The Revised Philadelphia Plan, often called the Philadelphia Plan, required government contractors in Philadelphia to hire minority workers, under the authority of Executive Order 11246. Declared illegal in 1968, a revised version was successfully defended by the Nixon administration [1] and its allies in Congress against those who saw it as an illegal quota program. [2] US Department of Labor Assistant Secretary for Wage and Labor Standards Arthur Fletcher implemented the plan in 1969 based on an earlier plan developed in 1967 by the Office of Federal Contract Compliance and the Philadelphia Federal Executive Board. The plan required federal contractors to meet certain goals for the hiring of minority employees by specific dates in order to combat institutionalized discrimination on the part of specific skilled building trades unions. The plan was quickly extended to other cities.
In 1971, the Contractors Association of Eastern Pennsylvania challenged the plan and Executive Order 11246 by arguing that it was beyond the President's constitutional authority, that it was inconsistent with Titles VI and VII of the Civil Rights Act of 1964 and that it was inconsistent with the National Labor Relations Act. [3] The United States Court of Appeals for the Third Circuit rejected the challenges[ why? ] [4] [5] and the US Supreme Court declined to hear the case, Contractors Association of Eastern Pennsylvania v. Secretary of Labor, in October. [6]
Affirmative action refers to a set of policies and practices within a government or organization seeking to benefit marginalized groups. Historically and internationally, support for affirmative action has been justified by the idea that it may help with bridging inequalities in employment and pay, increasing access to education, and promoting diversity, social equity, and social inclusion and redressing alleged wrongs, harms, or hindrances, also called substantive equality.
Proposition 209 is a California ballot proposition which, upon approval in November 1996, amended the state constitution to prohibit state governmental institutions from considering race, sex, or ethnicity, specifically in the areas of public employment, public contracting, and public education. Modeled on the Civil Rights Act of 1964, the California Civil Rights Initiative was authored by two California academics, Glynn Custred and Tom Wood. It was the first electoral test of affirmative action policies in North America. It passed with 55% in favor to 45% opposed, thereby banning affirmative action in the state's public sector.
Peter Joseph Brennan was an American labor activist and politician who served as United States Secretary of Labor from February 2, 1973, until March 15, 1975, in the administrations of Presidents Nixon and Ford. Brennan had previously been the president of both the Building and Construction Trades Council of Greater New York and the Building and Construction Trades Council of New York, and he returned to the former position after leaving the Ford administration. He was a strong opponent of affirmative action measures to increase the number of minority construction workers. After organizing a demonstration in support of the Nixon administration that turned into the Hard Hat Riot of May 8, 1970, where construction workers violently attacked student anti-war protesters, Brennan was wooed by the Nixon administration as a potential supporter in the 1972 presidential election. His work for Nixon in that election was crucial in increasing the vote for Nixon in New York and in the union movement.
Executive Order 11246, signed by President Lyndon B. Johnson on September 24, 1965, established requirements for non-discriminatory practices in hiring and employment on the part of U.S. government contractors. It "prohibits federal contractors and federally assisted construction contractors and subcontractors, who do over $10,000 in Government business in one year from discriminating in employment decisions on the basis of race, color, religion, sex, or national origin." It also requires contractors to "take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, color, religion, sex or national origin." The phrase affirmative action had appeared previously in Executive Order 10925 in 1961.
The Office of Federal Contract Compliance Programs (OFCCP) is part of the U.S. Department of Labor. OFCCP is responsible for ensuring that employers doing business with the Federal government comply with the laws and regulations requiring nondiscrimination. This mission is based on the underlying principle that employment opportunities generated by Federal dollars should be available to all Americans on an equitable and fair basis.
Equal employment opportunity is equal opportunity to attain or maintain employment in a company, organization, or other institution. Examples of legislation to foster it or to protect it from eroding include the U.S. Equal Employment Opportunity Commission, which was established by Title VII of the Civil Rights Act of 1964 to assist in the protection of United States employees from discrimination. The law was the first federal law designed to protect most US employees from employment discrimination based on that employee's race, color, religion, sex, or national origin.
In the United States, affirmative action consists of government-mandated, government-approved, and voluntary private programs granting special consideration to groups considered or classified as historically excluded, specifically racial minorities and women. These programs tend to focus on access to education and employment in order to redress the disadvantages associated with past and present discrimination. Another goal of affirmative action policies is to ensure that public institutions, such as universities, hospitals, and police forces, are more representative of the populations they serve.
Employment discrimination law in the United States derives from the common law, and is codified in numerous state, federal, and local laws. These laws prohibit discrimination based on certain characteristics or "protected categories". The United States Constitution also prohibits discrimination by federal and state governments against their public employees. Discrimination in the private sector is not directly constrained by the Constitution, but has become subject to a growing body of federal and state law, including the Title VII of the Civil Rights Act of 1964. Federal law prohibits discrimination in a number of areas, including recruiting, hiring, job evaluations, promotion policies, training, compensation and disciplinary action. State laws often extend protection to additional categories or employers.
Executive Order 10925, signed by President John F. Kennedy on March 6, 1961, required government contractors, except in special circumstances, to "take affirmative action to ensure that applicants are employed and that employees are treated during employment without regard to their race, creed, color, or national origin". It established the President's Committee on Equal Employment Opportunity (PCEEO), which was chaired by then Vice President Lyndon Johnson. Vice Chair and Secretary of Labor Arthur Goldberg was responsible for the "general supervision and direction" of the Committee's operations. Ten other senior executive appointees also sat on the Committee.
United Steelworkers of America v. Weber, 443 U.S. 193 (1979), was a case regarding affirmative action in which the United States Supreme Court held that Title VII of the Civil Rights Act of 1964, which prohibits racial discrimination by private employers, does not condemn all private, voluntary, race-conscious affirmative action plans. The Court's decision reversed lower courts' rulings in favor of Brian Weber whose lawsuit beginning in 1974 challenged his employer's hiring practices.
A protected group, protected class (US), or prohibited ground (Canada) is a category by which people are qualified for special protection by a law, policy, or similar authority. In Canada and the United States, the term is frequently used in connection with employees and employment and housing. Where illegal discrimination on the basis of protected group status is concerned, a single act of discrimination may be based on more than one protected class. For example, discrimination based on antisemitism may relate to religion, ethnicity, national origin, or any combination of the three; discrimination against a pregnant woman might be based on sex, marital status, or both.
The Women's Equity Action League, or WEAL, was a United States women's rights organization founded in 1968 with the purpose of addressing discrimination against women in employment and education opportunities. Made up of conservative women, they used the court system to facilitate enforcing existing legislation. They are most known for filing cases against higher education institutions across the United States to address discriminatory hiring and promotion practices. They also successfully litigated over help-wanted advertisements being sex-segregated, extending military spousal benefits to husbands of female service personnel, and over the extent to which the Department of Defense could involve itself in the lives of military spouses.
Wygant v. Jackson Board of Education, 476 U.S. 267 (1986), was a case before the United States Supreme Court. It is the seminal case for the "strong-basis-in-evidence standard" for affirmative action programs.
Executive Order 11375, signed by President Lyndon B. Johnson on October 13, 1967, banned discrimination on the basis of sex in hiring and employment in both the United States federal workforce and on the part of government contractors.
Bernice Resnick Sandler was an American women's rights activist. She is best known for being instrumental in the creation of Title IX, a portion of the Education Amendments of 1972, in conjunction with representatives Edith Green and Patsy Mink and Senator Birch Bayh in the 1970s. She has been called "the Godmother of Title IX" by The New York Times. Sandler wrote extensively about sexual and peer harassment towards women on campus, coining the phrase "the chilly campus climate".
Schuette v. BAMN, 572 U.S. 291 (2014), was a landmark decision of the Supreme Court of the United States concerning affirmative action and race- and sex-based discrimination in public university admissions. In a 6-2 decision, the Court held that the Fourteenth Amendment's Equal Protection Clause does not prevent states from enacting bans on affirmative action in education.
Executive Order 13672, signed by U.S. President Barack Obama on July 21, 2014, amended two earlier executive orders to extend protection against discrimination in hiring and employment to additional classes. It prohibited discrimination in the civilian federal workforce on the basis of gender identity and in hiring by federal contractors on the basis of both sexual orientation and gender identity.
Johnson v. Transportation Agency, 480 U.S. 616 (1987), is the only United States Supreme Court case to address a sex-based affirmative action plan in the employment context. The case was brought by Paul Johnson, a male Santa Clara County Transportation Agency employee, who was passed over for a promotion in favor of Diane Joyce, a female employee who Johnson argued was less qualified. The Court found that the plan did not violate the protection against discrimination on the basis of sex in Title VII of the Civil Rights Act of 1964.
Proposition 16 was a failed California ballot proposition that appeared on the November 3, 2020, general election ballot, asking California voters to amend the Constitution of California to repeal Proposition 209 (1996). Proposition 209 amended the state constitution to prohibit government institutions from considering race, sex, or ethnicity, specifically in the areas of public employment, public contracting, and public education. Therefore, Proposition 209 banned the use of race- and gender-based affirmative action in California's public sector and public university admissions.
