The Legal Adviser of the Department of State is a position within the United States Department of State. The legal adviser provides legal advice on all issues (domestic and international) arising in the course of the department's activities. The legal adviser heads the State Department's Office of the Legal Adviser. As such, the legal adviser has the rank of Assistant Secretary. [2] [3]

History

From 1870 to 1891, the examiner of claims had been the chief legal officer of the department. The solicitor, a Department of Justice employee, had functioned as the Department of State's chief legal officer from 1891 to 1931. Solicitors and examiners of claims were by statute officials of the Department of Justice. The position of Legal Advisor was created by an Act of Congress on February 23, 1931 (P.L. 71-715; 46 Stat. 1214). The first legal adviser was Green Hackworth, who served until 1946 and then became a judge on the International Court of Justice.

The United States attorney general (AG) is the head of the United States Department of Justice (DOJ) and is the chief law enforcement officer of the federal government of the United States. The attorney general serves as the principal advisor to the president of the United States on all legal matters. The attorney general is a statutory member of the Cabinet of the United States.

In most common law jurisdictions, the attorney general or attorney-general is the main legal advisor to the government. In some jurisdictions, attorneys general also have executive responsibility for law enforcement, prosecutions or even responsibility for legal affairs generally. The extent to which a solicitor general actually provides legal advice to or represents the government in court varies from jurisdiction to jurisdiction, and sometimes between individual office holders in the same jurisdiction.

The United States order of precedence is an advisory document maintained by the Ceremonials Division of the Office of the Chief of Protocol of the United States which lists the ceremonial order, or relative preeminence, for domestic and foreign government officials at diplomatic, ceremonial, and social events within the United States and abroad. The list is used to mitigate miscommunication and embarrassment in diplomacy, and offer a distinct and concrete spectrum of preeminence for ceremonies. Often the document is used to advise diplomatic and ceremonial event planners on seating charts and order of introduction. Former presidents, vice presidents, first ladies, second ladies, and secretaries of state and retired Supreme Court justices are also included in the list.

The Scottish Government is the executive arm of the devolved government of Scotland. It was formed in 1999 as the Scottish Executive following the 1997 referendum on Scottish devolution. Its areas for responsibility of decision making and domestic policy in the country include the economy, education, healthcare, justice and the legal system, rural affairs, housing, the crown estate, the environment, the fire service, equal opportunities, the transportation network, and tax, amongst others.

The law officers are the senior legal advisors to His Majesty's Government of the United Kingdom and devolved governments of Northern Ireland, Scotland and Wales. They are variously referred to as the Attorney General, Solicitor General, Lord Advocate, or Advocate General depending on seniority and geography – though other terms are also in use, such as the Counsel General for Wales. Law officers in these roles are distinguished by being political appointees, while also being bound by the duties of independence, justice and confidentiality among the other typical professional commitments of lawyers. These roles do not have any direct oversight of prosecutions nor do they directly lead or influence criminal investigations. This is a distinguishing factor between law officers and the state attorneys general of the United States or US Attorney General.

The Department of Justice (DoJ), is the department responsible for the laws of Hong Kong headed by the Secretary for Justice. Before 1997, the names of the department and the position was the Legal Department (律政署) and Attorney General (律政司) respectively. The Department of Justice provides legal advice to other departments in the government system, “drafts government bills, makes prosecution decisions, and promotes the rule of law”.

Assistant Secretary of State (A/S) is a title used for many executive positions in the United States Department of State, ranking below the under secretaries. A set of six assistant secretaries reporting to the under secretary for political affairs manage diplomatic missions within their designated geographic regions, plus one assistant secretary dealing with international organizations and one equivalent as the coordinator/ambassador at large for counterterrorism. Assistant secretaries usually manage individual bureaus of the Department of State. When the manager of a bureau or another agency holds a title other than assistant secretary, such as "director", it can be said to be of "assistant secretary equivalent rank". Assistant secretaries typically have a set of deputies, referred to as deputy assistant secretaries (DAS).

Adrian Sanford Fisher was an American lawyer and federal public servant, who served from the late 1930s through the early 1980s. He was associated with the Department of War and Department of State throughout his professional career. He participated in the U.S. government's decision to carry out Japanese-American internment and the international (1945–46) Nuremberg trial, and in State Department Cold War activities during the Harry S. Truman administration. He was the State Department Legal Adviser under Secretary of State Dean Acheson. During the John F. Kennedy, Lyndon B. Johnson and Jimmy Carter administrations, Fisher was directly involved in the negotiations of international nuclear testing and non-proliferation agreements.

Fred Kenelm Nielsen was a Danish-American lawyer, diplomatic official, and college football coach. Nielsen served as the head football coach at the Maryland Agricultural College—now known as the University of Maryland, College Park—from 1905 to 1906, the George Washington University from 1907 to 1908, Georgetown University from 1910 to 1911, and the Catholic University of America from 1915 to 1916.
