UN Security Council Resolution 883, adopted on 11 November 1993, after reaffirming resolutions 731 (1992) and 748 (1992), the council noted that, twenty months later, Libya had not complied with previous Security Council resolutions and as a consequence imposed further international sanctions on the country. [1]
The council expressed its determination to eliminate international terrorism and that those responsible for acts of terrorism would be brought to justice. In the context that the suppression of these acts is essential for international peace and security, it was noted that Libya had refused to comply with previous security council resolutions and its renunciation of terrorism, which the council determined to be a threat to international peace and security. At the same time, letters from representatives of Libya in which it stated its intention to encourage those accused of the bombing of Pan Am Flight 103 over Lockerbie, Scotland and the bombing of UTA Flight 772 over Chad and Niger to co-operate with the concerned authorities was noted.
Acting under Chapter VII of the United Nations Charter, the council demanded that Libya comply with resolutions 731 and 748. To ensure the Libyan government's compliance with the aforementioned resolutions, the following measures would take effect as of 00:01 EST on 1 December 1993. Firstly, all countries were required to freeze Libyan funds or other financial resources in their territory, though this would not apply to funds or other financial resources derived from the sale or supply of petroleum and petroleum products, natural gas and gas products and agricultural products. The committee established by the security council in Resolution 748 was instructed to draw up guidelines for the implementation of the above measures and to deal with requests for assistance under Article 50 of the United Nations Charter for countries that suffered indirectly as a result of the sanctions. All states and international organisations were urged to co-operate with the provisions of the current resolution and to report to the UN Secretary-General Boutros Boutros-Ghali on measures they had taken to implement the resolution. At the same time, Libya was urged to co-operate, while the council affirmed that the present resolution did not affect Libya's duty to adhere to all of its obligations concerning servicing and repayment of foreign debt. Measures taken by the council were to be reviewed after noting co-operation by Libya with regard to the bombing of Pan Am Flight 103 and UTA Flight 772.
Resolution 883 was adopted by 11 votes to none, with four abstentions, from China, Djibouti, Morocco and Pakistan. [3] Russia had previously threatened to veto the resolution, but after negotiations supported the provisions after stating its intention to recover the debt owed to it by Libya over purchases of weapons. [4]
Libya responded by closing its borders with Tunisia and Egypt for three days, denouncing the resolution as a product of hostile policy from the United Nations and affirming the need to seek a resolution to the crisis as soon as possible. [5]
The foreign relations of Libya under Muammar Gaddafi (1969–2011) underwent much fluctuation and change. They were marked by severe tension with the West and by other national policies in the Middle East and Africa, including the Libyan government's financial and military support for numerous paramilitary and rebel groups.
UTA Flight 772 was a scheduled international passenger flight of the French airline Union de Transports Aériens (UTA) operating from Brazzaville in the People's Republic of the Congo, via N'Djamena in Chad, to Charles de Gaulle Airport in Paris, France, which crashed into the Ténéré desert near Bilma, Niger, on 19 September 1989 with the loss of all 170 people on board, after an in-flight explosion caused by a suitcase bomb. It is the deadliest aviation incident to occur in Niger.
A no-fly zone, also known as a no-flight zone (NFZ), or air exclusion zone (AEZ), is a territory or area established by a military power over which certain aircraft are not permitted to fly. Such zones are usually set up in an enemy power's territory during a conflict for humanitarian or military reasons without consent of the enemy state, similar in concept to an aerial demilitarized zone, and usually intend to prohibit the enemy's military aircraft from operating in the region. Military action is employed by the enforcing state and, depending on the terms of the NFZ, may include preemptive attacks to prevent potential violations, reactive force targeted at violating aircraft, or surveillance with no use of force. Air exclusion zones and anti-aircraft defences are sometimes set up in a civilian context, for example to protect sensitive locations, or events such as the 2012 London Olympic Games, against terrorist air attack. A no-fly zone is generally not considered a form of aerial blockade due to its more limited scope compared to an aerial blockade.
United Nations Security Council Resolution 687 was adopted on 3 April 1991. After reaffirming resolutions 660, 661, 662, 664, 665, 666, 667, 669, 670, 674, 677, 678 and 686 (1991), the Council set the terms, in a comprehensive resolution, with which Iraq was to comply after losing the Gulf War. Resolution 687 was passed by 12 votes to one (Cuba) against, with two abstentions from Ecuador and Yemen, after a very extended meeting. Iraq accepted the provisions of the resolution on 6 April 1991.
United Nations Security Council resolution 986, adopted unanimously on 14 April 1995, after reaffirming all resolutions on Iraq and noting the serious humanitarian situation with the Iraqi civilian population, the council, acting under Chapter VII of the United Nations Charter, established a mechanism whereby Iraqi oil exports would finance humanitarian aid to the country, which later became known as the Oil-for-Food Programme.
Pan Am Flight 103 (PA103/PAA103) was a regularly scheduled Pan Am transatlantic flight from Frankfurt to Detroit via a stopover in London and another in New York City. The transatlantic leg of the route was operated by Clipper Maid of the Seas, a Boeing 747 registered N739PA. Shortly after 19:00 on 21 December 1988, while the aircraft was in flight over the Scottish town of Lockerbie, it was destroyed by a bomb, killing all 243 passengers and 16 crew in what became known as the Lockerbie bombing. Large sections of the aircraft crashed in a residential street in Lockerbie, killing 11 residents. With a total of 270 fatalities, it is the deadliest terrorist attack in the history of the United Kingdom.
The United Nations Act 1946 is an Act of the Parliament of the United Kingdom which enables His Majesty's Government to implement resolutions under Article 41 of the United Nations Charter as Orders in Council. Thus Parliament delegated the power to enact such resolutions without the approval of Parliament. However, the prospective Order must be laid before either Parliament or the Scottish Parliament. A similar mechanism was later used in the European Communities Act 1972 and the Terrorist Asset-Freezing etc. Act 2010.
Libya–United States relations are the bilateral relations between the State of Libya and the United States of America. Relations are today cordial and cooperative, with particularly strong security cooperation only after the 2012 attack on the US liaison office or mission in Benghazi. Furthermore, a Gallup poll conducted in March and April 2012 found that Libyans had "among the highest approval" of US leadership in the entire Middle East and North Africa region.
UN Security Council Resolution 731 was adopted unanimously on 21 January 1992, after the Council recalled resolutions 286 (1970) and 635 (1989), which condemned acts of terrorism; the Council expressed concern over the results of investigations into the destruction of Pan Am Flight 103 over Lockerbie, Scotland, and UTA Flight 772 over Chad and Niger, which implicated officials from the Government of Libya.
UN Security Council Resolution 748, adopted unanimously on 31 March 1992, after reaffirming Resolution 731 (1992), the UN Security Council decided, under Chapter VII of the United Nations Charter, that demanded Government of Libya's immediate compliance with requests from investigations relating to the destruction of Pan Am Flight 103 over Lockerbie and UTA Flight 772 over Chad and Niger, calling on Libya to cease all forms of terrorist action and assistance to terrorist groups. To this end, the council imposed sanctions on Libya until Libya complied.
United Nations Security Council Resolution 841, adopted unanimously on 16 June 1993, after recognising the need for an urgent settlement to the situation in Haiti and the efforts of the Secretary-General of the United Nations Boutros Boutros-Ghali and the Secretary General of the Organization of American States João Clemente Baena Soares, the Council placed various international sanctions on Haiti.
United Nations Security Council resolution 864, adopted unanimously on 15 September 1993, after reaffirming resolutions 696 (1991), 747 (1992), 785 (1992), 793 (1992), 804 (1993), 811 (1993), 823 (1993), 834 (1993) and 851 (1993), the Council noted the continuing situation in Angola and went on to condemn and place international sanctions on UNITA.
United Nations Security Council resolution 910, adopted unanimously on 14 April 1994, after considering a letter by the UN Secretary-General Boutros Boutros-Ghali advising of his intention to send a reconnaissance team to the Aouzou Strip disputed between Chad and Libya, the Council decided to exempt the reconnaissance mission from a provision in Resolution 748 (1992) that imposed international sanctions on Libya.
United Nations Security Council resolution 915 was adopted unanimously on 4 May 1994. While reaffirming Resolution 910 (1994), the Council, acting on a recommendation by the UN Secretary-General Boutros Boutros-Ghali, established the United Nations Aouzou Strip Observer Group (UNASOG) to supervise the withdrawal of Libyan forces from the Aouzou Strip following an International Court of Justice opinion rendered in the Libya–Chad Territorial Dispute case that the strip formed part of the territory of Chad.
United Nations Security Council resolution 917, adopted unanimously on 6 May 1994, after recalling resolutions 841 (1993), 861 (1993), 862 (1993), 867 (1993), 873 (1993) and 875 (1993) and 905 (1994) on the situation in Haiti, the Council imposed further international sanctions on the country after the military authorities refused to implement the Governors Island Agreement to hand over power and instances of violations of human rights.
