored by the administration.

Attorney General for Ronald Reagan Edwin Meese also courted controversy when he appointed the "Meese Commission" to investigate pornography in the United States; their report, released in July 1986, was highly critical of pornography and itself became a target of widespread criticism. That year, Meese Commission chairman Alan Sears [2] sent letters on Commission letterhead to the heads of 23 convenience store chains and other companies, declaring that the Commission would find that they were distributors of pornography and threatening that they would be listed as such in the final Report. [3] In fact, the list of purported distributors had been identified by Donald Wildmon, the head of the conservative Christian advocacy organization that later became the American Family Association. [3] [4] The letters triggered several companies to remove common soft-core pornography magazines as Playboy and Penthouse from store shelves. [5] [4] The American Booksellers Association, the Council for Periodical Distributors Associations, the Magazine Publishers of America, [4] and the publishers of Playboy and Penthouse sued, [6] arguing that the letters constituted prior restraint and were forbidden under the First Amendment. The U.S. District Court for the District of Columbia agreed, [3] [5] leading it to admonish the Commission [5] order it to withdraw the letter, and forbid it to issue any list of retailers in the report. [6]

In the United States in 2005, George W. Bush's Attorney General Alberto Gonzales made obscenity and pornography a top prosecutorial priority of the Department of Justice. [7]

The conservative religious organization Concerned Women for America polled every U.S. attorney's office to find out what they planned to do about obscenity. Except for a handful of offices that did not return calls, not one said it had any inclination to pursue anything other than child obscenity cases. [8]

Since the mid-1990s, hardcore pornography has become widely available on the internet, making it more accessible than ever before.

Pornography has existed since the origins of the United States, and has become more readily accessible in the 21st century. Advanced by technological development, it has gone from a hard-to-find "back alley" item, beginning in 1969 with Blue Movie by Andy Warhol, the Golden Age of Porn (1969–1984) and home video, to being more available in the country and later, starting in the 1990s, readily accessible to nearly anyone with a computer or other device connected to the Internet. The U.S. has no current plans to block explicit content from children and adolescents, as many other countries have planned or proceeded to do.

Roth v. United States, 354 U.S. 476 (1957), along with its companion case Alberts v. California, was a landmark decision of the Supreme Court of the United States which redefined the constitutional test for determining what constitutes obscene material unprotected by the First Amendment. The Court, in an opinion by Justice William J. Brennan Jr. created a test to determine what constituted obscene material: Whether the average person, applying contemporary community standards would find that the material appeals to a prurient interest in sex, and whether the material was utterly without redeeming social value. Although the Court upheld Roth’s conviction and allowed some obscenity prosecutions, it drastically loosened obscenity laws. The decision dissatisfied both social conservatives who thought that it had gone too far in tolerating sexual imagery, and liberals who felt that it infringed on the rights of consenting adults.

<i>United States v. Extreme Associates, Inc.</i>

United States v. Extreme Associates, 431 F.3d 150, is a 2005 U.S. law case revolving around issues of obscenity. Extreme Associates, a pornography company owned by Rob Zicari and his wife Lizzy Borden, was prosecuted by the federal government for alleged distribution of obscenity across state lines. After several years of legal proceedings, the matter ended on March 11, 2009, with a plea agreement by Rob Zicari and Lizzy Borden.

In 1969, the United States Supreme Court ruled in Stanley v. Georgia that people could view whatever they wished in the privacy of their own homes. In response, the United States Congress funded the President's Commission on Obscenity and Pornography, set up by President Lyndon B. Johnson to study pornography.

Pornography has been defined as sexual subject material "such as a picture, video, or text" that is intended for sexual arousal. Intended for consumption by adults, pornography depictions have evolved from cave paintings, some forty millennia ago, to virtual reality presentations. A general distinction of adult content is made classifying it as pornography or erotica.

Child erotica is non-pornographic material relating to children that is used by any individuals for sexual purposes. It is a broader term than child pornography, incorporating material that may cause sexual arousal such as nonsexual images, books or magazines on children or pedophilia, toys, diaries, or clothes. Law enforcement investigators have found that child erotica is often collected by pedophiles and child sexual abuse offenders. It may be collected as a form of compulsive behavior and as a substitute for illegal underage pornography and is often a form of evidence for criminal behavior.

The Committee on Obscenity and Film Censorship, better known as the Williams Committee, was a 1970s British Home Office committee chaired by Professor Bernard Williams. The task of the committee was to "review the laws concerning obscenity, indecency and violence in publications, displays and entertainments in England and Wales, except in the field of broadcasting, and to review the arrangements for film censorship in England and Wales".

The Obscenity Prosecution Task Force (OPTF) was an organization created in 2005 by the United States Department of Justice. The OPTF's job was to investigate and prosecute producers and distributors of hardcore pornography that meets the legal tests for obscenity, as defined by the Supreme Court of the United States. The group was led by U.S. Attorney Brent Ward.

Steven Toushin is an American producer and distributor of gay pornographic and BDSM films who has operated adult theaters and sex clubs since 1970. Toushin owned and managed the Bijou Theater in Chicago, the oldest gay adult theater and sex club in the United States. Toushin has produced multiple underground and classic pornographic films through his studio Bijou Video and published several books on the matter. He and his businesses have been the subject of twenty-one obscenity cases, including two federal trials, and he has suffered thirty-five personal arrests and over 200 busts to his businesses.

An obscenity is any utterance or act that strongly offends the prevalent morality of the time. It is derived from the Latin obscēnus, obscaenus, "boding ill; disgusting; indecent", of uncertain etymology. Generally, the term can be used to indicate strong moral repugnance and outrage in expressions such as "obscene profits" and "the obscenity of war". As a legal term, it usually refers to descriptions and depictions of people engaged in sexual and excretory activity.

In the United States, child pornography is illegal under federal law and in all states and is punishable by up to life imprisonment and fines of up to $250,000. U.S. laws regarding child pornography are virtually always enforced and amongst the harshest in the world. The Supreme Court of the United States has found child pornography to be outside the protections of the First Amendment to the United States Constitution. Federal sentencing guidelines on child pornography differentiate between production, distribution, and purchasing/receiving, and also include variations in severity based on the age of the child involved in the materials, with significant increases in penalties when the offense involves a prepubescent child or a child under the age of 18. U.S. law distinguishes between pornographic images of an actual minor, realistic images that are not of an actual minor, and non-realistic images such as drawings. The latter two categories are legally protected unless found to be obscene, whereas the first does not require a finding of obscenity.

An anti-pornography movement in the United States has existed since before the 1969 Supreme Court decision of Stanley v. Georgia, which held that people could view whatever they wished in the privacy of their own homes, by establishing an implied "right to privacy" in U.S. law. This led President Lyndon B. Johnson, with the backing of Congress, to appoint a commission to study pornography. The anti-pornography movement seeks to maintain or restore restrictions and to increase or create restrictions on the production, sale or distribution of pornography.

Feminists Fighting Pornography was a political activist organization against pornography. It advocated for United States Federal legislation to allow lawsuits against the porn industry by women whose attackers were inspired by pornography. FFP was based in New York, N.Y., was founded in 1983 or 1984, and dissolved in 1997.

Lascivious behavior is sexual behavior or conduct that is considered crude and offensive, or contrary to local moral or other standards of appropriate behavior. In this sense, "lascivious" is similar in meaning to "lewd", "indecent", "lecherous", "unchaste", "licentious" or "libidinous".

The Meese Report, officially the Final Report of the Attorney General's Commission on Pornography, is the result of an investigation into pornography ordered by U.S. President Ronald Reagan. It was published in July 1986 and contains 1,960 pages.

United States obscenity law deals with the regulation or suppression of what is considered obscenity and therefore not protected speech or expression under the First Amendment to the United States Constitution. In the United States, discussion of obscenity typically relates to defining what pornography is obscene, as well as to issues of freedom of speech and of the press, otherwise protected by the First Amendment to the Constitution of the United States. Issues of obscenity arise at federal and state levels. State laws operate only within the jurisdiction of each state, and there are differences among such laws. Federal statutes ban obscenity and child pornography produced with real children. Federal law also bans broadcasting of "indecent" material during specified hours.

United States v. Reidel, 402 U.S. 351 (1971), was a United States Supreme Court case in which the Court held that a postal regulation that banned the sale of adult materials was constitutionally permissible.
