S Tel Private Limited was a GSM based cellular operator in India. It was owned jointly by Chinakannan Sivasankaran. (51%) and Bahrain Telecommunications (49%). [1] On 2 February 2012 Supreme Court of India cancelled all 122 spectrum licences granted during the tenure of former communications minister A Raja. Six licences of S Tel were cancelled, and Batelco sold its stake in S Tel. The sale was completed in late 2012. [2]

Controversy

License cancelled by Supreme Court

On 2 February 2012, The Supreme Court of India cancelled all 122 spectrum licences granted during the tenure of former communications minister A Raja, including the 6 licenses granted to S Tel. [3] [4] The Supreme Court of India also imposed a fine of 50 lakh on S Tel. [5] [6]

Batelco sells stake

On 8 February 2012, a few days after The Supreme Court ruling, Batelco sold its 42.7% share of S Tel to Sky City Foundation Ltd of India for 65.8 million Bahraini dinar (US$174.5 million). [7] [8] Batelco's Group Chief Executive Shaikh Mohamed bin Isa Al Khalifa said in a statement, "BMIC Limited, a 100 per cent Batelco-owned subsidiary company, entered into an agreement, in the fourth quarter of 2011 to sell its 42.7 per cent stake in S Tel for USD 174.5 million to its Indian partner, Sky City Foundation Limited". [3] The sale was to be completed by the end of October 2012. [9]

Current status

S Tel services is no longer available in India following the cancellation of its six UAS licenses on 17 February 2012. On 29 February 2012 it was reported that S Tel boss Sivasankaran wrote to Manmohan Singh, former Prime Minister of India, demanding Rs. 1700 Crore investment while offering to surrender its licenses. The Comptroller and Auditor General (CAG) of India is the Constitutional Authority in India, established under Article 148 of the Constitution of India. He is empowered to Audit all receipts and expenditure of the Government of India and the State Governments, including those of autonomous bodies and corporations substantially financed by the Government. T. R. Baalu Indian politician

Thalikkottai Rajuthevar Baalu, also known as T. R. Baalu, is an Indian Tamil politician. T.R. Baalu did his B.Sc. from New College, Chennai in Madras University and diploma in drafting engineering drawings from Central polytechnic Chennai. He is currently the MP of Lok Sabha of the Sriperumbudur constituency. He is a member of Lok Sabha of India and has been elected five times since 1996. He is an important leader of the DMK party and is known for political loyalty having been in the party since 1957. He served as the Principal Secretary of the party from August 2018 to January 2020. He now serves as the Treasurer of DMK, elected unopposed on 3 September 2020.

Indira Jaising is an Indian lawyer who is noted for her legal activism in promoting human right causes. In 2018 she was ranked 20th in the list of 50 Greatest Leaders of the World by Fortune magazine. She also runs an NGO with the name of Lawyers' Collective, the license of which was permanently cancelled by the Home Ministry for violations of Foreign Contribution Regulation Act. The central government of India accused the NGO of using foreign funds in a manner not mentioned in the objectives of the NGO. However, the Bombay High Court has passed the order to de-freeze the domestic accounts of her NGO. However, this is a small relief as the case still continues in the Supreme Court of India.

MTS India provided wireless voice, broadband Internet, messaging and data services in India. On 1 November 2017, MTS India merged with Reliance communication.

Vinod Rai

Vinod Rai is a former IAS officer who served as the 11th Comptroller and Auditor General of India. He assumed office on 7 January 2008 till 22 May 2013. He is the current chairman of UN Panel of External Auditors and Honorary Advisor to the Railways and a member of the Railway Kaya Kalp Council. He holds a master's degree in Economics from the University of Delhi, and Masters in Public Administration from Harvard University. He is widely considered as symbol of the anti-corruption movement and is credited with having turned the office of CAG into a powerful force for accountability and transparency in contemporary India. The most prominent actions of CAG under Vinod Rai was the report that stated that the 2G spectrum allocation by the government had caused a loss of over 1 lac crores to the government. Several ministers of the UPA had to resign, some were arrested. It is widely believed that this report by CAG was the single most important setback for the then UPA government. After years of hearing at the CBI court in Delhi, the judge acquitted all the accused saying not a single piece of admissible evidence had been put before the court. Vinod Rai was made the chairman of the Banking Board of India by the new Government of NDA by then. On 30 January 2017, the Supreme Court of India appointed Rai as the interim president of the Board of Control for Cricket in India (BCCI). He is the head of advisory commission of Kerala Infrastructure and Investment Board (KIIFB), appointed by Government of Kerala.

Videocon Telecom

Videocon Telecommunications Limited, formerly Videocon Mobile Services, was an Indian cellular service provider that offered GSM mobile services in India under the brand name Videocon. The company was a subsidiary of the Videocon Group, and was headquartered at Gurgaon, Haryana. Videocon launched its services on 7 April 2010 in Mumbai. At its peak, Videocon held licences to provide mobile services in 18 out of 22 telecom circles of India. However, Videocon launched commercial services only in 11 out of the 18 circles it held licences in. Following the 2G spectrum case, the Supreme Court cancelled 122 licences issued by the Indian Government in 2008, including 21 licences belonging to Videocon.

Shahid Usman Balwa is an entrepreneur based in Mumbai, Maharashtra, India. He is one of the promoters of Mumbai-based DB Group. Arrested in 2011, he was granted bail for his alleged role in 2G spectrum case. On 21 December 2017, a Supreme Court appointed Special CBI Court acquitted him of all charges relating to his role in this case.

In India, a binding decision of the Supreme Court/High Court can be reviewed in Review Petition. The parties aggrieved on any order of the Supreme Court on any apparent error can file a review petition. Taking into consideration the principle of stare decisis, courts generally do not unsettle a decision, without a strong case. This provision regarding review is an exception to the legal principle of stare decisis.

Asok Kumar Ganguly

Justice Asok Kumar Ganguly is an Indian jurist. He served as the Chairman of the West Bengal Human Rights Commission and as a Judge of the Supreme Court of India who delivered judgements in some high-profile cases like the 2G spectrum case.

Dr Khaleel Chishty is a Pakistani citizen who was convicted and sentenced to life imprisonment in January 2011 for killing a man after a fight in the Indian town of Ajmer in 1992. The trial lasted 18-years during which time he was kept under house arrest in his ancestral home in Ajmer.

G.S. Singhvi is a retired judge of the Supreme Court of India. He retired on 11 December 2013.
