Restricted use pesticides (RUP) are pesticides not available to the general public in the United States. Fulfilling its pesticide regulation responsibilities, the United States Environmental Protection Agency (EPA) registers all pesticides as either "unclassified" or "restricted use". Unclassified pesticides are available over-the-counter, while the latter require a license to purchase and apply the product. Pesticides are classified as "restricted use" for a variety of reasons, such as potential for or history of groundwater contamination.
The RUP classification restricts a product, or its uses, to use by a certificated pesticide applicator or under the direct supervision of a certified applicator. Certification programs are administered by the federal government, individual states, and by company policies that vary from state to state. This is managed by the EPA under the Worker Protection Standard, in cooperation with the United States Department of Agriculture.[ citation needed ]
The RUP list is part of Title 40 of the Code of Federal Regulations (40 CFR 152.175). [1] Atrazine is the most widely used restricted-use herbicide, however there are over 700 RUPs as of 2017. Many insecticides and fungicides used in fruit production are restricted use.[ citation needed ]
The Worker Protection Standard (WPS) identifies the type of requirements that must be satisfied to obtain the proper license needed to purchase and apply restricted use pesticide. [2] The process required to obtain a pest control licenses is regulated by a combination of state laws, federal laws, common law, and private company policies. All RUP applications must be recorded to identify the date, location, and type of pesticide applied. Federal law requires a minimum record retention period, which may be three years or longer depending upon state laws. There are two licensee categories: supervisor and applicator. Pesticides are substances that are used to control pests. They include herbicides, insecticides, nematicides, fungicides, and many others. The most common of these are herbicides, which account for approximately 50% of all pesticide use globally. Most pesticides are used as plant protection products, which in general protect plants from weeds, fungi, or insects. In general, a pesticide is a chemical or biological agent that deters, incapacitates, kills, or otherwise discourages pests. Target pests can include insects, plant pathogens, weeds, molluscs, birds, mammals, fish, nematodes (roundworms), and microbes that destroy property, cause nuisance, or spread disease, or are disease vectors. Along with these benefits, pesticides also have drawbacks, such as potential toxicity to humans and other species.
Bromomethane, commonly known as methyl bromide, is an organobromine compound with formula CH3Br. This colorless, odorless, nonflammable gas is produced both industrially and biologically. It is a recognized ozone-depleting chemical. It was used extensively as a pesticide until being phased out by most countries in the early 2000s. From a chemistry perspective, it is one of the halomethanes.
Piperonyl butoxide (PBO) is a pale yellow to light brown liquid organic compound used as an adjuvant component of pesticide formulations for synergy. That is, despite having no pesticidal activity of its own, it enhances the potency of certain pesticides such as carbamates, pyrethrins, pyrethroids, and rotenone. It is a semisynthetic derivative of safrole and is produced from the condensation of the sodium salt of 2-(2-butoxyethoxy) ethanol and the chloromethyl derivative of hydrogenated safrole (dihydrosafrole); or through 1,2-Methylenedioxybenzene.
Under United States law, pesticide misuse is considered to be the use of a pesticide in a way that violates laws regulating their use or endangers humans or the environment; many of these regulations are laid out in the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Pesticide misuse encompasses a range of practices, including overapplication, incorrect timing, and the use of banned substances. This global issue not only threatens environmental safety but also undermines efforts towards sustainability. The risk of pesticide pollution at a global scale necessitates a concerted effort to understand and mitigate misuse. The most common instances of pesticide misuse are applications inconsistent with the labeling, which can include the use of a material in any way not described on the label, changing dosage rates, or violating specific safety instructions. Pesticide labels have been criticized as a poor risk communication vehicle, leading some officials and researchers to question whether "misuse" is an appropriate term for what are often "unintended uses" resulting from a poor understanding of safety and application instructions. Other kinds of pesticide misuse include the sale or use of an unregistered pesticide or one whose registration has been revoked and the sale or use of an adulterated or misbranded pesticide. Under most jurisdictions, it is illegal to alter or remove pesticide labels, to sell restricted pesticides to an uncertified applicator, or to fail to maintain sales and use records of restricted pesticides.
Chlorpyrifos (CPS), also known as chlorpyrifos ethyl, is an organophosphate pesticide that has been used on crops, and animals in buildings, and in other settings, to kill several pests, including insects and worms. It acts on the nervous systems of insects by inhibiting the acetylcholinesterase enzyme. Chlorpyrifos was patented in 1966 by Dow Chemical Company.
The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) is a United States federal law that set up the basic U.S. system of pesticide regulation to protect applicators, consumers, and the environment. It is administered and regulated by the United States Environmental Protection Agency (EPA) and the appropriate environmental agencies of the respective states. FIFRA has undergone several important amendments since its inception. A significant revision in 1972 by the Federal Environmental Pesticide Control Act (FEPCA) and several others have expanded EPA's present authority to oversee the sales and use of pesticides with emphasis on the preservation of human health and protection of the environment by "(1) strengthening the registration process by shifting the burden of proof to the chemical manufacturer, (2) enforcing compliance against banned and unregistered products, and (3) promulgating the regulatory framework missing from the original law".
Aerial application, or what is informally referred to as crop dusting, involves spraying crops with crop protection products from an agricultural aircraft. Planting certain types of seed are also included in aerial application. The specific spreading of fertilizer is also known as aerial topdressing in some countries. Many countries have severely limited aerial application of pesticides and other products because of environmental and public health hazards like spray drift; most notably, the European Union banned it outright with a few highly restricted exceptions in 2009, effectively ending the practice in all member states.
Chloropicrin, also known as PS and nitrochloroform, is a chemical compound currently used as a broad-spectrum antimicrobial, fungicide, herbicide, insecticide, and nematicide. Right to know is a human right enshrined in law in several countries. UNESCO defines it as the right for people to "participate in an informed way in decisions that affect them, while also holding governments and others accountable". It pursues universal access to information as essential foundation of inclusive knowledge societies. It is often defined in the context of the right for people to know about their potential exposure to environmental conditions or substances that may cause illness or injury, but it can also refer more generally to freedom of information or informed consent.
The Food Quality Protection Act (FQPA), or H.R.1627, was passed unanimously by Congress in 1996 and was signed into law by President Bill Clinton on August 3, 1996. The FQPA standardized the way the Environmental Protection Agency (EPA) would manage the use of pesticides and amended the Federal Insecticide, Fungicide, and Rodenticide Act and the Federal Food Drug and Cosmetic Act. It mandated a health-based standard for pesticides used in foods, provided special protections for babies and infants, streamlined the approval of safe pesticides, established incentives for the creation of safer pesticides, and required that pesticide registrations remain current.
Cyhalothrin is an organic compound that, in specific isomeric forms, is used as a pesticide. It is a pyrethroid, a class of synthetic insecticides that mimic the structure and properties of the naturally occurring insecticide pyrethrin which is present in the flowers of Chrysanthemum cinerariifolium. Pyrethroids, such as cyhalothrin, are often preferred as an active ingredient in agricultural insecticides because they are more cost-effective and longer acting than natural pyrethrins. λ-and γ-cyhalothrin are now used to control insects and spider mites in crops including cotton, cereals, potatoes and vegetables.
Clothianidin is an insecticide developed by Takeda Chemical Industries and Bayer AG. Similar to thiamethoxam and imidacloprid, it is a neonicotinoid. Neonicotinoids are a class of insecticides that are chemically similar to nicotine, which has been used as a pesticide since the late 1700s. Clothianidin and other neonicotinoids act on the central nervous system of insects as an agonist of nAChR, the same receptor as acetylcholine, the neurotransmitter that stimulates and activating post-synaptic acetylcholine receptors but not inhibiting AChE. Clothianidin and other neonicotinoids were developed to last longer than nicotine, which is more toxic and which breaks down too quickly in the environment.

Pesticide regulation in the United States is primarily a responsibility of the Environmental Protection Agency (EPA). In America, it was not till the 1950s that pesticides were regulated in terms of their safety. The Pesticides Control Amendment (PCA) of 1954 was the first time Congress passed guidance regarding the establishment of safe limits for pesticide residues on food. It authorized the Food and Drug Administration (FDA) to ban pesticides they determined to be unsafe if they were sprayed directly on food. The Food Additives Amendment, which included the Delaney Clause, prohibited the pesticide residues from any carcinogenic pesticides in processed food. In 1959, pesticides were required to be registered.

Pyrethroids such as tefluthrin are often preferred as active ingredients in agricultural insecticides because they are more cost-effective and longer acting than natural pyrethrins. It is effective against soil pests because it can move as a vapour without irreversibly binding to soil particles: in this respect it differs from most other pyrethroids.

The Reducing Regulatory Burdens Act of 2013 is a bill that would prohibit the Environmental Protection Agency (EPA) and states authorized to issue a permit under the National Pollutant Discharge Elimination System (NPDES) from requiring a permit for some discharges of pesticides authorized for use under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The bill would clarify the law so that people did not have to get two permits in order to use the same pesticide.
The Circle of Poison (COP) refers to the export of domestically banned pesticides for use on foods elsewhere, some of which returns by way of import. The "circle" is complete when the toxic chemicals that were exported are then used to grow fruit, meat, and produce that are imported and available for domestic consumption. This circle was first identified relative to the United States but the relationship also exists between other nations of the Global North and South.
