Supreme Court of India, in its judgement dated 10 July 2013 while disposing the Lily Thomas v. Union of India case (along with Lok Prahari v. Union of India), [1] ruled that any Member of Parliament (MP), Member of the Legislative Assembly (MLA) or Member of the Legislative Council (MLC) who is convicted of a crime and given a minimum of two years' imprisonment, loses membership of the House with immediate effect. This is in contrast to the earlier position, wherein convicted members held on to their seats until they exhausted all judicial remedy in lower, state and supreme court of India. Further, Section 8(4) of the Representation of the People Act, which allowed elected representatives three months to appeal their conviction, [2] was declared unconstitutional by the bench of Justice A. K. Patnaik and Justice S. J. Mukhopadhaya. [3]
In an attempt to overturn this decision, the Representation of the People (Second Amendment and Validation) Bill, 2013, was introduced into the Rajya Sabha on 30 August by Law Minister Kapil Sibal; by the proposed amendment, representatives would not be disqualified immediately after conviction. [4] The Indian government also filed a review petition, which the Supreme Court dismissed. [5] On 24 September, a few days before the fodder scam verdict, the government tried to bring the bill into effect as an ordinance. [6] However, Rahul Gandhi, then vice-president of the Indian National Congress, made his opinion of the ordinance clear in a press meeting: "It's complete nonsense. It should be torn up and thrown away." [7] Members of opposition parties claimed that Gandhi's comments indicated total confusion within the government, and called for the resignation of Prime Minister Manmohan Singh. [8] [9] Within 5 days, both the ordinance and the bill were withdrawn on 2 October. [10]
On 1 October 2013, Rasheed Masood became the first MP to lose his membership of parliament under the new guidelines, when he was sentenced to four years' imprisonment for cheating, forgery and corruption. [11]

Rahul Rajiv Gandhi is an Indian politician. The Fodder Scam was a corruption scandal that involved the embezzlement of about ₹940 crore from the government treasury of the north Indian state of Bihar. Among those implicated in the theft and arrested were then Chief Minister of Bihar, Lalu Prasad Yadav, as well as former Chief Minister, Jagannath Mishra. The scandal led to the end of Lalu's reign as Chief Minister. Dineshwar Prasad Sharma is also alleged to have received ₹300.60 crore from S. N. Sinha. On 23 December 2017, Lalu Prasad Yadav was convicted by a special CBI court while Jagannath Misra was acquitted.
Mohammad Shahabuddin was a politician and former Member of Parliament from the Siwan constituency in the state of Bihar. He was a former member of the National Executive Committee of the Janata Dal and the Rashtriya Janata Dal. Shahabuddin was disqualified from contesting elections following his conviction for the kidnapping and disappearance of Chote Lal Gupta, an activist of the Communist Party of India (Marxist–Leninist) Liberation for which he was serving a life sentence. He was also accused of killing 15 other Communist Party activists, including the former student leader Chandrashekhar Prasad.

Dr. Jagdish Sharma is an Indian politician. He was a vice president of the Hindustani Awam Morcha, a political party. His wife Shanti Sharma was MLA from Ghosi. His son Rahul Kumar became MLA from Ghosi constituency. After being found guilty in criminal conspiracy to save bureaucrats involved in Fodder Scam, Sharma was sentenced to four years rigorous imprisonment and disqualified as an MP along with RJD Supremo Lalu Prasad Yadav.
The Representation of the People Act, 1951 is an act of Parliament of India to provide for the conduct of election of the Houses of Parliament and to the House or Houses of the Legislature of each State, the qualifications and disqualifications for membership of those Houses, what constitute corrupt practices and other offences at or in connection with such elections and the determination of disputes arising out of or in connection with such elections. It was introduced in Parliament by law minister Dr. B.R. Ambedkar. The Act was enacted by the provisional parliament under Article 327 of Indian Constitution, before the first general election.
Jitan Ram Manjhi is an Indian politician, serving as the Minister of Micro, Small and Medium Enterprises since 2024. He is currently a Member of Parliament from Gaya constituency and was Bihar's 23rd Chief Minister from 20 May 2014 to 20 February 2015. He was the founding President of Hindustani Awam Morcha (HAM). Previously, he had served as minister for scheduled castes and scheduled tribes welfare in Nitish Kumar's cabinet. He has been a minister in several Bihar state governments, under multiple chief ministers like Chandrashekhar Singh, Bindeshwari Dubey, Satyendra Narayan Sinha, Jagannath Mishra, Lalu Prasad Yadav and Rabri Devi.
Lily Isabel Thomas was an Indian lawyer who initiated improvement and change to existing laws by filing petitions in India's apex court, the Supreme Court of India and regional courts. Her petitions resulted in changes to laws to prevent convicted politicians getting elected, the addition of a new marriage law and protections for parliamentarians. She was hailed most notably for petitioning to amend the Representation of the People Act, 1951.

Rahul Gandhi, the leader of Indian National Congress, was disqualified as member of the Lower House of the Indian Parliament on 24 March 2023. The disqualification followed a conviction by an Indian court, which sentenced Gandhi with two-year imprisonment, on the accusation of defaming the Modi surname. The conviction and defamation raised an alarm about the state of democracy in India and were seen as a move to silence dissent and political opposition before the upcoming 2024 general elections. In August 2023, the Supreme Court of India stayed his conviction. This would allow him to contest the next election. On 7 August a notification from Lok Sabha secretariat reinstated Rahul Gandhi to the parliament.
