A Targeted Employment Area (TEA) is a region of the United States for which the threshold for investment for an investor to be eligible for the EB-5 visa is $900,000 (as opposed to the usual $1,800,000 threshold for the US as a whole). There are two kinds of TEAs: high unemployment areas (defined as areas having unemployment more than 150% the national average calculated by the Bureau of Labor Statistics) and rural areas (defined as areas outside a Metropolitan Statistical Area). Definition

There are two kinds of TEAs recognized by the USCIS: rural areas and high unemployment areas. [2]

Rural areas

An area can be designated as a TEA if, at the time of application, it is a rural area. This is defined as an area that is not within either a metropolitan statistical area (MSA) (as designated by the Office of Management and Budget) or the outer boundary of any city or town having a population of 20,000 or more.

High unemployment areas

An area can be designated as a TEA based on high unemployment if it has experienced unemployment of at least 150% of the national average rate as determined by the Bureau of Labor Statistics. In 2018, this average was 3.9%, so currently, to qualify as a TEA based on high unemployment an area must have an unemployment rate of at least 5.9% (3.9 * 150%).

TEA determination

If the location of the proposed new business is not already determined to be a TEA, the investor has the option to gather the relevant publicly available state or federal statistics on their own and submit it with their petition for USCIS to have a new TEA determination made. [3]

There is no centralized list of targeted employment areas, but state agencies in various states maintain their own lists or criteria for identifying TEAs, as well as information on local unemployment rates that can be cited in applications. Various US states facilitate the process by allowing people to apply for certification for particular areas being designated as TEAs. USCIS defers to state determinations but periodically reviews the criteria used by states to confirm that they comply with its guidelines. [4]

In addition, there are privately collected information sources on unemployment by census tract, including interactive maps, that can help investors identify TEAs. [5] [6]

TEA designations in various states

Hawaii

According to Hawaii's official website, the following parts of the state are TEAs: [7]

California

In California, the investor may petition the state government for designating a particular subdivision of the area as an area of high unemployment (over 150% the national average). [8] The California Department of Housing and Community Development provides a list of street ranges and census tracts for TEAs. [9]

Florida

The state of Florida maintains a list of Targeted Employment Areas, of which there are currently 33. [10] [11]

Rural areas included are Bradford County, Calhoun County, Citrus County, Columbia County, DeSoto County, Dixie County, Franklin County, Glades County, Gulf County, Hamilton County, Hardee County, Hendry County, Jackson County, Lafayette County, Levy County, Liberty County, Madison County, Monroe County (excluding Key West), Okeechobee County, Putnam County, Sumter County, Suwannee County, Taylor County, Union County, Walton County, and Washington County.

The list of non-rural high-unemployment areas is subject to regular change based on fluctuations in unemployment rate. The list in August 2012 included Palm Coast metropolitan statistical area (Flagler County), Hernando County, City of Hialeah (in Miami-Dade County), City of Miami Gardens (in Miami-Dade County), and City of Fort Pierce (in St. Lucie County).

Texas

The city of Austin in Texas listed 31 designated TEAs and also provided an unemployment cutoff of 11.1% (150% of the national unemployment rate of 7.4%, as determined by the Bureau of Labor Statistics) for non-rural areas to qualify as TEAs. [12]

Washington

Washington, the US state, maintains its own list of TEAs. [13]

Minnesota

The state of Minnesota commissioned a study by the Carlson Consulting Enterprise to better understand how the state could leverage the EB-5 investor program to drive employment growth in the state, particularly in high-unemployment areas. [14] The program has also been highlighted as a way to improve employment for black residents on North Minneapolis (a designated TEA) by matching them with EB-5 investors from Asia. [15]

Reception

A 2011 article in the New York Times claimed that areas within New York had been strangely gerrymandered so that relatively upscale and wealthy locations could qualify for TEA status, and also noted pushback from locals against an EB-5-funded program for a proposed China City program in upstate New York. [16] [17] Similarly, EB-5-funded construction projects by Marriott, including some in Washington D.C., have met with criticism for how they have sought TEA status for wealthy and well-off regions, contradicting the original spirit of the TEA designation. [18] [19]

The Washington City Paper cited the American Immigration Lawyers Association on the ease of having your area designated as a TEA, writing: "The ease of qualifying for TEAs is such an open secret that the American Immigration Lawyers Association fact sheet on EB-5 states simply, "Each immigrant investor must create 10 US jobs with an investment of $500,000 or more"—rather than the $1 million required outside of TEAs." Similar skepticism about TEAs was expressed in an article in Fortune , that said: "One essential part of gaining USCIS approval was crafting an acceptable "targeted employment area," or TEA. The EB-5 law requires investment in a district that is either rural or has a jobless rate that is 150% of the national average. But after years of industry pressure, it's now USCIS policy to automatically accept any state designation of a TEA, even though states routinely approve gerrymandered districts that tack on distant high-unemployment tracts to allow EB-5 endeavors in wealthy areas." Green card Lawful permanent residency in the United States

A green card, known officially as a permanent resident card, is an identity document which shows that a person has permanent residency in the United States. Green card holders are formally known as lawful permanent residents (LPRs). As of 2019, there are an estimated 13.9 million green card holders of whom 9.1 million are eligible to become United States citizens. Approximately 65,000 of them serve in the U.S. Armed Forces.

The H-1B is a visa in the United States under the Immigration and Nationality Act, section 101(a)(15)(H) that allows U.S. employers to temporarily employ foreign workers in specialty occupations. A specialty occupation requires the application of specialized knowledge and a bachelor's degree or the equivalent of work experience. The duration of stay is three years, extendable to six years; after which the visa holder may need to reapply. Laws limit the number of H-1B visas that are issued each year: 188,100 new and initial H-1B visas were issued in 2019. Employers must generally withhold Social Security and Medicare taxes from the wages paid to employees in H-1B status.

Priority date is a United States immigration concept – it is the date when a principal applicant first reveals his or her intent of immigration to the US government. For family-sponsored applicants, the priority date is the date an immigration petition, filed on behalf of him or her, is received by the United States Citizenship and Immigration Services (USCIS). For employment-based immigration beneficiaries, the priority date is the date an immigration petition is filed at USCIS, under categories where a labor certification is not required, or when the United States Department of Labor receives a labor certification application, under categories where a labor certification is required. In all cases, the priority dates are not established until USCIS approves the immigration petition. The date establishes one's place in the queue for a family-sponsored or employment-based or permanent residency permit application.

U.S. Citizenship and Immigration Services (USCIS) is an agency of the United States Department of Homeland Security (DHS) that administers the country's naturalization and immigration system. It is a successor to the Immigration and Naturalization Service (INS), which was dissolved by the Homeland Security Act of 2002 and replaced by three components within the DHS: USCIS, Immigration and Customs Enforcement (ICE), and Customs and Border Protection (CBP).

An H-2A visa allows a foreign national worker into the United States for temporary agricultural work. There are several requirements of the employer in regard to this visa. The H-2A temporary agricultural program establishes a means for agricultural employers who anticipate a shortage of domestic workers to bring non-immigrant foreign workers to the U.S. to perform agricultural labor or services of a temporary or seasonal nature. In 2015 there were approximately 140,000 total temporary agricultural workers under this visa program. Terms of work can be as short as a month or two or as long as 10 months in most cases, although there are some special procedures that allow workers to stay longer than 10 months. All of these workers are covered by U.S. wage laws, workers' compensation and other standards; additionally, temporary workers and their employers are subject to the employer and/or individual mandates under the Affordable Care Act. Because of concern that guest workers might be unfairly exploited the U.S. Department of Labor Wage and Hour Division is especially vigilant in auditing and inspecting H-2A employers. H-2A employers are the only group of employers who are required to pay inbound and outbound transportation, free housing, and provide meals for their workers. H-2A agricultural employers are among the most heavily regulated and monitored employers in the United States. Unlike other guest worker programs, there is no cap on the number of H-2A visas allocated each year.

Visa policy of the United States Policy on permits required to enter the United States and its unincorporated territories

The visa policy of the United States consists of the requirements for foreign nationals to travel to, enter, and remain in the United States. Visitors to the United States must obtain a visa from one of the U.S. diplomatic missions unless they come from one of the visa-exempt or Visa Waiver Program countries. The same rules apply for travel to all U.S. states, the District of Columbia, Puerto Rico and the U.S. Virgin Islands, as well as to Guam and the Northern Mariana Islands with additional waivers, while similar but separate rules apply to American Samoa.

An H-4 visa is a United States visa issued to dependent family members of H-1B, H-1B1, H-2A, H-2B, and H-3 visa holders to allow them to travel to the United States to accompany or reunite with the principal visa holder. A dependent family member is a spouse or unmarried child under the age of 21. If a dependent of an H-1B, H-1B1, H-2A, H-2B, or H-3 worker is already in the United States, they can apply for H-4 immigration status by filing Form I-539 for change of status with United States Citizenship and Immigration Services (USCIS).

The United States EB-5 visa, employment-based fifth preference category or EB-5 Immigrant Investor Visa Program, created in 1990 by the Immigration Act of 1990, provides a method for eligible Immigrant Investors to become lawful permanent residents—informally known as "green card" holders—by investing substantial capital to finance a business in the United States that will employ at least 10 American workers. The current investment amount is controversial as USCIS has not updated their website nor issued guidance in light of a federal judge, in June 2021, striking down the 2019 EB-5 “modernization” regulation. The judge found the 2019 regulation which increased the investment threshold from $500,000 to $900,000 invalid as it was enacted by government officials not properly appointed to their post in violation of the 1998 Federal Vacancies Reform Act (FVRA).

EB-2 is an immigrant visa preference category for United States employment-based permanent residency, created by the Immigration Act of 1990. The category includes "members of the professions holding advanced degrees or their equivalent", and "individuals who because of their exceptional ability in the sciences, arts, or business will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, and whose services in the sciences, arts, professions, or business are sought by an employer in the United States". Applicants must generally have an approved labor certification, a job offer, and their employer must have filed an Immigrant Petition for Alien Worker with the USCIS.

Immigrant investor programs are programs that allow individuals to obtain residence or citizenship of a country in return for making qualifying investments.

The New York City Regional Center (NYCRC) secures capital for real estate and infrastructure projects throughout New York City. Established in 2008, NYCRC has provided over $1.5 billion of capital to help fund a broad spectrum of economic development projects in Brooklyn, Queens, Manhattan, and the Bronx. These projects have successfully utilized NYCRC financing to assist in the construction of over 3.5 million square feet of new development and renovation as well as infrastructure upgrades resulting in thousands of new jobs for New Yorkers.

EB-3 is a visa preference category for United States employment-based permanent residency. It is intended for "skilled workers", "professionals", and "other workers". Those are prospective immigrants who don't qualify for the EB-1 or EB-2 preferences. The EB-3 requirements are less stringent, but the backlog may be longer. Unlike persons with extraordinary abilities in the EB-1 category, EB-3 applicants require a sponsoring employer. There is no "self-petition" category.

Border Security, Economic Opportunity, and Immigration Modernization Act of 2013

The Border Security, Economic Opportunity, and Immigration Modernization Act of 2013 was a proposed immigration reform bill introduced by Sen. Charles Schumer (D-NY) in the United States Senate. The bill was co-sponsored by the other seven members of the "Gang of Eight", a bipartisan group of U.S. Senators who wrote and negotiated the bill. It was introduced in the Senate on April 16, 2013 during the 113th United States Congress.

The American Competitiveness in the 21st Century Act (AC21) was an act passed by the government of the United States in October 2000, pertaining to immigration to the United States. It was a complement to the American Competitiveness and Workforce Improvement Act that had been passed in 1998. The focus of AC21 was to change rules related to portability and caps for the H-1B visa to increase the effective number of visas available and make it easier for workers on those visas to switch jobs. Although the language of the Act references the Immigration and Naturalization Service (INS), the INS would soon be restructured and the functions of the INS referenced in AC21 would be handled by United States Citizenship and Immigration Services.

Premium Processing Service refers to an optional premium service offered by the United States Citizenship and Immigration Services to employers filing Form I-129 or Form I-140. To avail of the service, the employer needs to file Form I-907 and include a fee that is $1,500 for the H-2B and R classifications and $2,500 for all others.

China City of America is a multi-phased construction project planned for the town of Thompson, Sullivan County, in the Catskill Mountains region of the U.S. state of New York. The current project, Thompson Education Center (TEC), is a proposed for-profit college for foreign students, situated in a 573-acre parcel which borders a state-protected wetland.

The United States Citizenship and Immigration Services is a subdivision of the U.S. Department of Homeland Security that adjudicates petitions and processes forms related to citizenship, residency, and various kinds of authorization to live and work in the United States. Many of the forms it processes are prerequisites for people outside the United States who are not United States citizens or permanent residents to obtaining visas to enter the United States in the specified status. Many of the USCIS immigration forms have long processing times. The USCIS offers some guidance regarding expected processing times through its website and through reports. Special Immigrant Juvenile Status (SIJS) is a special way for minors currently in the United States to adjust status to that of Lawful Permanent Resident despite unauthorized entry or unlawful presence in the United States, that might usually make them inadmissible to the United States and create bars to Adjustment of Status. The key criterion for SIJS is abuse, neglect, or abandonment by one or both parents.

Form I-140 I-140, Immigrant Petition for Alien Worker

Form I-140, Immigrant Petition for Alien Worker is a form submitted to the United States Citizenship and Immigration Service (USCIS) by a prospective employer to petition an alien to work in the US on a permanent basis. This is done in the case when the worker is deemed extraordinary in some sense or when qualified workers do not exist in the US. The employer who files is called the petitioner, and the alien employee is called the beneficiary; these two can coincide in the case of a self-petitioner. The form is 6 pages long with a separate 10-page instructions document as of 2016. It is one of the USCIS immigration forms.

EB-5 Reform and Integrity Act

The EB-5 Reform and Integrity Act is bipartisan legislation introduced in 2019 and again in 2021 in Congress that would reform the EB-5 Immigrant Investor federal program, which provides green cards to certain foreign investors. The Senate bill was authored by U.S. Senators Chuck Grassley (R-IA) and Patrick Leahy (D-VT). In the House, it was authored by U.S. Rep. Greg Stanton (R-AZ). The legislation was written after several high-profile problems with fraud misappropriation of investor funds put the program's integrity in question. The EB-5 Reform and Integrity Act, if signed into law, would reform the rules and regulations for the approval of green cards to foreign investors and attempt to root out "bad actors" at regional centers, which are public-private organizations that allocate the program's revenues to local public works and investment projects.
