The Representation of the People Act 1985 (c. 50) is an act of the Parliament of the United Kingdom concerning British electoral law.
The Act allows British citizens who are resident outside the United Kingdom to qualify as "overseas electors" in the constituency for which they were last registered for a period of five years after they have left (this was subsequently changed to 20 years and is now 15 years). Expatriate electors were able to register as overseas electors at British consular posts, starting in the summer of 1986. When registered, expatriate voters were eligible to vote by proxy at any Parliamentary or European Parliament elections which were held after the 1987 register came into force on 16 February 1987. It was estimated that half-a-million British expatriates were enfranchised by the Act. [1]
The Act also made British people abroad on holiday eligible to vote by postal ballot or by proxy, as well as those who were not reasonably expected to be able to by being physically present at the polling station.[ citation needed ]
The Act modified the rules concerning deposits in Parliamentary elections. Previously the deposit had been £150 and was under this Act raised to £500. The percentage of votes needed to retain the deposit was lowered from 12½% to 5%. The deposit for election to the European Parliament were raised from £600 to £700.[ citation needed ]
Suffrage, political franchise, or simply franchise is the right to vote in public, political elections and referendums. In some languages, and occasionally in English, the right to vote is called active suffrage, as distinct from passive suffrage, which is the right to stand for election. The combination of active and passive suffrage is sometimes called full suffrage.
Disfranchisement, also disenfranchisement or voter disqualification, is the restriction of suffrage of a person or group of people, or a practice that has the effect of preventing someone from exercising the right to vote. Disfranchisement can also refer to the revocation of power or control of a particular individual, community, or being to the natural amenity they have; that is to deprive of a franchise, of a legal right, of some privilege or inherent immunity. Disfranchisement may be accomplished explicitly by law or implicitly through requirements applied in a discriminatory fashion, through intimidation, or by placing unreasonable requirements on voters for registration or voting. High barriers to entry to the political competition can disenfranchise political movements.
Gibraltar elects on the national level a legislature. The Gibraltar Parliament has 17 members, all elected for a four-year term in one constituency with each voter getting to vote for their selection of ten candidates. Gibraltar forms a single constituency but voters have only ten votes. Hence the electoral bloc with the most votes will normally get ten seats and the runners up seven.
The Canadian electoral system is based on a parliamentary system of government modelled on that of the United Kingdom.
In electoral systems, voter registration is the requirement that a person otherwise eligible to vote must register on an electoral roll, which is usually a prerequisite for being entitled or permitted to vote.
An absentee ballot is a vote cast by someone who is unable or unwilling to attend the official polling station to which the voter is normally allocated. Methods include voting at a different location, postal voting, proxy voting and online voting. Increasing the ease of access to absentee ballots is seen by many as one way to improve voter turnout through convenience voting, though some countries require that a valid reason, such as infirmity or travel, be given before a voter can participate in an absentee ballot. Early voting overlaps with absentee voting. Early voting includes votes cast before the official election day(s), by mail, online or in-person at voting centers which are open for the purpose. Some places call early in-person voting a form of "absentee" voting, since voters are absent from the polling place on election day.
Postal voting is voting in an election where ballot papers are distributed to electors by post, in contrast to electors voting in person at a polling station or electronically via an electronic voting system.
An electoral roll is a compilation that lists persons who are entitled to vote for particular elections in a particular jurisdiction. The list is usually broken down by electoral districts, and is primarily prepared to assist election officials at polling places. Most jurisdictions maintain permanent electoral rolls, which are updated continuously or periodically, while some jurisdictions compile new electoral rolls before each election. Electoral rolls are the result of a process of voter registration. In most jurisdictions, voter registration is a prerequisite for voting at an election. Some jurisdictions do not require voter registration, and do not use electoral rolls, such as the state of North Dakota in the United States. In those jurisdictions a voter must provide identification and proof of entitlement to vote before being permitted to vote.
The Representation of the People Act 1948 was an Act of the Parliament of the United Kingdom that altered the law relating to parliamentary and local elections. It is noteworthy for abolishing plural voting for parliamentary elections, including by the abolition of the twelve separate university constituencies; and for again increasing the number of members overall, in this case to 613.
A Commonwealth citizen is a citizen of a Commonwealth of Nations member state. Most member countries generally do not treat citizens of other Commonwealth states any differently from foreign nationals, but do grant limited citizenship rights to resident Commonwealth citizens. For example, in 14 member states, resident non-local Commonwealth citizens are eligible to vote in elections. The status is most significant in the United Kingdom, and carries few or no privileges in many other Commonwealth countries.
General elections in Singapore must be held within three months after five years have elapsed from the date of the first sitting of a particular Parliament of Singapore, as per the Constitution. However, Parliament can also be dissolved and a general election called at the behest of the Prime Minister before the five-year period elapses. The number of constituencies or electoral divisions is not permanently fixed by law, but is declared by the Prime Minister prior to each general election pursuant to the Parliamentary Elections Act, which governs the conduct of elections to Parliament, taking into account recommendations of the Electoral Boundaries Review Committee.
Plural voting is the practice whereby one person might be able to vote multiple times in an election. It is not to be confused with a plurality voting system which does not necessarily involve plural voting. Weighted voting is a generalisation of plural voting.
Forty-shilling freeholders were those who had the parliamentary franchise to vote by virtue of possessing freehold property, or lands held directly of the king, of an annual rent of at least forty shillings, clear of all charges.
Dublin University is a university constituency in Ireland, which elects three senators to Seanad Éireann, the senate of the Oireachtas. Its electorate comprises the undergraduate scholars and graduates of the University of Dublin, whose sole constituent college is Trinity College Dublin, so it is often also referred to as the Trinity College constituency. Between 1613 and 1937 it elected MPs or TDs to a series of representative legislative bodies.
Non-citizen suffrage is the extension of the right to vote (suffrage) to non-citizens. This right varies widely by place in terms of which non-citizens are allowed to vote and in which elections, though there has been a trend over the last 30 years to enfranchise more non-citizens, especially in Europe.
Electors must be on the electoral register in order to vote in elections and referendums in the UK. Electoral registration officers within local authorities have a duty to compile and maintain accurate electoral registers.
There are five types of elections in the United Kingdom: elections to the House of Commons of the United Kingdom, elections to devolved parliaments and assemblies, local elections, mayoral elections, and Police and Crime Commissioner elections. Within each of those categories, there may also be by-elections. Elections are held on Election Day, which is conventionally a Thursday, and under the provisions of the Dissolution and Calling of Parliament Act 2022 the timing of general elections can be held at the discretion of the prime minister during any five-year period. All other types of elections are held after fixed periods, though early elections to the devolved assemblies and parliaments can occur in certain situations. The five electoral systems used are: the single member plurality system (first-past-the-post), the multi-member plurality, the single transferable vote, the additional member system, and the supplementary vote.
The right to vote in Singapore is not explicitly stated in Singapore's Constitution, but the Government has expressed the view that it may be inferred from the fact that Singapore is a representative democracy and from specific constitutional provisions, including Articles 65 and 66 which set out requirements for the prorogation and dissolution of Parliament and the holding of general elections. Speaking on the matter in Parliament in 2009, the Minister for Law, K. Shanmugam, said that the right to vote could not be a mere privilege as this would imply the existence of an institution superior to the body of citizens that is empowered to grant such a privilege, but that no such institution exists in a free country. In 1966 a Constitutional Commission chaired by Chief Justice Wee Chong Jin advocated entrenching the right to vote within the Constitution, but this was not taken up by the Parliament of the day. When this proposal was repeated during the 2009 parliamentary debate, the Government took the view that such entrenchment was unnecessary.
Non-resident citizen voting is citizens voting in elections according to their citizenship while not residing in the country of the election. As of 2020 a total of 141 countries grant non-residents such as emigrants or expatriates the right to non-resident citizen voting. There is considerable variation across countries in regard to voter eligibility, voting modalities, i.e. voting in person at diplomatic missions or other physical locations, by post or online, which elections nonresident citizens may vote in, i.e. elections of the national legislature, executive elections, referendums, or sub-national elections, and how nonresident citizen voters are represented. The number of countries enfranchising nonresident citizens accelerated significantly in the 1990s. Social scientists have advanced a number of claims about the causes and consequences of this development and debated its normative implications or pros and cons of nonresident citizen voting.
Absentee voting in the United Kingdom is allowed by proxy or post for any elector.
