Pimicikamak is an indigenous people in Canada. Pimicikamak is related to, but constitutionally, legally, historically and administratively distinct from, the Cross Lake First Nation which is a statutory creation that provides services on behalf of the Canadian Government. Pimicikamak government is based on self-determination and has a unique form. [1]
A modern Pimicikamak leader is quoted as saying: "Our ancestors governed themselves in our territory since time immemorial. Pimicikamak did not have rulers. It had leaders. Leadership was based on consensus and especially upon respect that was earned." [2] Oral history told by Pimicikamak elders says that traditional government under customary law (Pimicikamāk okimākānak) was based on consensus, like other Cree governments. [3] Customary law is well-recognized in the jurisprudence of the U.S., [4] U.K. [5] and Canada. [6] Pimicikamak leaders were respected persons, possibly of the Midewiwin society. [7] "A leader held his position as long as he had the respect of the people." [8] As well, oral history says that Elders (the Council of Fire) and women played distinct roles in governance.
Like other indigenous peoples in North America. Pimicikamak was constituted as a self-governing people under spiritual as well as temporal laws. These were passed down orally through stories, ceremonies and traditions [9] that formed part of a culture that enabled Pimicikamak's ancestors to survive as a people in a harsh environment for thousands of years. [10] Many stories say that the elders had a role in speaking of the law and the women had a role in organizing Pimicikamak society. Both came into play at summer gatherings. [11] The Pimicikamak constitution derives from those times. It rests upon custom and is largely uncodified, characteristics it shares with the government of the United Kingdom. [12] It has since evolved [13] into a modern customary form. [14]
On September 24, 1875, Tepastenam and two others [15] signed Treaty 5 [16] with the British Crown at Norway House on behalf of Pimicikamak. It had the effect of amending and partly codifying [17] Pimicikamak's customary constitution and laws. The official written text of the Treaty [18] implicitly depends upon the continuance of Pimicikamak self-government. [19] It appears that, until the 1990s, no other part of Pimicikamak law was codified.
"Pimicikamak’s traditional government is quite new, and yet it is also ancient." [20] Beginning in 1996, parts of the Pimicikamak traditional constitution were updated and codified in written laws in English. They are based upon self-determination, [21] the inherent right of self-government, the Rule of Law and updated traditional principles of democracy and accountability. They deal with making laws in writing, [22] defining who is a Pimicikamak citizen [23] and electing an Executive Council. [24] Pimicikamak government is an example of direct democracy. Modern written Pimicikamak customary law is subject to acceptance by consensus of a general assembly of the Pimicikamak public. [25] The roles of the Secretary to the Councils as keeper of customary laws and as the interface between the oral Cree traditional government and the written English world it faces may have arisen in the 1990s. [26]
Pimicikamak's four councils [27] derive from its traditional form of governance by the elders and women. Each council is elected by its own constituency under its own rules and functions in its own roles by consensus. [28] National policy is established by consensus of the Four Councils (itself a single entity composed of the members of all four councils). The councils are subject to Pimicikamak law. Pimicikamak law requires the Executive Council to give effect to national policy. [29] Because the traditional councils can call an Executive Council election at any time, [30] and its members are the Band Council members ex officio, [31] the Band Council tends to regard Pimicikamak national policy as persuasive.
The government of Canada has not acknowledged Pimicikamak's customary government in modern times. Its policy is that self-government is an inherent right of aboriginal peoples in Canada [32] and that this right is recognized and affirmed by the Constitution of Canada. [33] "The federal government supports the concept of self-government being exercised by Aboriginal nations or other larger groupings of Aboriginal people." [34] but does not accept that an aboriginal people may exercise this right without first negotiating it. [35] Negotiation and legislation of self-government can result in domestic, dependent status similar to that of Indian nations in the United States of America, whose governments are defined by Act of Congress. [36] Canada has not generally accepted Pimicikamak's policy of exercising its inherent right. The government of Canada prefers to deal with Cross Lake First Nation, a domestic, dependent, municipal form of government [37] established by Act of Parliament. [38] Under this federal legislation and the terms of various agreements, the Band Council acts as the agent of the Minister of Indian Affairs and Northern Development in delivering programs to Indians on reserve. [39] Since 1999, several Band Councils have taken and held office pursuant to the Pimicikamak Election Law, 1999 [40] instead of the federal legislation. [41]
The government of Manitoba has a respectful relationship with the Pimicikamak government. [42] In 2002, the Manitoba Minister of Northern and Aboriginal Affairs, the late Honorable Oscar Lathlin, set a precedent by formally addressing the Pimicikamak National Assembly. [43] Premier Gary Doer has acknowledged Pimicikamak's government and traditional councils and formally met with its traditional chiefs.
Indigenous peoples in Canada comprise the First Nations, Inuit, and Métis. Although Indian is a term still commonly used in legal documents, the descriptors Indian and Eskimo have fallen into disuse in Canada, and many consider them to be pejorative. Aboriginal peoples as a collective noun is a specific term of art used in some legal documents, including the Constitution Act, 1982, though in most Indigenous circles Aboriginal has also fallen into disfavour.
In Canada, an Indian reserve is defined by the Indian Act as a "tract of land, the legal title to which is vested in His Majesty, that has been set apart by His Majesty for the use and benefit of a band." Reserves are areas set aside for First Nations, one of the major groupings of Indigenous peoples in Canada, after a contract with the Canadian state, and are not to be confused with indigenous peoples' claims to ancestral lands under Aboriginal title.
The Indian Register is the official record of people registered under the Indian Act in Canada, called status Indians or registered Indians. People registered under the Indian Act have rights and benefits that are not granted to other First Nations people, Inuit, or Métis, the chief benefits of which include the granting of reserves and of rights associated with them, an extended hunting season, easier access to firearms, an exemption from federal and provincial taxes on reserve, and more freedom in the management of gaming and tobacco franchises via less government interference and taxes.
The Muskotew Sakahikan Enowuk or Lubicon Lake Nation is a Cree First Nation in northern Alberta, Canada. They are commonly referred to as the Lubicon Lake Nation, Lubicon Cree, or the Lubicon Lake Cree. This should not be confused with the Lubicon Lake Band #453, which is a separate entity created by the Government of Canada by Order in Council in 1973.
A tribal council is an association of First Nations bands in Canada, generally along regional, ethnic or linguistic lines.
First Nations in Alberta are a group of people who live in the Canadian province of Alberta. The First Nations are peoples recognized as Indigenous peoples or Plains Indians in Canada excluding the Inuit and the Métis. According to the 2011 Census, a population of 116,670 Albertans self-identified as First Nations. Specifically there were 96,730 First Nations people with registered Indian Status and 19,945 First Nations people without registered Indian Status. Alberta has the third largest First Nations population among the provinces and territories. From this total population, 47.3% of the population lives on an Indian reserve and the other 52.7% live in urban centres. According to the 2011 Census, the First Nations population in Edmonton totalled at 31,780, which is the second highest for any city in Canada. The First Nations population in Calgary, in reference to the 2011 Census, totalled at 17,040. There are 48 First Nations or "bands" in Alberta, belonging to nine different ethnic groups or "tribes" based on their ancestral languages.
Canadian Aboriginal law is the body of law of Canada that concerns a variety of issues related to Indigenous peoples in Canada. Canadian Aboriginal Law is different from Canadian Indigenous law: In Canada, Indigenous Law refers to the legal traditions, customs, and practices of Indigenous peoples and groups. Aboriginal peoples as a collective noun is a specific term of art used in legal documents, including the Constitution Act, 1982, and includes First Nations, Inuit and Métis people. Canadian Aboriginal law provides certain constitutionally recognized rights to land and traditional practices. Canadian Aboriginal Law enforces and interprets certain treaties between the Crown and Indigenous people, and manages much of their interaction. A major area of Aboriginal law involves the duty to consult and accommodate.
Peggy J. Blair is a Canadian lawyer and author. Blair has been a member of the Law Society of Upper Canada since 1990 and is a past member of the Law Society of Alberta (1982–1999). Blair is considered an expert in Indigenous legal issues. After leaving active law practice, Blair has become a mystery writer.
Cross Lake First Nation is a band of Cree First Nations people in Canada governed under the Indian Act. Its members occupy several reserves within the town of Cross Lake situated on the east shore of Cross Lake in the province of Manitoba. In October 2008, its recorded registered membership was 6,969, of which 4,953 people of this First Nation lived on their reserve. Cross Lake is the principal community of the Pimicikamak indigenous people that made treaty with the British Crown in 1875. Its indigenous language is Woods Cree. Cross Lake was the site of a residential school operated under Canada's assimilation policy. In 2008, Prime Minister Stephen Harper apologized for the damage caused by this policy.
The Muskrat Dam Lake First Nation is an Oji-Cree First Nation band government in Northern Ontario. They reside on the 1,939.7 hectares Muskrat Dam Lake reserve, located on Muskrat Dam Lake in the Kenora District. The community of Muskrat Dam, Ontario, is located on this reserve. In June 2008, their total registered population was 387 people, of which their on-reserve population was around 195.
Ahtahkakoop First Nation is a Cree First Nation band government in Shell Lake, Saskatchewan, Canada. The Ahtahkakoop First Nation government and community is located on Ahtahkakoop 104, 72 kilometers northwest of Prince Albert and is 17,347 hectares in size. The community was formerly known as the "Sandy Lake Indian Band", a name which is still used interchangeably when referring to the reserve.
Pimicikamak is the name of one of the Cree-speaking aboriginal peoples of Canada. Pimicikamak is "a people of rivers and lakes. The traditional territory of Pimicikamak is around Sipiwesk Lake in the heart of the boreal forest, five hundred kilometres north of Winnipeg, Manitoba. Flowing through their land is Kichi Sipi, the Great River." Pimicikamak's traditional territory also is known as Pimicikamak.
Aboriginal child protection describes services designed specifically for protection of the children of "aboriginal" or indigenous peoples, particularly where these peoples are a minority within a country. They may differ at international, national, legal, cultural, social, professional and program levels from general or mainstream child protection services. Fundamental human rights are a source of many of the differences. Aboriginal child protection may be an integral or a distinct aspect of mainstream services or it may be exercised formally or informally by an aboriginal people itself. There has been controversy about systemic genocide in child protection systems enforced with aboriginal children in post-colonial societies.
Pimicikamak Cree Nation is sometimes used as a name for Pimicikamak, one of the more populous Cree indigenous peoples in Canada. Etymologically, "Pimicikamak Cree Nation" is a description of this indigenous people, and is not a name.
Weechi-it-te-win Family Services is a family services agency focused on the needs of Anishinaabe families in ten communities in the southern part of the traditional territory of the Anishinaabe Nation in Treaty #3 in Canada. It provides bicultural aboriginal and mainstream child protection and prevention services based upon cultural competence. Weechi-it-te-win "is an example of First Nations communities reclaiming jurisdiction for their children and safeguarding a cultural heritage shaken by the impacts of colonization, the legacy of the residential schools and intervention by the mainstream child welfare system." Weechi-te-win is a national child protection agency of the Anishinaabe Nation in Treaty #3. The defining difference between Weechi-it-te-win and mainstream services is its focus on customary care. Its website says: "Weechi-it-te-win was founded as an Indian Alternative and we continue to envision the revitalizing of an Anishinaabe child care system that is rooted in the customs, traditions and values of the Anishinaabe people."
The Anishinaabe Nation in Treaty No. 3 is a sovereign Anishinaabe Nation in Canada. It has existed as a self-governing people with its own laws and government institutions since time immemorial, before the arrival of European settlers. "America, separated from Europe by a wide ocean, was inhabited by ... separate nations, independent of each other and of the rest of the world, having institutions of their own, and governing themselves by their own laws." "The territory included in Treaty #3 in 1873 was governed by a Grand Council of Anishinaabe Chiefs. ... This civil leadership was responding to other political ranks and ultimately to the constituent families." The Nation is, by constitutional definition, the Anishinaabe people that entered into Treaty 3 with the Crown in 1873.
Saddle Lake Cree Nation is a Plains Cree, First Nations community, located in the Amiskwacīwiyiniwak region of central Alberta, Canada. The Nation is a signatory to Treaty 6, and their traditional language is Plains Cree.
Indigenous or Aboriginal self-government refers to proposals to give governments representing the Indigenous peoples in Canada greater powers of government. These proposals range from giving Aboriginal governments powers similar to that of local governments in Canada to demands that Indigenous governments be recognized as sovereign, and capable of "nation-to-nation" negotiations as legal equals to the Crown, as well as many other variations.
The Big River First Nation is a part of the Cree Nation and is located in the Saskatchewan province of Canada. The Big River First Nation is also called ᒥᐢᑕᐦᐃ ᓰᐲᕁ mistahi-sîpîhk in Cree meaning "at the big river". They are signatories of Treaty 6 are located close to Pelican Lake Ojibway, the Big River and Prince Albert National Park. They are 120 km northwest of the city of Prince Albert and 19 km southwest of the village of Debden. The Big River First Nation has nearly 30,000 acres of reserve land. Their reserves include-
