Solem v. Bartlett, 465 U.S. 463 (1984), was a United States Supreme Court case involving Indian country jurisdiction in the United States that decided that opening up reservation lands for settlement by non-Indians does not constitute the intent to diminish reservation boundaries. Therefore, reservation boundaries would not be diminished unless specifically determined through acts of Congress. [1] [2]
The Cheyenne River Act of 1908 gave the Secretary of Interior power “to sell and dispose of” 1,600,000 acres (6,500 km2) of the Cheyenne River Sioux reservation to non-Indians for settlement. The profit of the sale was to go to the United States Treasury as a “credit” for the Indians to have tribal rights on the reservation (465 U.S. 463). [1]
In 1979, Sioux tribe member John Bartlett was charged by the State of South Dakota with attempted rape. The crime had occurred on the area of the reservation that had been opened to settlement in 1908 with Cheyenne River Act (465 U. S. 465). Bartlett pleaded guilty and was sentenced to ten years in a state penitentiary, but contended that his crime actually took place in Indian country because the Act did not reduce the reservation but instead only opened it to settlement, therefore the jurisdiction belonged to the tribe, not the state (465 U.S. 465). [1]
The Court recognized that large areas in the west had been set aside as Indian reservations in the late 19th century, and that later, individual allotments were designated to Indians, with the excess land being sold to non-Indians. The Cheyenne River Act was a piece of legislation that dealt specifically with the excess land from the Cheyenne Sioux Reservation, and has its own statutory language. Usually, States held jurisdiction over unallotted open lands when the Act declared that the area is no longer considered reservation land. Otherwise, federal, state, and tribal authorities share jurisdiction of the open area. The Court stated that designated reservation land remains a part of the reservation until Congress clearly diminishes its boundaries.
The Court held that the Act only gives the Secretary of State permission to “sell and dispose” of lands, not to diminish the reservation boundaries (465 U.S. 466). [1] Therefore, the Cheyenne River Sioux reservation was not diminished by the Act and the area on which Bartlett committed his crime was within Indian country jurisdiction.
The ruling in Solem v. Bartlett established three principles to measure Congress’s intent to diminish a reservation.
First, only Congress has the power to diminish reservation boundaries. In Solem, it is stated that “once a block of land is set aside for an Indian reservation and no matter what happens to the title of the individual plots within the area, the entire block retains its reservation status until Congress explicitly states otherwise”. [3] : 86 Therefore, the allotment policy does not designate a change in reservation boundaries.
It is also stated that the intent to diminish will not be lightly inferred by a federal court. [3] : 87 Since only Congress has the power to diminish a reservation and the allotment policy never eliminated reservations, the language of any surplus land acts must specifically state the intent to diminish a reservation or make a blatant statement from which the intent to diminished is presumed. [3] : 87
Other factors can also determine whether reservation lands have been reduced by an act, such as the legislative history. For example, subsequent treatment of the land by Congress can specify whether the land is still considered a part of the reservation or not. [3] : 87 If the treatment of an area strongly suggests that Congress or other governmental groups view the reservation land as diminished, yet there is no specific statutory language deeming it so, it can still be considered reduced. [3] : 87 However, when both the Act and the legislative history are unsuccessful in providing proof that supports the idea of diminishment, the court holds that the reservation is not diminished [3] : 88
The important precedents set in the decision, Solem v. Bartlett, were heavily relied upon later on to decide two other cases involving Indian country jurisdiction. In Hagen v. Utah, the court, using the factors determined in Solem, upheld that Congress had intentionally diminished tribal lands with surplus land acts in the Uintah Reservation. [4] : 129 The court determined that the specific language in Hagen, which addressed that the excess lands “be restored to the public domain” clearly indicated that the land was not to remain reservation land as in Solem, but instead reduce the boundaries of the reservation. [4] : 129 In another similar case, South Dakota v. Yankton Sioux Tribe, the court echoed similar sentiments, stating that Congress used clear statutory language to diminish the boundaries of the Yankton Sioux Reservation and that the agreement to pay for these lands further supported that they had been ceded through the statute. [4] : 130
The tests of Solem as to whether Congress has property disestablished the reservation boundary, arose in Sharp v. Murphy , a case involving the reservations of the Five Civilized Tribes that cover most of the eastern half of the state of Oklahoma, as to whether to determine if a person accused of murder should be under jurisdiction of the state if the reservations were disestablished or the federal system otherwise. The United States Court of Appeals for the Tenth Circuit used Solem to find that Congress did not explicitly disestablish these reservations. [5] The decision of the Appeals Court was upheld by the United States Supreme in light of that courts judgement in McGirt v. Oklahoma (2020). [6] This means that Patrick Murphy could be retried in federal court. [7]
Indian Territory and the Indian Territories are terms that generally described an evolving land area set aside by the United States government for the relocation of Native Americans who held original Indian title to their land as an independent nation-state. The concept of an Indian territory was an outcome of the U.S. federal government's 18th- and 19th-century policy of Indian removal. After the American Civil War (1861–1865), the policy of the U.S. government was one of assimilation.
Tribal sovereignty in the United States is the concept of the inherent authority of Indigenous tribes to govern themselves within the borders of the United States.
An American Indian reservation or Native American reservation is an area of land held and governed by a U.S. federal government-recognized Native American tribal nation, whose government is autonomous, subject to regulations passed by the United States Congress and administered by the United States Bureau of Indian Affairs, and not to the U.S. state government in which it is located. Some of the country's 574 federally recognized tribes govern more than one of the 326 Indian reservations in the United States, while some share reservations, and others have no reservation at all. Historical piecemeal land allocations under the Dawes Act facilitated sales to non–Native Americans, resulting in some reservations becoming severely fragmented, with pieces of tribal and privately held land being treated as separate enclaves. This intersection of private and public real estate creates significant administrative, political, and legal difficulties.
The Great Sioux Reservation is an Indian reservation created by the United States through treaty with the Sioux, principally the Lakota, who dominated the territory before its establishment. In the Fort Laramie Treaty of 1868, the reservation included lands west of the Missouri River in South Dakota and Nebraska, including all of present-day western South Dakota. The treaty also provided rights to roam and hunt in contiguous areas of North Dakota, Montana Wyoming, and northwest Colorado.
The Uintah and Ouray Indian Reservation is located in northeastern Utah, United States. It is the homeland of the Ute Indian Tribe, and is the largest of three Indian reservations inhabited by members of the Ute Tribe of Native Americans.
The Major Crimes Act is a law passed by the United States Congress in 1885 as the final section of the Indian Appropriations Act of that year. The law places certain crimes under federal jurisdiction if they are committed by a Native American in Native territory. The law follows the 1817 General Crimes Act, which extended federal jurisdiction to crimes committed in Native territory but did not cover crimes committed by Native Americans against Native Americans. The Major Crimes Act therefore broadened federal jurisdiction in Native territory by extending it to some crimes committed by Native Americans against Native Americans. The Major Crimes Act was passed by Congress in response to the Supreme Court of the United States's ruling in Ex parte Crow Dog that overturned the federal court conviction of Brule Lakota sub-chief Crow Dog for the murder of principal chief Spotted Tail on the Rosebud Indian Reservation.
Hodel v. Irving, 481 U.S. 704 (1987), is a case in which the U.S. Supreme Court held that a statute ordering the escheat of fractional interests in real property which had been bequeathed to members of the Oglala Sioux tribe was an unconstitutional taking which required just compensation.
The Omaha Reservation of the federally recognized Omaha tribe is located mostly in Thurston County, Nebraska, with sections in neighboring Cuming and Burt counties, in addition to Monona County in Iowa. As of the 2020 federal census, the reservation population was 4,526. The tribal seat of government is in Macy. The villages of Rosalie, Pender and Walthill are located within reservation boundaries, as is the northernmost part of Bancroft. Due to land sales in the area since the reservation was established, Pender has disputed tribal jurisdiction over it, to which the Supreme Court ruled unanimously in 2016 that "the disputed land is within the reservation’s boundaries."
Indian country jurisdiction, or the extent which tribal powers apply to legal situations in the United States, has undergone many drastic shifts since the beginning of European settlement in America. Over time, federal statutes and Supreme Court rulings have designated more or less power to tribal governments, depending on federal policy toward Indians. Numerous Supreme Court decisions have created important precedents in Indian country jurisdiction, such as Worcester v. Georgia, Oliphant v. Suquamish Tribe, Montana v. United States, and McGirt v. Oklahoma.
South Dakota v. Bourland, 508 U.S. 679 (1993), was a case in which the Supreme Court of the United States held that Congress specifically abrogated treaty rights with the Cheyenne River Sioux Tribe as to hunting and fishing rights on reservation lands that were acquired for a reservoir.
An Organic Act is a generic name for a statute used by the United States Congress to describe a territory, in anticipation of being admitted to the Union as a state. Because of Oklahoma's unique history an explanation of the Oklahoma Organic Act needs a historic perspective. In general, the Oklahoma Organic Act may be viewed as one of a series of legislative acts, from the time of Reconstruction, enacted by Congress in preparation for the creation of a united State of Oklahoma. The Organic Act created Oklahoma Territory, and Indian Territory that were Organized incorporated territories of the United States out of the old "unorganized" Indian Territory. The Oklahoma Organic Act was one of several acts whose intent was the assimilation of the tribes in Oklahoma and Indian Territories through the elimination of tribes' communal ownership of property.
Oklahoma Tax Commission v. Sac & Fox Nation, 508 U.S. 114 (1993), was a case in which the Supreme Court of the United States held that absent explicit congressional direction to the contrary, it must be presumed that a State does not have jurisdiction to tax tribal members who live and work in Indian country, whether the particular territory consists of a formal or informal reservation, allotted lands, or dependent Indian communities.
United States v. Mitchell, 463 U.S. 206 (1983), was a case in which the Supreme Court of the United States held that the United States is accountable in money damages for alleged breaches of trust in connection with its management of forest resources on allotted lands of the Quinault Reservation.
Seymour v. Superintendent of Wash. State Penitentiary, 368 U.S. 351 (1962), was a case in which the Supreme Court of the United States that the state of Washington did not have jurisdiction to try an Indian for a crime committed within the boundaries of the Colville Indian Reservation, even if the crime was committed on land now owned by a non-Indian.
United States v. John, 437 U.S. 634 (1978), was a case in which the Supreme Court of the United States held that lands designated as a reservation in Mississippi are "Indian country" as defined by statute, although the reservation was established nearly a century after Indian removal and related treaties. The court ruled that, under the Major Crimes Act, the State has no jurisdiction to try a Native American for crimes covered by that act that occurred on reservation land.
Both the Oklahoma and Indian Territories contained suzerain Indian nations that had legally established boundaries. The US federal government allotted collective tribal landholdings through the allotment process before the establishment of Oklahoma as a state in 1907. Tribal jurisdictional areas replaced the tribal governments, with the exception of the Osage Nation. As confirmed by the Osage Nation Reaffirmation Act of 2004, the Osage Nation retains mineral rights to their reservation, the so-called "Underground Reservation".
Nebraska v. Parker, 577 U.S. 481 (2016), was a United States Supreme Court case in which the Court held that Congress's 1882 Act did not diminish the Omaha Indian Reservation. The disputed land is within the reservation's boundaries.
Diminishment is the legal process by which the United States Congress can reduce the size of an Indian reservation.
Sharp v. Murphy, 591 U.S. ___ (2020), was a Supreme Court of the United States case of whether Congress disestablished the Muscogee (Creek) Nation reservation. After holding the case from the 2018 term, the case was decided on July 9, 2020, in a per curiam decision following McGirt v. Oklahoma that, for the purposes of the Major Crimes Act, the reservations were never disestablished and remain Indian country.
McGirt v. Oklahoma, 591 U.S. ___ (2020), was a landmark United States Supreme Court case which held that the domain reserved for the Muscogee Nation by Congress in the 19th century has never been disestablished and constitutes Indian country for the purposes of the Major Crimes Act, meaning that the State of Oklahoma has no right to prosecute American Indians for crimes allegedly committed therein. The Oklahoma Court of Criminal Appeals applied the McGirt rationale to rule nine other Indigenous nations had not been disestablished. As a result, almost the entirety of the eastern half of what is now the State of Oklahoma remains Indian country, meaning that criminal prosecutions of Native Americans for offenses therein falls outside the jurisdiction of Oklahoma’s court system. In these cases, jurisdiction properly vests within the Indigenous judicial systems and the federal district courts under the Major Crimes Act.
