Rational-legal authority

Rational-legal authority (also known as rational authority, legal authority, rational domination, legal domination, or bureaucratic authority) is a form of leadership in which the authority of an organization or a ruling regime is largely tied to legal rationality, legal legitimacy and bureaucracy. The majority of the modern states of the twentieth and twenty-first centuries are rational-legal authorities, according to those who use this form of classification.

Scholars such as Max Weber and Charles Perrow characterized the rational-legal bureaucracy as the most efficient form of administration. [1] [2]

In sociology, the concept of rational-legal domination comes from Max Weber's tripartite classification of authority (one of several classifications of government used by sociologists); the other two forms being traditional authority and charismatic authority. All of those three domination types represent an example of his ideal type concept. Weber noted that in history those ideal types of domination are always found in combinations.

In traditional authority, the legitimacy of the authority comes from tradition. Charismatic authority is legitimized by the personality and leadership qualities of the ruling individual. Finally, rational-legal authority derives its powers from the system of bureaucracy and legality.

Under rational-legal authority, legitimacy is seen as coming from a legal order and the laws that have been enacted in it (see also natural law and legal positivism).

Weber defined legal order as a system where the rules are enacted and obeyed as legitimate because they are in line with other laws on how they can be enacted and how they should be obeyed. Further, they are enforced by a government that monopolizes their enactment and the legitimate use of physical force.

If society, as a whole, approves the exercise of the power in a certain way, then the power is considered "legitimate authority".

Max Weber's theory: type of authority

Max Weber broke down legitimate authority into three different types of societies: Traditional Authority, Rational-legal Authority, and Charismatic Authority. Each of these authorities have their own unique complex societies that have evolved from simple definitions.

Weber wrote that the modern state based on rational-legal authority emerged from the patrimonial and feudal struggle for power (see traditional authority) uniquely in the Occidental civilization. The prerequisites for the modern Western state are:

An important attribute of Weber's definition of a modern state was that it is a bureaucracy.

The vast majority of the modern states from the 20th century onward fall under the rational-legal authority category.

Weber provided ten necessities addressing: "how individual officials are appointed and work". The administrative staff are under the supreme authority for legal authority in a bureaucratic administrative style.

  1. They are personally free and subject to authority only with respect to their impersonal official obligation.
  2. They are organized in a clearly defined hierarchy of offices.
  3. Each office has a clearly defined sphere of competence in the legal sense.
  4. The office is filled by a free contractual relationship or free selection.
  5. Candidates are selected on the basis of technical qualification.
  6. They are remunerated by fixed salaries in money for the most part, with a right to pensions.
  7. The office is treated as the sole, or at least primary, occupation of incumbent.
  8. It constitutes a career. Promotions are dependent on the judgement of superiors.
  9. The official works entirely separated from ownership of the means of administration and without appropriation of his/her position.
  10. He is subject to strict and systematic discipline and control in the conduct of the office.

"Politics as a Vocation" is an essay by German economist and sociologist Max Weber (1864–1920). It originated in the second lecture of a series he gave in Munich to the "Free Students Union" of Bavaria on 28 January 1919. This happened during the German Revolution when Munich itself was briefly the capital of the Bavarian Socialist Republic. Weber gave the speech based on handwritten notes which were transcribed by a stenographer. The essay was published in an extended version in July 1919, and translated into English only after World War II. The essay is today regarded as a classic work of political science and sociology.

Traditional authority is a form of leadership in which the authority of an organization or a regime is largely tied to tradition or custom. The main reason for the given state of affairs is that "things have always been that way".

Max Weber distinguished three ideal types of legitimate political leadership, domination and authority. He wrote about these three types of domination in both his essay "The Three Types of Legitimate Rule", which was published in his masterwork Economy and Society, and in his classic speech "Politics as a Vocation".

Legitimation in the social sciences refers to the process whereby an act, process, or ideology becomes legitimate by its attachment to norms and values within a given society. It is the process of making something acceptable and normative to a group or audience.

In sociology, the term rationalization was coined by Max Weber, a German sociologist, jurist, and economist. Rationalization is the replacement of traditions, values, and emotions as motivators for behaviour in society with concepts based on rationality and reason. The term rational is seen in the context of people, their expressions, and or their actions. This term can be applied to people who can perform speech or in general any action, in addition to the views of rationality within people it can be seen in the perspective of something such as a worldview or perspective (idea). An example of rationalization can be seen in the implementation of bureaucracies in government is a kind of rationalization, as is the construction of high-efficiency living spaces in architecture and urban planning. A potential reason as to why rationalization of a culture may take place in the modern era is the process of globalization. Countries are becoming increasingly interlinked, and with the rise of technology, it is easier for countries to influence each other through social networking, the media and politics. An example of rationalization in place would be the case of witch doctors in certain parts of Africa. Whilst many locals view them as an important part of their culture and traditions, development initiatives and aid workers have tried to rationalize the practice in order to educate the local people in modern medicine and practice.

In sociology, the iron cage is a concept introduced by Max Weber to describe the increased rationalization inherent in social life, particularly in Western capitalist societies. The "iron cage" thus traps individuals in systems based purely on teleological efficiency, rational calculation and control. Weber also described the bureaucratization of social order as "the polar night of icy darkness".

<span class="mw-page-title-main">Legitimation crisis</span> Decline of trust in authority

Legitimation crisis refers to a decline in the confidence of administrative functions, institutions, or leadership. The term was first introduced in 1973 by Jürgen Habermas, a German sociologist and philosopher. Habermas expanded upon the concept, claiming that with a legitimation crisis, an institution or organization does not have the administrative capabilities to maintain or establish structures effective in achieving their end goals. The term itself has been generalized by other scholars to refer not only to the political realm, but to organizational and institutional structures as well. While there is not unanimity among social scientists when claiming that a legitimation crisis exists, a predominant way of measuring a legitimation crisis is to consider public attitudes toward the organization in question.

Bureaucracy is a body of non-elected governing officials or an administrative policy-making group. Historically, a bureaucracy was a government administration managed by departments staffed with non-elected officials. Today, bureaucracy is the administrative system governing any large institution, whether publicly owned or privately owned. The public administration in many jurisdictions and sub-jurisdictions exemplifies bureaucracy, but so does any centralized hierarchical structure of an institution, e.g. hospitals, academic entities, business firms, professional societies, social clubs, etc.
