Leser v. Garnett, 258 U.S. 130 (1922), was a case in which the Supreme Court of the United States held that the Nineteenth Amendment was constitutional. [1]
Maryland citizens Mary D. Randolph, "'a colored female citizen' of 331 West Biddle Street", [2] and Cecilia Street Waters, "a white woman, of 824 North Eutaw Street", [2] applied for and were granted registration as qualified Baltimore voters on October 12, 1920. To have their names removed from the list of qualified voters, Oscar Leser and others brought suit against the two women on the sole grounds that they were women, arguing that they were not eligible to vote because the Constitution of Maryland limited suffrage to men [3] and the Maryland legislature had refused to vote to ratify the Nineteenth Amendment. Two months before, on August 26, 1920, the ratification of the Nineteenth Amendment to the United States Constitution was certified by Secretary of State Bainbridge Colby.
The Supreme Court granted certiorari to decide "Whether the Nineteenth Amendment has become part of the US Constitution." The plaintiffs disputed the constitutionality of the amendment through three claims:
In a unanimous decision, written by Justice Louis Brandeis, the court addressed each objection in turn.
In response to the first objection, the court declared that since the Fifteenth Amendment had been accepted as valid for more than fifty years, and dealt with a similar matter (in this case, that voting rights could not be denied on account of race), it could not be argued that the new amendment was invalid due to its subject matter.
In response to the second objection, the court decided that when the state legislatures ratified the amendment, they were operating in a federal capacity as laid down in the Constitution, a role which "transcends any limitations sought to be imposed by the people of a state."
As far as the ratifications of Tennessee and West Virginia were concerned, the court remarked that the additional ratifications of Connecticut and Vermont after the proclamation of the amendment rendered the point moot, but the court also addressed the substance of the objection. The court found that as the Secretary of State had accepted the ratifications by the legislatures of the two states as valid, they were valid, effectively ruling the matter as non-justiciable.
Article Five of the United States Constitution describes the procedure for altering the Constitution. Under Article Five, the process to alter the Constitution consists of proposing an amendment or amendments, and subsequent ratification.
The Nineteenth Amendment to the United States Constitution prohibits the United States and its states from denying the right to vote to citizens of the United States on the basis of sex, in effect recognizing the right of women to vote. The amendment was the culmination of a decades-long movement for women's suffrage in the United States, at both the state and national levels, and was part of the worldwide movement towards women's suffrage and part of the wider women's rights movement. The first women's suffrage amendment was introduced in Congress in 1878. However, a suffrage amendment did not pass the House of Representatives until May 21, 1919, which was quickly followed by the Senate, on June 4, 1919. It was then submitted to the states for ratification, achieving the requisite 36 ratifications to secure adoption, and thereby went into effect, on August 18, 1920. The Nineteenth Amendment's adoption was certified on August 26, 1920.
The Equal Rights Amendment (ERA) is a proposed amendment to the U.S. Constitution that would, if added, explicitly prohibit sex discrimination. It was written by Alice Paul and Crystal Eastman and introduced in Congress in December 1923 as a proposed amendment to the United States Constitution. The purpose of the ERA is to guarantee equal legal rights for all American citizens regardless of sex. Proponents assert it would end legal distinctions between men and women in matters of divorce, property, employment, and other matters. Opponents originally argued it would remove protections that women needed. In the 21st century, opponents argue it is no longer needed and some disapprove of its potential effects on abortion and transgender rights.
The Twenty-sixth Amendment to the United States Constitution established a nationally standardized minimum age of 18 for participation in state and local elections. It was proposed by Congress on March 28, 1971, and it was ratified by three-quarters of the states by July 1, 1971.
The Titles of Nobility Amendment is a proposed and still-pending amendment to the United States Constitution. The 11th Congress passed it on May 1, 1810, and submitted to the state legislatures for ratification. It would strip United States citizenship from any citizen who accepted a title of nobility from an "emperor, king, prince or foreign power". On two occasions between 1812 and 1816, it was within two states of the number needed to become part of the Constitution. He was a notable anti-suffragist, challenging the Nineteenth Amendment to the United States Constitution in 1920 and serving as president of the American Constitutional League.

Hawke v. Smith, 253 U.S. 221 (1920), was a United States Supreme Court case coming out of the state of Ohio. It challenged the constitutionality of a provision in the state constitution allowing the state legislature's ratification of federal constitutional amendments to be challenged by a petition signed by six percent of Ohio voters. This would then bring the issue to referendum.
Tax protester Sixteenth Amendment arguments are assertions that the imposition of the U.S. federal income tax is illegal because the Sixteenth Amendment to the United States Constitution, which reads "The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration", was never properly ratified, or that the amendment provides no power to tax income. Proper ratification of the Sixteenth Amendment is disputed by tax protesters who argue that the quoted text of the Amendment differed from the text proposed by Congress, or that Ohio was not a State during ratification, despite its admission to the Union on March 1, 1803, more than a century prior. Sixteenth Amendment ratification arguments have been rejected in every court case where they have been raised and have been identified as legally frivolous.

Hughes, 258 U.S. 126 (1922), was a case in which the Supreme Court of the United States held that a general citizen, in a state that already had women's suffrage, lacked standing to challenge the validity of the ratification of the Nineteenth Amendment. A companion case, Leser v. Garnett, upheld the ratification.

Myrtle Agnes Cain was an American politician and labor activist. She served as president of the Women's Trade Union of Minneapolis and was a member of the Minnesota Farmer Labor Party. In 1923 and 1924, Cain served in the Minnesota House of Representatives. Governor Wendell Anderson named February 15, 1973 "Myrtle Cain Day." She is one of 25 women recognized on the Minnesota Woman Suffrage Memorial in Saint Paul.
