Nixon v. United States, 506 U.S. 224 (1993), was a United States Supreme Court decision that determined that a question of whether the Senate had properly tried an impeachment was political in nature and could not be resolved in the courts if there was no applicable judicial standard. [1]
The Chief Judge for the United States District Court for the Southern District of Mississippi, Walter Nixon, was convicted of committing perjury before a grand jury but refused to resign from office even after he had been incarcerated. Nixon was subsequently impeached by the US House of Representatives, and the matter was referred to the Senate for a vote on Nixon's removal. The Senate appointed a committee to hear the evidence against Nixon and later report to the body as a whole. The Senate then heard the report of the committee and voted to remove Nixon from office. Nixon contended that this did not meet the constitutional requirement of Article I for the case to be "tried by the Senate".
The court's decision was unanimous, but four separate opinions were published. The majority opinion, by Chief Justice William Rehnquist, held that the courts may not review the impeachment and trial of a federal officer because the Constitution reserves that function to a coordinate political branch. Article I, Section 3 of the Constitution gives the Senate the "sole power to try all impeachments." Because of the word sole it is clear that the judicial branch was not to be included. Furthermore, because the word try was originally understood to include factfinding committees, there was a textually demonstrable commitment to give broad discretion to the Senate in impeachments.
Furthermore, the Framers believed that representatives of the people should try impeachments, and the Court was too small to justly try impeachments. Also, the judicial branch is "checked" by impeachments, so judicial involvement in impeachments might violate the doctrine of the separation of powers.
The Court further ruled that involving the judiciary would prevent finality without clear remedy and bias post-impeachment criminal or civil prosecutions, which the Constitution explicitly allows.
Justices Byron White, Harry Blackmun, and David Souter concurred, but voiced concern that the Court was foreclosing the area for review. While they found that the Senate had done all that was constitutionally required, they were concerned that the Court should have the power to review cases in which the Senate removed an impeached officer summarily without a hearing, or through some arbitrary process such as "a coin toss."
An important feature of this case is how it diverges from Powell v. McCormack (1969). In Powell, a grant of discretionary power to Congress was deemed to be justiciable because it required a mere "interpretation" of the Constitution.
Impeachment is the process by which a legislative body or other legally constituted tribunal initiates charges against a public official for misconduct. It may be understood as a unique process involving both political and legal elements.
In United States constitutional law, the political question doctrine holds that a constitutional dispute that requires knowledge of a non-legal character or the use of techniques not suitable for a court or explicitly assigned by the Constitution to the U.S. Congress, or the President of the United States, lies within the political, rather than the legal, realm to solve, and judges customarily refuse to address such matters. The idea of a political question is closely linked to the concept of justiciability, as it comes down to a question of whether or not the court system is an appropriate forum in which to hear the case. This is because the court system only has the authority to hear and decide a legal question, not a political one. Legal questions are deemed to be justiciable, while political questions are nonjusticiable. One scholar explained:
The political question doctrine holds that some questions, in their nature, are fundamentally political, and not legal, and if a question is fundamentally political ... then the court will refuse to hear that case. It will claim that it doesn't have jurisdiction. And it will leave that question to some other aspect of the political process to settle out.
Article One of the United States Constitution establishes the legislative branch of the federal government, the United States Congress. Under Article One, Congress is a bicameral legislature consisting of the House of Representatives and the Senate. Article One grants Congress various enumerated powers and the ability to pass laws "necessary and proper" to carry out those powers. Article One also establishes the procedures for passing a bill and places various limits on the powers of Congress and the states from abusing their powers.
Article Two of the United States Constitution establishes the executive branch of the federal government, which carries out and enforces federal laws. Article Two vests the power of the executive branch in the office of the president of the United States, lays out the procedures for electing and removing the president, and establishes the president's powers and responsibilities.
Article Three of the United States Constitution establishes the judicial branch of the U.S. federal government. Under Article Three, the judicial branch consists of the Supreme Court of the United States, as well as lower courts created by Congress. Article Three empowers the courts to handle cases or controversies arising under federal law, as well as other enumerated areas. Article Three also defines treason.
The Supreme Court of the United States (SCOTUS) is the highest court in the federal judiciary of the United States. It has ultimate appellate jurisdiction over all federal court cases, and over state court cases that involve a point of U.S. Constitutional or federal law. It also has original jurisdiction over a narrow range of cases, specifically "all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party." The court holds the power of judicial review, the ability to invalidate a statute for violating a provision of the Constitution. It is also able to strike down presidential directives for violating either the Constitution or statutory law. However, it may act only within the context of a case in an area of law over which it has jurisdiction. The court may decide cases having political overtones, but has ruled that it does not have power to decide non-justiciable political questions.
The chief justice of the United States is the chief judge of the Supreme Court of the United States and is the highest-ranking officer of the U.S. federal judiciary. Article II, Section 2, Clause 2 of the U.S. Constitution grants plenary power to the president of the United States to nominate, and with the advice and consent of the United States Senate, appoint "Judges of the Supreme Court", who serve until they resign, retire, are impeached and convicted, or die. The existence of a chief justice is only explicit in Article One, Section 3, Clause 6 which states that the chief justice shall preside on the impeachment trial of the president.
Warren Earl Burger was an American attorney and jurist who served as the 15th chief justice of the United States from 1969 to 1986. Born in Saint Paul, Minnesota, Burger graduated from the St. Paul College of Law in 1931. He helped secure the Minnesota delegation's support for Dwight D. Eisenhower at the 1952 Republican National Convention. After Eisenhower won the 1952 presidential election, he appointed Burger to the position of Assistant Attorney General in charge of the Civil Division. In 1956, Eisenhower appointed Burger to the United States Court of Appeals for the District of Columbia Circuit. Burger served on this court until 1969 and became known as a critic of the Warren Court.
United States v. Nixon, 418 U.S. 683 (1974), was a landmark decision of the Supreme Court of the United States in which the Court unanimously ordered President Richard Nixon to deliver tape recordings and other subpoenaed materials related to the Watergate scandal to a federal district court. Decided on July 24, 1974, the ruling was important to the late stages of the Watergate scandal, amidst an ongoing process to impeach Richard Nixon. United States v. Nixon is considered a crucial precedent limiting the power of any U.S. president to claim executive privilege.
The New Hampshire Supreme Court is the supreme court of the U. S. state of New Hampshire and sole appellate court of the state. The Supreme Court is seated in the state capital, Concord. The Court is composed of a Chief Justice and four Associate Justices appointed by the Governor and Executive Council to serve during "good behavior" until retirement or the age of seventy. Separation of powers is a political doctrine originating in the writings of Charles de Secondat, Baron de Montesquieu in The Spirit of the Laws, in which he argued for a constitutional government with three separate branches, each of which would have defined abilities to check the powers of the others. This philosophy heavily influenced the drafting of the United States Constitution, according to which the Legislative, Executive, and Judicial branches of the United States government are kept distinct in order to prevent abuse of power. The American form of separation of powers is associated with a system of checks and balances.
Justiciability concerns the limits upon legal issues over which a court can exercise its judicial authority. It includes, but is not limited to, the legal concept of standing, which is used to determine if the party bringing the suit is a party appropriate to establishing whether an actual adversarial issue exists. Essentially, justiciability seeks to address whether a court possesses the ability to provide adequate resolution of the dispute; where a court believes that it cannot offer such a final determination, the matter is not justiciable.
Impeachment in the United States is the process by which a legislature may bring charges against an officeholder for misconduct alleged to have been committed with a penalty of removal. Impeachment may also occur at the state level if the state or commonwealth has provisions for it under its constitution. Impeachment might also occur with tribal governments as well as at the local level of government.
Walter Louis Nixon Jr. is a former United States district judge of the United States District Court for the Southern District of Mississippi who in 1989 was impeached by the House of Representatives and removed from office by the Senate. Because Nixon's impeachment was for perjury, the case was cited as a precedent in the impeachment trial of President Bill Clinton.

It was published on March 8, 1788, under the pseudonym Publius, the name under which all The Federalist papers were published. The title is "Objections to the Power of the Senate To Set as a Court for Impeachments Further Considered".
Goldwater v. Carter, 444 U.S. 996 (1979), was a United States Supreme Court case in which the Court dismissed a lawsuit filed by Senator Barry Goldwater and other members of the United States Congress challenging the right of President Jimmy Carter to unilaterally nullify the Sino-American Mutual Defense Treaty, which the United States had signed with the Republic of China, so that relations could instead be established with the People's Republic of China. Goldwater and his co-filers claimed that the President required Senate approval to take such an action, under Article II, Section II of the U.S. Constitution, and that, by not doing so, President Carter had acted beyond the powers of his office. While dismissing the case the Court left open the question of the constitutionality of President Carter's actions.

Powell v. McCormack, 395 U.S. 486 (1969), is a United States Supreme Court case that held that the Qualifications of Members Clause of Article I of the US Constitution is an exclusive list of qualifications of members of the House of Representatives, which may exclude a duly elected member for only those reasons enumerated in that clause.
William Hubbs Rehnquist was an American attorney and jurist who served on the U.S. Supreme Court for 33 years, first as an associate justice from 1972 to 1986 and then as the 16th chief justice from 1986 until his death in 2005. Considered a staunch conservative, Rehnquist favored a conception of federalism that emphasized the Tenth Amendment's reservation of powers to the states. Under this view of federalism, the Court, for the first time since the 1930s, struck down an act of Congress as exceeding its power under the Commerce Clause.
Federal impeachment in the United States is the process by which the House of Representatives charges the president, vice president, or a civil federal officer for alleged misconduct. The House can impeach an individual with a simple majority of the present members or other criteria adopted by the House according to Article One, Section 2, Clause 5 of the U.S. Constitution. Similarly, state and territorial officials, such as a governor, can be impeached and tried by their respective legislatures according to their constitutions. In Washington, D.C., elected officials, except the District's Delegate to the Congress, are removed in a recall election instead of through an impeachment process.
