LOT Polish Airlines Flight 165 hijacking was the hijacking of a LOT Polish Airlines flight that occurred on 30 August 1978. [1] The hijackers from East Germany (GDR) were seeking political asylum in West Germany (FRG). The plane landed safely, and the primary hijacker was tried and convicted by a West German jury in the United States Court for Berlin and sentenced to time served, the nine months he had already served during pretrial detention. This was the only case heard before the United States Court for Berlin.
The GDR citizens Hans Detlef Alexander Tiede (aka Detlev Tiede) and his friend Ingrid Ruske and her 12-year-old daughter had travelled to Poland to meet with Ruske's West German boyfriend Horst Fischer, who had planned to bring forged West German papers to enable their escape by ferry to West German Travemünde. [2] However, Fischer did not turn up, and after four days of waiting for him Ruske and Tiede – not having any information as to his whereabouts – concluded that Fischer must have been arrested when travelling through East Germany. [2] Their conclusion was right, as Fischer had indeed been arrested and would later be sentenced to eight years of jail in East Germany for preparing their Republikflucht ("desertion from the Republic"), a crime under GDR law.
Ruske and Tiede then concluded that they were trapped and that prison awaited them if they returned to East Germany. [2] So they developed a plan to hijack a plane headed for East Berlin's Schönefeld Airport and force a landing at the U.S. Air Force base at Tempelhof Airport in West Berlin. [2] They bought a toy starting pistol at a Polish flea market, and then booked three tickets on LOT Polish Airlines Flight 165 from Gdańsk, Poland, to East Berlin. [3]
On 30 August 1978, Tiede and Ruske hijacked a Polish LOT Tupolev Tu-134 airliner with 62 passengers making Flight 165 from Gdańsk to East Berlin. Tiede, armed with the toy starting pistol, took a flight attendant hostage and succeeded in forcing the aircraft to land at Tempelhof Airport in West Berlin. [4]
Of the 62 passengers, there were 50 GDR citizens, 10 Polish citizens, a man from Munich and a woman from West Berlin. The passengers were given the opportunity to remain in West Berlin or to return to East Berlin. Not only did Tiede, Ruske and her daughter claim sanctuary in West Berlin, but so did another seven East Germans: [4] a radiology assistant from Erfurt, a couple with two children and a couple from Leipzig, although the radiology assistant returned to East Germany the next day. [5] The remaining passengers were interviewed and taken to East Berlin on a bus. [5]
The West German Federal Government was unwilling to prosecute Tiede and Ruske because of the West German policy of supporting the right of East Germans to flee oppression in the GDR. The United States government had successfully persuaded the East German government to sign a hijacking treaty. Consequently, the case was prosecuted in the United States Court for Berlin, with charges bought under the terms of The Hague Convention as incorporated into the laws of the United States, as the plane landed at a US Air Force base. US federal judge Herbert Jay Stern ruled that the defendants were entitled to be tried by a jury, as guaranteed by the Sixth Amendment to the United States Constitution, a procedure abolished in Germany by the Emminger Reform of 1924. [2] [4] The case against Tiede's co-defendant Ingrid Ruske was dismissed because she had not been notified of her legal rights before signing a confession. Tiede was acquitted on three charges, including hijacking and possession of a firearm, but convicted of taking a hostage. The jury found Tiede guilty of hostage-taking, but not guilty of acts against the safety of civil aviation, deprivation of liberty and battery. [2] The minimum sentence for hostage-taking was three years. [2] However, Stern sentenced Tiede to time served during pretrial detention, about nine months. [4] Stern accounted for Tiede's emergency situation and plight to face imprisonment in East Germany for attempted Republikflucht. [2]
The 1984 book which Judge Stern wrote about the event, Judgment in Berlin , was made into a movie of the same name in 1988. Martin Sheen depicted him. [7]

Aircraft hijacking is the unlawful seizure of an aircraft by an individual or a group. Dating from the earliest of hijackings, most cases involve the pilot being forced to fly according to the hijacker's demands. There have also been incidents where the hijackers have overpowered the flight crew, made unauthorized entry into the cockpit and flown them into buildings – most notably in the September 11 attacks – and in some cases, planes have been hijacked by the official pilot or co-pilot, such as with Ethiopian Airlines Flight 702.
Berlin Tegel "Otto Lilienthal" Airport was the primary international airport of Berlin, the capital of Germany. The airport was named after aviation pioneer Otto Lilienthal and was the fourth busiest airport in Germany, with over 24 million passengers in 2019. In 2016, Tegel handled over 60% of all airline passenger traffic in Berlin. The airport served as a base for Eurowings, Ryanair and easyJet. It featured flights to several European metropolitan and leisure destinations as well as some intercontinental routes. It was situated in Tegel, a section of the northern borough of Reinickendorf, eight kilometres northwest of the city centre of Berlin. Tegel Airport was notable for its hexagonal main terminal building around an open square, which made walking distances as short as 30 m (100 ft) from the aircraft to the terminal exit.
Berlin Tempelhof Airport was one of the first airports in Berlin, Germany. Situated in the south-central Berlin borough of Tempelhof-Schöneberg, the airport ceased operating in 2008 amid controversy, leaving Tegel and Schönefeld as the two main airports serving the city for another twelve years until both were replaced by Berlin Brandenburg Airport in 2020.
TWA Flight 847 was a regularly scheduled Trans World Airlines flight from Cairo to San Diego with en route stops in Athens, Rome, Boston, and Los Angeles. On the morning of June 14, 1985, Flight 847 was hijacked soon after take off from Athens. The hijackers demanded the release of 700 Shia Muslims from Israeli custody and took the plane repeatedly to Beirut and Algiers. Later Western analysis considered them members of the Hezbollah group, an allegation Hezbollah rejects.

Judgment in Berlin is a 1984 book by federal judge Herbert Jay Stern about a hijacking trial in the United States Court for Berlin in 1979, over which he presided.
In September 1970, members of the Popular Front for the Liberation of Palestine (PFLP) hijacked four airliners bound for New York City and one for London. Three aircraft were forced to land at Dawson's Field, a remote desert airstrip near Zarqa, Jordan, formerly Royal Air Force Station Zarqa, which then became PFLP's "Revolutionary Airport". By the end of the incident, one hijacker had been killed and one injury reported. This was the second instance of mass aircraft hijacking, after an escape from communist Czechoslovakia in 1950.
Uli Derickson was a German American flight attendant best known for her role in helping protect 152 passengers and crew members during the June 14, 1985, hijacking of TWA Flight 847 by militants with alleged links to Hezbollah.

Lufthansa Flight 181, a Boeing 737-230C jet airliner named Landshut, was hijacked on 13 October 1977 by four militants of the Popular Front for the Liberation of Palestine while en route from Palma de Mallorca, Spain, to Frankfurt am Main, West Germany. The hijacking aimed to secure the release of eleven notorious Red Army Faction leaders held in West German prisons and two Palestinians held in Turkey. This event was part of the so-called German Autumn, intended to increase pressure on the West German government. The hijackers diverted the flight to several locations before ending in Mogadishu, Somalia, where the crisis concluded in the early morning hours of 18 October 1977 under the cover of darkness. The West German counter-terrorism unit GSG 9, with ground support from the Somali Armed Forces, stormed the aircraft, rescuing all 87 passengers and four crew members. The captain of the flight was killed by the hijackers earlier in the ordeal.
Republikflucht was the colloquial term in the German Democratic Republic for illegal emigration to West Germany, West Berlin, and non-Warsaw Pact countries; the official term was Ungesetzlicher Grenzübertritt. Republikflucht applied to both the 3.5 million Germans who migrated legally from the Soviet occupation zone and East Germany before the Berlin Wall was built on 13 August 1961, and the thousands who migrated illegally across the Iron Curtain until 23 December 1989. It has been estimated that 30,000 people left the GDR per year between 1984 and 1988, and up to 300,000 per year before the construction of the Berlin Wall in 1961.

During the Cold War era (1945–1991), the West Berlin air corridors, also known as the Berlin corridors and control zone, were three regulated airways for civil and military air traffic of the Western Allies between West Berlin and West Germany passing over East Germany's territory. The corridors and control zone were physically centered on and under control of the all-Allied Berlin Air Safety Center (BASC) in West Berlin. The airspace within these corridors was used by US, UK and French-registered non-combat aircraft belonging to these countries' armed forces and airlines operated by pilots holding those countries' passports. In addition, it was also used by LOT Polish Airlines for regular scheduled services from Warsaw to London and Paris via Schönefeld Airport to the south of East Berlin.

Earlier in his career, Stern served as a United States district judge of the United States District Court for the District of New Jersey and as the United States Judge for Berlin.
Lufthansa Flight 592 was a regularly scheduled passenger flight from Frankfurt, Germany to Addis Ababa, Ethiopia that was hijacked on February 11, 1993. The Lufthansa-operated Airbus A310-300 was hijacked by Nebiu Zewolde Demeke, a 20-year old Ethiopian man seeking asylum who forced the pilot to fly to New York City's John F. Kennedy International Airport. The aircraft landed safely, and the gunman surrendered peacefully and without incident. He was charged with aircraft hijacking by a United States district court, and was sentenced to 20 years' imprisonment.
