The subcommittee was formerly known as the Subcommittee on Superfund and Environmental Health, but was renamed during committee organization of the 111th Congress to reflect its jurisdiction over major federal environmental health laws. From the 111th to the 116th Congress it was named Subcommittee on Superfund, Waste Management, and Regulatory Oversight.

Industrial waste is the waste produced by industrial activity which includes any material that is rendered useless during a manufacturing process such as that of factories, mills, and mining operations. Types of industrial waste include dirt and gravel, masonry and concrete, scrap metal, oil, solvents, chemicals, scrap lumber, even vegetable matter from restaurants. Industrial waste may be solid, semi-solid or liquid in form. It may be hazardous waste or non-hazardous waste. Industrial waste may pollute the nearby soil or adjacent water bodies, and can contaminate groundwater, lakes, streams, rivers or coastal waters. Industrial waste is often mixed into municipal waste, making accurate assessments difficult. An estimate for the US goes as high as 7.6 billion tons of industrial waste produced annually, as of 2017. Most countries have enacted legislation to deal with the problem of industrial waste, but strictness and compliance regimes vary. Enforcement is always an issue.

The Agency for Toxic Substances and Disease Registry (ATSDR) is a federal public health agency within the United States Department of Health and Human Services. It works closely with other federal, state, and local agencies; tribal governments; local communities; and healthcare providers. Its mission is to "Serve the public through responsive public health actions to promote healthy and safe environments and prevent harmful exposures." ATSDR was created as an advisory, nonregulatory agency by the Superfund legislation and was formally organized in 1985.

Superfund is a United States federal environmental remediation program established by the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA). The program is administered by the Environmental Protection Agency (EPA). The program is designed to investigate and clean up sites contaminated with hazardous substances. Sites managed under this program are referred to as Superfund sites. There are 40,000 federal Superfund sites across the country, and approximately 1,300 of those sites have been listed on the National Priorities List (NPL). Sites on the NPL are considered the most highly contaminated and undergo longer-term remedial investigation and remedial action (cleanups).

The Resource Conservation and Recovery Act (RCRA), enacted in 1976, is the principal federal law in the United States governing the disposal of solid waste and hazardous waste.

The Inter-Tribal Environmental Council (ITEC) was set up in 1992 to protect the health of Native Americans, their natural resources, and environment. To accomplish this ITEC provides technical support, training and environmental services in a variety of disciplines. Currently, there are over forty ITEC member tribes in Oklahoma, New Mexico, and Texas. The ITEC is an example of the Native American Pan-Indian Organizations and Efforts.

The California Department of Toxic Substances Control is an agency of the government of the state of California which protects public health and the environment from hazardous waste. DTSC is part of the California Environmental Protection Agency, with one thousand employees, and is headquartered in Sacramento. As of 2023, DTSC has regional offices in Berkeley, Chatsworth, Clovis, Commerce, Cypress, El Centro and San Diego and environmental chemistry laboratories in Berkeley and Pasadena. Meredith Williams has served as the director of DTSC since 2019.

The Energy Subcommittee on Environment, Manufacturing and Critical Minerals is a subcommittee within the House Committee on Energy and Commerce. Prior to 2009, it was known as the Subcommittee on Environment and Hazardous Materials; it was part of the Subcommittee on Energy and Environment from 2009 to 2011. In December 2010, Representative Fred Upton, the incoming chairman of the Energy and Commerce Committee for the 112th Congress, announced his intention to establish the Environment and Economy Subcommittee as a separate subcommittee. In January 2023, new Chair of the full committee Cathy McMorris Rodgers amended the subcommittee's jurisdiction, transferring responsibility for climate policy to the United States House Energy Subcommittee on Energy, Climate and Grid Security, while adding broader manufacturing policy to the jurisdiction of this subcommittee.

Title 40 is a part of the United States Code of Federal Regulations. Title 40 arranges mainly environmental regulations that were promulgated by the US Environmental Protection Agency (EPA), based on the provisions of United States laws. Parts of the regulation may be updated annually on July 1.

The environmental policy of the United States is a federal governmental action to regulate activities that have an environmental impact in the United States. As his first official act bringing in the 1970s, President Richard Nixon signed the U.S. National Environmental Policy Act (NEPA) into law on New Years Day, 1970. Waste management laws govern the transport, treatment, storage, and disposal of all manner of waste, including municipal solid waste, hazardous waste, and nuclear waste, among many other types. Waste laws are generally designed to minimize or eliminate the uncontrolled dispersal of waste materials into the environment in a manner that may cause ecological or biological harm, and include laws designed to reduce the generation of waste and promote or mandate waste recycling. These inputs form the basis of policy frameworks that influence solid waste management decisions. In the United States, the Environmental Protection Agency (EPA) regulates household, industrial, manufacturing, and commercial solid and hazardous wastes under the 1976 Resource Conservation and Recovery Act (RCRA). Effective solid waste management is a cooperative effort involving federal, state, regional, and local entities. Thus, the RCRA's Solid Waste program section D encourages the environmental departments of each state to develop comprehensive plans to manage nonhazardous industrial and municipal solid waste.

Certified Unified Program Agencies, or CUPAs, are local agencies that are certified by the Secretary of the California Environmental Protection Agency (CalEPA) to implement the CalEPA Unified Program elements in the CUPA's jurisdiction. The CalEPA Unified Program consolidates, coordinates, and makes consistent the administrative requirements, permits, inspections, and enforcement activities of six environmental and emergency response programs in California. There are many exemptions for fracking under United States federal law: the oil and gas industries are exempt or excluded from certain sections of a number of the major federal environmental laws. These laws range from protecting clean water and air, to preventing the release of toxic substances and chemicals into the environment: the Clean Air Act, Clean Water Act, Safe Drinking Water Act, National Environmental Policy Act, Resource Conservation and Recovery Act, Emergency Planning and Community Right-to-Know Act, and the Comprehensive Environmental Response, Compensation, and Liability Act, commonly known as Superfund.

The Reducing Excessive Deadline Obligations Act of 2013 is a bill that would change the frequency of reports from the United States Environmental Protection Agency (EPA) about solid waste regulations. Instead of being forced to automatically review the regulations every three years, the EPA would be able to review them on an as needed basis. It would also grant precedence to state financial requirements for hazardous substances over federal requirements. The bill was introduced on June 6, 2013, into the United States House of Representatives during the 113th United States Congress.
