Disqualification of convicted representatives in India

Supreme Court of India, in its judgement dated 10 July 2013 while disposing the Lily Thomas v. Union of India case (along with Lok Prahari v. Union of India), [1] ruled that any Member of Parliament (MP), Member of the Legislative Assembly (MLA) or Member of the Legislative Council (MLC) who is convicted of a crime and given a minimum of two years' imprisonment, loses membership of the House with immediate effect. This is in contrast to the earlier position, wherein convicted members held on to their seats until they exhausted all judicial remedy in lower, state and supreme court of India. Further, Section 8(4) of the Representation of the People Act, which allowed elected representatives three months to appeal their conviction, [2] was declared unconstitutional by the bench of Justice A. K. Patnaik and Justice S. J. Mukhopadhaya. [3]

Resistance from government

In an attempt to overturn this decision, the Representation of the People (Second Amendment and Validation) Bill, 2013, was introduced into the Rajya Sabha on 30 August by Law Minister Kapil Sibal; by the proposed amendment, representatives would not be disqualified immediately after conviction. [4] The Indian government also filed a review petition, which the Supreme Court dismissed. [5] On 24 September, a few days before the fodder scam verdict, the government tried to bring the bill into effect as an ordinance. [6] However, Rahul Gandhi, then Vice-President of the Indian National Congress, made his opinion of the ordinance clear in a press meeting: "It's complete nonsense. It should be torn up and thrown away." [7] Members of opposition parties claimed that Gandhi's comments indicated total confusion within the government, and called for the resignation of Prime Minister Manmohan Singh. [8] [9] Within 5 days, both the ordinance and the bill were withdrawn on 2 October. [10]

On 1 October 2013, Rasheed Masood became the first MP to lose his membership of parliament under the new guidelines, when he was sentenced to four years' imprisonment for cheating, forgery and corruption. [11]

Although India is a parliamentary democracy, the country's politics has become dynastic or with high level of nepotism, possibly due to the absence of party organizations, independent civil-society associations which mobilize support for a party, or centralized financing of elections. The dynastic phenomenon is present at the national, state, regional, and district level. The Nehru–Gandhi family has produced three Indian prime ministers, and family members have largely led the Congress party since 1978. The ruling Bharatiya Janata Party (BJP) also has several dynastic leaders. In addition to the major national parties, other national and regional parties such as Shiromani Akali Dal, Shiv Sena, Samajwadi Party, Rashtriya Janata Dal, Janata Dal Secular, Jharkhand Mukti Morcha, Dravida Munnetra Kazhagam, Kerala Congress, Jammu & Kashmir National Conference, Indian Union Muslim League, AIMIM, and the Nationalist Congress Party are all dominated by families, mostly those of the party founders.

Mohammad Shahabuddin was a politician and former Member of Parliament from the Siwan constituency in the state of Bihar. He was a former member of the National Executive Committee of the Janata Dal and the Rashtriya Janata Dal. Shahabuddin was disqualified from contesting elections following his conviction for the kidnapping and disappearance of Chote Lal Gupta, an activist of the Communist Party of India (Marxist–Leninist) Liberation for which he was serving a life sentence. He was also accused of killing 15 other Communist Party activists, including the former student leader Chandrashekhar Prasad.

Prabhunath Singh is a politician from Bihar, India and was a member of the 12th, 13th and 14th Lok Sabha. Singh represented the Masrakh assembly constituency from 1985 to 1995, and the Maharajganj Lok Sabha constituency of Bihar from 1998 to 2009. In 2013, he won the bypoll and remained as MP until 2014. Singh is a member of the Rashtriya Janata Dal (RJD).

Ritlal Yadav or Ritlal Ray is a leader of RJD who won the Bihar Legislative Council election in July 2015 as an independent candidate. Ritlal was in jail in connection with multiple criminal cases, including murder charges. Ritlal is accused in over 33 cases. He was a former Member of Legislative Council (MLC), the post, to which he was elected in 2016. He was incarcerated in Beur Jail until August 2020. However he was then released from the jail on bail. Ritlal Yadav defeated BJP's Asha Devi Sinha in the 2020 Bihar Assembly elections.

Purnesh Modi is an MLA from Gujarat Legislative Assembly. He won the by-election for the 13th Legislative Assembly in Gujarat, which was facilitated following the death of the then MLA Kishor Vankawala. He lives in Adajan Area, Surat along with his family.

Rahul Gandhi, the leader of Indian National Congress, was disqualified as member of the Lower House of the Indian Parliament on 24 March 2023. The disqualifiaction followed a conviction by an Indian court, which sentenced Gandhi with two-year imprisonment, on the accusation of defaming prime minister Narendra Modi's surname. The conviction and defamation raised an alarm about the state of democracy in India and were seen as a move to silence dissent and political opposition before the upcoming 2024 general elections. In August 2023, the Supreme Court of India stayed his conviction. This would allow him to contest the next election. On 7 August a notification from Lok Sabha secretariat reinstated Rahul Gandhi to the parliament.
