The Prevention of Terrorism Act, 2002 (POTA) was an Act passed by the Parliament of India in 2002, with the objective of strengthening anti-terrorism operations. The Act was enacted due to several terrorist attacks that were being carried out in India and especially in response to the attack on the Parliament. The Act replaced the Prevention of Terrorism Ordinance (POTO) of 2001 and the Terrorist and Disruptive Activities (Prevention) Act (TADA) (1985–1995), and was supported by the governing National Democratic Alliance. The Act was repealed in 2004 by the United Progressive Alliance coalition.
The bill was defeated in the Rajya Sabha (the upper house) by a 113–98 vote, [3] but was passed in a joint session (425 Ayes and 296 Noes), as the Lok Sabha (lower house) has more seats. It was only the third time that a bill was passed by a joint session of both houses of Indian Parliament. [4] [5] [6]
The Act defined what constituted a "terrorist act" and who a "terrorist" was, and granted special powers to the investigating authorities described under the Act. In order to ensure that discretionary powers granted to the investigating agencies were not misused and human rights violations were not committed, specific safeguards were built into the Act. [7]
Similar to the provisions contained in TADA, the law provided that a suspect could be detained for up to 180 days without the filing of a chargesheet in court. However, a very major change was introduced, in that unlike TADA, this act had no provision to allow preventive detention. [8]
Secondly, the matter of confessions made by the accused to the police. The general law in India does not recognise confessions made to police as evidence admissible in court, and permits a person to deny such confessions in court, but under POTA, confessions made to a police officer were admissible as evidence in court. [9] POTA also allowed law enforcement agencies to withhold the identity of witnesses. Anti-Terrorism Day is celebrated on 21 May.
However, the POTA law did have some safeguards. Any decision on bail petitions or the verdict of the special courts constituted under this Act could be appealed against, and the appeal would be heard by a division bench of the relevant High Court.
The provisions in the Act mentioned the possibility of both state and central review committees, but offered few details as to their formation or use. As the Act began to be widely misused by the state governments, the central government finally established a review committee to hear individual cases related to this Act. At first, the committee functioned in a purely advisory capacity.
In December 2003, by an overwhelming majority, India's legislature amended the Act with an ordinance designed to expand the scope of judicial review. [8] The new ordinance gave review commissions the authority to review the prima facie case of an "aggrieved person" and issue orders binding on the state government and police. Though the amendment was an improvement on the purely advisory capacity of the initial review committee because it enhanced the power of judicial review, the central review committee remained largely impotent, as it could not initiate an investigation absent an initial complaint and lacked clearly delineated investigatory powers. Moreover, the review committee's resources were limited, and it operated under no regulated time-frame. Without sufficient autonomy, resources, or guidelines, the committee was an illusory safeguard. [8]
Given the review committee's limitations, only the grievances of those persons with political connections to the central government were likely to be heard. Further, even with political pressure from the central government and a favorable advisory opinion by the review committee, Tamil Nadu detained Vaiko for over four months without charge, and an additional fourteen months after charging him before granting bail.
Once the Act came into force, many reports surfaced of the law being grossly abused. [10] POTA was alleged to have been arbitrarily used to target political opponents. Only four months after its enactment, state law enforcement officers had arrested 250 people nationwide under the Act, and the number was steadily increasing. A mere eight months later, seven states where POTA was in force, had arrested over 940 people, at least 560 of whom were languishing in jail. Several prominent persons like Vaiko were arrested under the act. [11]
The Act had a built-in expiry date three years after its commencement, vide section 1(6) of the Act. [12] It had commenced on 24 October 2001, so was scheduled to expire on 24 October 2004. One month before its expiry, the Act was repealed on 21 September 2004 by the Prevention of Terrorism (Repeal) Ordinance, 2004, [13] later substituted with the Prevention of Terrorism (Repeal) Act, 2004 (assented to on 21 December 2004 [14] ). NDA asked UPA to introduce the Act again, but Congress criticized it and did not pass the Act. [15]
The Anti-terrorism, Crime and Security Act 2001 is an Act of Parliament of the United Kingdom, formally introduced into Parliament on 19 November 2001, two months after the terrorist attacks in the United States on 11 September. It received royal assent and came into force on 14 December 2001. Many of its measures are not specifically related to terrorism, and a Parliamentary committee was critical of the swift timetable for such a long bill including non-emergency measures.
Armed Forces Act (AFSPA), 1958 is an act of the Parliament of India that grants special powers to the Indian Armed Forces to maintain public order in "disturbed areas". According to the Disturbed Areas Act, 1976 once declared 'disturbed', the area has to maintain status quo for a minimum of 3 months. One such act passed on 11 September 1958 was applicable to the Naga Hills, then part of Assam. In the following decades it spread, one by one, to the other Seven Sister States in India's northeast. Another one passed in 1983 and applicable to Punjab and Chandigarh was withdrawn in 1997, roughly 14 years after it came to force. An act passed in 1990 was applied to Jammu and Kashmir and has been in force since.
On 5 July 2005, five Lashkar-e-Taiba's terrorists attacked the makeshift Ram temple at the site of destroyed Babri Mosque in Ayodhya, India. All five were shot dead in the ensuing gunfight with the Central Reserve Police Force (CRPF), while one civilian died in the grenade attack that the attackers launched in order to breach the cordoned wall. The CRPF suffered three casualties, two of whom were seriously injured with multiple gunshot wounds.
Vaiko, birth name Vaiyapuri Gopalsamy, is an Indian politician. He is a member of the Rajya Sabha, the upper house of the Parliament of India from Tamil Nadu. He is the founder and General Secretary of the Marumalarchi Dravida Munnetra Kazhagam (MDMK), a political party active mainly in the Indian state of Tamil Nadu. He was earlier elected to the Lok Sabha, the lower house of the Parliament of India from Sivakasi, Tamil Nadu.
Mohammad Afzal Guru was a Kashmiri terrorist who was convicted for his role in the 2001 Indian Parliament attack. He received a death sentence for his involvement, which was upheld by the Indian Supreme Court. Following the rejection of a mercy petition by the President of India, he was executed on 9 February 2013. His body was buried within the precincts of Delhi's Tihar Jail.
The 2001 Indian Parliament attack was a terrorist attack on the Parliament of India in New Delhi, India on 13 December 2001. The attack was carried out by five armed assailants that resulted in the deaths of six Delhi Police personnel, two Parliament Security Service personnel, and a gardener. All the five terrorists were killed by security forces.
Anti-terrorism legislation are laws aimed at fighting terrorism. They usually, if not always, follow specific bombings or assassinations. Anti-terrorism legislation usually includes specific amendments allowing the state to bypass its own legislation when fighting terrorism-related crimes, under alleged grounds of necessity.
Terrorist and Disruptive Activities (Prevention) Act, commonly known as TADA, was an Indian anti-terrorism law which was in force between 1985 and 1995 amid the Punjab insurgency and applied to the whole of India. It was originally assented to by the President on 23 May 1985 and came into effect on 24 May 1985. This act was intended to halt the Khalistani Movement, an armed Sikh separatist movement present in Punjab. It later expanded to encompass other states as well. The Act had a sunset provision for lapsing after two years post-commencement, which it did on 24 May 1987. The Parliament not being in session, the life of the Act could not be extended. But the provisions were kept alive by an ordinance effective from the expiry date of the Act. This ordinance was later replaced with the Terrorist and Disruptive Activities (Prevention) Act, 1987. It was assented to on 3 September 1987, and made effective in two parts from 24 May 1987 and 3 September 1987. This also had a sunset provision of two years from 24 May 1987. It was renewed in 1989, 1991 and 1993 before being allowed to lapse in 1995 due to increasing unpopularity after widespread allegations of abuse. It was the first anti-terrorism law legislated by the government to define and counter terrorist activities.
The Maintenance of Internal Security Act (MISA) was a controversial law passed by the Indian parliament in 1971 giving the administration of Prime Minister Indira Gandhi and Indian law enforcement agencies very broad powers – indefinite preventive detention of individuals, search and seizure of property without warrants, and wiretapping – in the quelling of civil and political disorder in India, as well as countering foreign-inspired sabotage, terrorism, subterfuge and threats to national security. The law was amended several times during the subsequently declared national emergency (1975–1977) and used for quelling political dissent. Finally, it was repealed in 1977, when Indira Gandhi lost the 1977 Indian general election and the Janata Party came to power.
The Godhra train burning occurred on the morning of 27 February 2002, when 59 Hindu pilgrims and karsevaks returning from Ayodhya were killed in a fire inside the Sabarmati Express near the Godhra railway station in Gujarat, India. The cause of the fire remains disputed. The Gujarat riots, during which Muslims were the targets of widespread and severe violence, took place shortly afterward.
Rajindar Sachar was an Indian lawyer and a former Chief Justice of the Delhi High Court. He was a member of United Nations Sub-Commission on the Promotion and Protection of Human Rights and also served as a counsel for the People's Union for Civil Liberties.
The 25 August 2003 Mumbai bombings were twin car bombings in the Indian city of Mumbai that killed 54, and injured 244 people. One of the bomb explosions took place at the Gateway of India, which is a major tourist attraction. The other bomb went off in a jewellery market Zaveri Bazaar near the Mumba Devi temple in central Mumbai. Both the bombs were planted in parked taxis and exploded during the lunch hour. No group initially claimed responsibility for the attack, but Pakistan-based Lashkar-e-Taiba was blamed for it.
Raghuraj Pratap Singh,, commonly known as Raja Bhaiya, is an Indian politician, currently serving as a Member of Legislative Assembly (MLA) in the 18th Uttar Pradesh Assembly, representing the Kunda assembly constituency of Pratapgarh. He has been elected as an MLA for the seventh consecutive time since 1993 from the same constituency. In 2018, he founded and became the national president of Jansatta Dal Loktantrik party. Singh has held various Cabinet Minister positions in the Government of Uttar Pradesh of both Samajwadi Party and Bharatiya Janata Party administrations.
The Unlawful Activities (Prevention) Act is an Indian law aimed at the prevention of unlawful activities associations in India. Its main objective was to make powers available for dealing with activities directed against the integrity and sovereignty of India. The most recent amendment of the law, the Unlawful Activities (Prevention) Amendment Act, 2019 has made it possible for the Union Government to designate individuals as terrorists without following any formal judicial process. UAPA is also known as the "Anti-terror law".
Atal Bihari Vajpayee was an Indian politician who served thrice as Prime Minister of India, first from 16 May to 1 June 1996, and then from 19 March 1998 to 22 May 2004. A member of the Bharatiya Janata Party (BJP), Vajpayee was the tenth Prime Minister. He headed the BJP-led National Democratic Alliance in the Indian Parliament, and became the first Prime Minister unaffiliated with the Indian National Congress to complete a full five-year term in office. He died at the age of 93 on Thursday 16 August 2018 at 17:05 at AIIMS, New Delhi.
The Maharashtra Control of Organised Crime Act, 1999 is a law enacted by the state of Maharashtra in India in 1999 to combat organised crime and terrorism. Known as "MCOCA", the Act provides the State Government with special powers to tackle these issues, including powers of surveillance, relaxed evidentiary standards and procedural safeguards, and prescribing additional criminal penalties, including the death penalty. The law was introduced by a coalition government of the Bharatiya Janata Party and Shiv Sena.
Devinder Pal Singh Bhullar is a Sikh activist and a former professor. He was convicted by a TADA court in a 1993 Delhi bomb blast case that left nine people dead and injured 31. The Indian supreme court had confirmed his death sentence in a fractured and divided decision. His death sentence has been commuted to life imprisonment by the Supreme Court of India on 31 March 2014.

Qasim Faktoo is a Kashmiri separatist and militant, serving life imprisonment for the murder of Hriday Nath Wanchoo. He had been among the earliest members of Hizbul Mujahideen.
The Prevention of Terrorism Act 2015, is an anti-terrorism law that was passed by the Malaysian government on 7 April 2015. It enables the Malaysian authorities to detain terror suspects without trial for a period of two years. POTA also does not allow any judicial reviews of detentions. Instead, detentions will be reviewed by a special Prevention of Terrorism Board. The POTA bill has been criticised by opposition elements as a reincarnation of the former Internal Security Act, which was revoked in 2012. The passage of POTA coincided with the arrest of seventeen suspected militants who were involved in an alleged terror plot in the capital Kuala Lumpur.
