Legislative Assembly elections are speculated be held in the union territory of Jammu and Kashmir, India to elect 90 members [lower-alpha 1] of Jammu and Kashmir Legislative Assembly expected to be along with next Indian general election. [1] [2] The legislative assembly was dissolved in November 2018 through an order [3] by the then Governor Satyapal Malik, which was challenged through dozens of petitions.

Contents

The date of the next elections have not be finalized yet. But would be the first since 2014 and the first since the territory's special status was revoked [4] and its statehood withdrawn in 2019. [5]

Background

The previous assembly elections were held in November–December 2014. After the election, coalition of Jammu and Kashmir Peoples Democratic Party and Bharatiya Janata Party formed the state government, with Mufti Mohammad Sayeed becoming the Chief Minister. [6] [7]

Chief Minister Mufti Mohammad Sayeed died on 7 January 2016. [8] After a brief period of Governor's rule, Mehbooba Mufti was sworn in as the next Chief Minister of Jammu and Kashmir. [9]

Political developments

Dissolution of assembly and President's rule

In June 2018, BJP withdrew its support from the government [10] and Governor's rule was subsequently imposed in Jammu and Kashmir. [11] In November 2018, the state assembly was dissolved by Governor of Jammu and Kashmir Satya Pal Malik. [12] despite the fact that many political parties had written to the Governor expressing their willingness to form the Government. [13] President's rule was imposed on 20 December 2018. [14]

Revocation of Article 370 and reorganisation of state

In 2019, Article 370 of the Constitution of India, which gave special status to Jammu and Kashmir, was abrogated [4] and the Jammu and Kashmir Reorganisation Act was passed to reconstitute the state of Jammu and Kashmir into union territories of Jammu and Kashmir and Ladakh with effect from 31 October 2019. [5]

Delimitation

In March 2020, a three-member Delimitation Commission was formed, chaired by retired Justice Ranjana Prakash Desai, for the delimitation of the union territory of Jammu and Kashmir. [15] The commission published its interim report in February 2022. [16] The final delimitation report was released on 5 May 2022 under which additional 6 seats were added to Jammu division and 1 seat to Kashmir division. After delimitation, the total seats in the assembly rose to 114 seats, out of which 24 seats are designated for areas that fall under Pakistan occupied Kashmir. Out of the remaining 90 seats, 43 seats are in Jammu division and 47 seats are in the Kashmir division. [17] The final delimitation report came into force from 20 May 2022. [18]

DDC elections

In 2020, DDC elections were held after revocation of special status. People's Alliance for Gupkar Declaration (PAGD) secured 110 seats, while BJP was the single largest party with 75 seats. [19]

Democratic Progressive Azad Party

Former Chief Minister Ghulam Nabi Azad resigned from Indian National Congress on 26 August 2022 [20] and launched a new party named Democratic Azad Party on 26 September 2022, [21] [22] later renamed as Democratic Progressive Azad Party. [23]

Reservation for SC/STs and Nominated Members

Union Home Minister introduced 2 bills to extend the provisions for reservation of seats for the Scheduled Castes and Scheduled Tribes communities as applicable for the legislative assemblies throughout the country. [24]

The bills also empower the Lt. Governor of the UT to nominate 2 members from Kashmiri migrant families (1 seat reserved for woman) and 1 seat to be reserved for representative of migrants from (what Indian laws denote as) Pakistan occupied Kashmir (PoK), taking the total number of nominated members in the assembly to 5.

Mufti Mohammad Sayeed was an Indian politician who served twice as the Chief Minister of Jammu and Kashmir, during November 2002–November 2005 and March 2015–January 2016. He was also Minister of Tourism in Rajiv Gandhi's cabinet and Home Minister of India in V. P. Singh's cabinet. He started in the wing of the National Conference led by G. M. After the revocation of the special status (autonomy) of the state in August 2019, Mufti was detained without any charges at first and later under the Jammu and Kashmir Public Safety Act. She was released only in October 2020, after the Supreme Court of India quizzed the government about the length of her detention.

Ghulam Nabi Azad is an Indian politician who served as Leader of Opposition in Rajya Sabha between 2014 and 2021. He also served as the Chief Minister of erstwhile state of Jammu and Kashmir from 2005 to 2008. On 26 September 2022, Azad announced his own political party as Democratic Progressive Azad Party. He is the chief patron cum founder of Democratic Progressive Azad Party.

The Jammu and Kashmir Peoples Democratic Party (PDP) is a state political party in Jammu and Kashmir, India. The PDP was headed and founded by Mufti Mohammed Sayeed. His daughter, Mehbooba Mufti, succeeded him as party leader and as Chief Minister of Jammu and Kashmir following his death in January 2016. The party is a member of the People's Alliance for Gupkar Declaration electoral alliance. The party is also a member of the Indian National Developmental Inclusive Alliance since its founding on 18th June 2023.

Muzaffar Hussain Baig is an Indian politician. He was the former Deputy Chief Minister of the Indian state of Jammu and Kashmir. On Republic Day of 2020 he received India's third highest civilian honour Padma Bhushan.

Haseeb A Drabu is an Indian politician, economist and the former member of Jammu and Kashmir Legislative Assembly from Rajpora constituency in Pulwama district. He was elected as Finance Minister of Jammu and Kashmir in the BJP-PDP coalition government from 2015 to 2018.

Tara Chand is a politician and Dalit leader from Jammu and Kashmir. He was Deputy Chief Minister of Jammu and Kashmir from 2009 to 2014. He had earlier served as the Speaker of the Jammu and Kashmir Legislative Assembly. On 30 August 2022, he resigned from Indian National Congress in support of Ghulam Nabi Azad. He was appointed as Vice chairperson for Democratic Azad Party. On 22 December 2022, he was removed from Democratic Azad Party after the allegations of 'anti-party'activities.

The Jammu and Kashmir Legislative Assembly election, 2014 was held in the Indian state of Jammu and Kashmir in five phases from 25 November – 20 December 2014. Voters elected 87 members to the Jammu and Kashmir Legislative Assembly, which ends its six-year term on 19 January 2020. The results were declared on 23 December 2014. Voter-verified paper audit trail (VVPAT) along with EVMs were used in 3 assembly seats out of 87 in Jammu Kashmir elections.

Elections for the former Indian state of Jammu and Kashmir were held in September -October 2002 in four phases.

Dr Nirmal Kumar Singh is an Indian politician and was the last Speaker of the Jammu and Kashmir Legislative Assembly of the erstwhile Jammu and Kashmir State. He is a former Deputy Chief Minister of Jammu and Kashmir. He is a leader of Bharatiya Janata Party. Syed Mohammad Altaf Bukhari is an Indian politician hailing from Jammu and Kashmir. He is the president of the Jammu and Kashmir Apni Party, a political organization, which he launched in 2020. He served as the Member of Jammu and Kashmir Legislative Assembly from 2015 to 2018, representing the Amira Kadal Assembly constituency. He served as the education minister of Jammu and Kashmir and later assumed the additional responsibility of the Finance, Labour and Employment ministry.

Tassaduq Hussain Mufti is a former cinematographer known for his work in Omkara and Kaminey. He is now the member of Jammu and Kashmir Peoples Democratic Party and the former member of Jammu and Kashmir Legislative Council. He served as the Cabinet Minister for Tourism, from 2017 to 2018, in the government of Jammu and Kashmir. He is the son of former Home Minister of India and two time Chief Minister of Jammu and Kashmir, Mufti Mohammad Sayeed, and brother of former Chief Minister of Jammu and Kashmir, Mehbooba Mufti.

Ghulam Mohammad Saroori, also known as G. M. Saroori, is an Indian politician and the former legislator of Jammu and Kashmir Legislative Assembly, who represented Inderwal constituency of Kishtwar district from 2002 to 2018 until the coalition government was ended in the state of Jammu and Kashmir.

Peer Mohammed Hussain Soharvardi better known as Sher–e–Kuthar among his followers is a Kashmiri politician and former Minister of State in the erstwhile state of Jammu and Kashmir. He served as Member of Legislative Assembly (2002-2008) after being elected from the Shangus assembly constituency. He, subsequently, also served as Vice Chairman of the J&K Muslim Wakf Board.

The Democratic Progressive Azad Party formerly Democratic Azad Party is an Indian political party formed by Ghulam Nabi Azad on 26 September 2022 in Jammu and Kashmir. The party's top three agendas in Jammu and Kashmir are restoration of full statehood, right to land and employment to native domiciles. The party's ideology is based on the ideals of Mahatma Gandhi.
