The West Virginia Legislature is the state legislature of the U.S. state of West Virginia. A bicameral legislative body,the legislature is split between the upper Senate and the lower House of Delegates. It was established under Article VI of the West Virginia Constitution following the state's split from Virginia during the American Civil War in 1863. As with its neighbor and former constituent Virginia General Assembly,the legislature's lower house is also referred to as a "House of Delegates."
The West Virginia Senate is the upper house of the West Virginia Legislature. There are seventeen senatorial districts. Each district has two senators who serve staggered four-year terms. Although the Democratic Party held a supermajority in the Senate as recently as 2015,Republicans now dominate in the chamber,and hold 31 seats to the Democrats' three seats.

A member of the Democratic Party,he previously served in the West Virginia Senate from 1980 to 2011 and as president of the West Virginia Senate from 1995 to 2011. Tomblin became acting governor in November 2010 following Joe Manchin's election to the U.S. Senate. He won a special election in October 2011 to fill the unexpired term ending on January 14,2013,and was elected to a full term as governor in November 2012.
Evan Hollin Jenkins is an American politician and judge. He served as a justice of the Supreme Court of Appeals of West Virginia,joining the Court in 2018 and serving as chief justice in 2021. He resigned from the court on February 4,2022. He served as a U.S. Representative from West Virginia from 2015 to 2018. He is a Republican,having switched his party affiliation from Democratic in 2013.
Margaret Lee Workman is an American lawyer and a former justice of the Supreme Court of Appeals of West Virginia. Her 1988 election to the Supreme Court made her the first woman elected to statewide office in West Virginia and first female Justice on the Court.

John "JB" McCuskey is an American lawyer and politician who has served as West Virginia State Auditor since January 16,2017. A Republican,he was a member of the West Virginia House of Delegates representing District 35 from 2013 to 2017. On February 28,2023,he announced he would run for governor of West Virginia to attempt to succeed term limited governor Jim Justice. However,in July 2023 he announced that he would run for attorney general instead.

Mitchell Carmichael is an American politician. He is a former Republican member of the West Virginia Senate representing District 4 from 2012 until his defeat in 2020. Prior to his service in the Senate,Carmichael served in the West Virginia House of Delegates representing District 12 from 2000 through 2012. Carmichael was also a candidate for Governor of West Virginia in the 2011 West Virginia gubernatorial special election. As President of the state Senate from January 2017 to January 2021,he held the title Lieutenant Governor of West Virginia. After his defeat in 2020,Governor Jim Justice appointed Carmichael as West Virginia's economic development director.
Robert D. Beach is an American politician and a Democratic member of the West Virginia State Senate representing District 13 since January 2011. Beach was also the Democratic nominee for West Virginia Commissioner of Agriculture in 2020. Beach served consecutively in the West Virginia Legislature's House of Delegates from January 2001 until January 2011,and non-consecutively from his May 1998 appointment to fill the vacancy caused by the passing of his father,the late Delegate Robert C. Beach,until December 3,1998,in the West Virginia House of Delegates within the 44 Delegate District.

The primaries were held on May 10.

The impeachment of the Supreme Court of Appeals of West Virginia occurred on August 13,2018,when the West Virginia House of Delegates voted to impeach all five justices of the Supreme Court of Appeals of West Virginia for charges relating to corruption,overspending,and lack of oversight. Despite being threatened in other states at other times,this is the only time in United States history that the entire bench of the highest court of a state has been impeached.
Danielle Walker is an American politician and community activist,who served as a Democratic member of the West Virginia House of Delegates from 2018 until her resignation in 2023. Through her tenure,Walker was the only Black woman serving in the West Virginia Legislature. In June 2022,Walker was elected vice chair of the West Virginia Democratic Party,she later resigned as vice chairwoman after her selection as the leader of the American Civil Liberties Union of West Virginia.
