Edvard William Alstergren AO (born 12 April 1962), [1] commonly known as Will Alstergren, [3] [4] is an Australian jurist who has held the positions of Chief Justice of the Family Court of Australia since 10 December 2018,and Chief Judge of the Federal Circuit Court of Australia since 13 October 2017.
Alstergren attended Geelong Grammar School,Scotch College,Melbourne [5] and Melbourne Grammar School. [6] He graduated with Bachelor of Arts and a Bachelor of Laws degrees from the University of Melbourne in 1991,where he resided at Trinity College and later completed a Master of Laws in 2010. [7] He commenced practising as a barrister in Melbourne in 1991,specialising in commercial law,tax law,industrial law and family law,and was appointed Queen's Counsel in 2012. [8] In 2013 he was Chairman of the Victorian Bar Association,and in 2017 was the Chairman of the Australian Bar Association. [7]
On 13 October 2017,Alstergren was appointed as the Chief Judge of the Federal Circuit Court of Australia,replacing John Pascoe (who was appointed as Chief Justice of the Family Court of Australia). Alstergren was given a concurrent commission as a Justice of the Family Court of Australia. [9]
When Pascoe reached the statutory retirement age from the Family Court a year later,Alstergren was appointed to succeed him as Chief Justice of the Family Court,effective from 10 December 2018. He retained his appointment as Chief Judge of the Federal Circuit Court amongst a Government plan to merge both courts. [10] Robert McClelland was appointed as Deputy Chief Justice at the same time. Alstergren was the captain of the Australian bobsled team in 2002. [11] His team met the International Olympic Committee qualifying standards for the 2002 Winter Olympics,but the Australian Olympic Committee used higher standards and did not send them to compete. Alstergren said "We also beat half the teams currently in Salt Lake City,but unfortunately we couldn't meet the very high standard of the AOC". [12]
In 2022,Alstergren was appointed as an Officer of the Order of Australia for "distinguished service to the judiciary and to the law,and to sport as an administrator,coach and athlete". [13]
The Family Court of Australia was a superior Australian federal court of record which deals with family law matters,such as divorce applications,parenting disputes,and the division of property when a couple separate. Together with the Federal Circuit Court of Australia,it covered family law matters in all states and territories of Australia except for Western Australia,which has a separate Family Court. Its core function was to determine cases with the most complex law,facts and parties,to cover specialised areas in family law,and to provide national coverage as the national appellate court for family law matters.

The Federal Court of Australia is an Australian superior court which has jurisdiction to deal with most civil disputes governed by federal law,along with some summary and indictable criminal matters. Cases are heard at first instance mostly by single judges. In cases of importance,a full court comprising three judges can be convened upon determination by the Chief Justice. The Court also has appellate jurisdiction,which is mostly exercised by a Full Court comprising three judges,the only avenue of appeal from which lies to the High Court of Australia. In the Australian court hierarchy,the Federal Court occupies a position equivalent to the supreme courts of each of the states and territories. In relation to the other courts in the federal stream,it is superior to the Federal Circuit and Family Court of Australia for all jurisdictions except family law. It was established in 1976 by the Federal Court of Australia Act.

The Family Court of Western Australia is a state court that deals with family law. It was established by the passing of the Family Court Act and commenced operation in 1976. It is a state family court under section 41 of the Commonwealth Family Law Act 1975,and deals with the same family law matters as the Federal Circuit and Family Court of Australia,including divorce,marital property settlements,and child custody,and also adoption and surrogacy. Although funded by the Australian Government,it is the only state-based family court in Australia. The reason for the creation of the court as a state court was to bestow additional jurisdiction related to family law on the court,which were beyond the scope of federal power,such as de facto arrangements and adoptions.

The Federal Court of Bankruptcy was an Australian court that was established in 1930,pursuant to Chapter III of the Constitution. The jurisdiction in bankruptcy was shared with state courts. Judicial independence is regarded as one of the foundation values of the Australian legal system,such that the High Court held in 2004 that a court capable of exercising federal judicial power must be,and must appear to be,an independent and impartial tribunal. Former Chief Justice Gerard Brennan described judicial independence as existing "to serve and protect not the governors but the governed",albeit one that "rests on the calibre and the character of the judges themselves". Despite general agreement as to its importance and common acceptance of some elements,there is no agreement as to each of the elements of judicial independence.
